State Board of Ed: We are in Charge

Kansas State Board of EdThe Kansas State Board of Education has sent a letter to Gov. Sam Brownback and state legislators reminding them of the board’s authority to set state education standards.

The Topeka Capital-Journal reports that the brief letter doesn’t mention specific measures before state lawmakers, but asks that legislators respect the board’s “constitutional responsibility for the general supervision of schools, which includes accrediting schools, providing for academic standards and the licensure of teachers.”

The letter was signed by board chairwoman Jana Shaver on behalf of the board. Shaver says the purpose of the letter was to clarify the board’s constitutional role. She also said that a measure before a House committee was the main impetus for the letter. That bill would ban Kansas’ current mathematics and English standards.

BREAKING NEWS: Weather Cancels Some of Special Olympics

Because of this weekend’s weather forecast for snow in Hays, most of the Kansas Special Olympics basketball tournament and activities have been cancelled.

According to Tim Respecial olympics kansas state basketball and cheerleading tournament logohder of Kansas Special Olympics, activities are cancelled from 5p.m. Friday through Saturday.

There will be no banquet or dance Friday.

Tonight’s opening ceremonies and activities through 5p.m. Friday are still scheduled.

KHAZ Country Music News: George Strait and Garth Brooks to Honor the Late Dick Clark at the ACM Awards

DICK CLARKGeorge Strait and Garth Brooks are teaming up for a joint performance at the ACM Awards in honor of the late Dick Clark, who began producing the ACMs in 1979. He passed away last year.  Also, the ACM Artist of the Decade Award will be renamed the ACM Dick Clark Artist of the Decade Award in his honor. George was given that award for the 2000s, and Garth took it for the ’90s.

Garth commends the Academy for renaming the trophy in honor of Dick Clark, saying, “There may be others who have contributed as much to the music industry, but there is definitely no one that has contributed more than Dick Clark.  He was music’s best friend, and a dear friend to me.”

George adds that Dick Clark made country accessible to a wider audience. He says, “Garth and I were so grateful when we each received the ACM Artist of the Decade Award, so it’s only fitting that we’ll be honoring him with this tribute performance at the ACMs.”

The 48th Annual ACM Awards will broadcast live on CBS from the MGM Grand Garden Arena in Las Vegas Sunday, April 7 at 8 p.m. Eastern.

State Senate Continues Budget Debate

Legislators are one step from beginning negotiations over how Kansas will spend some $14 billion on government programs in the next fiscal year.Capitol Building - KS 004

The Senate is scheduled to take final action Thursday on its version of the bill after debating the measure for nearly five hours Wednesday.

The House gave final approval to its version of the budget Wednesday.

Both bills generally follow spending recommendations laid out by Republican Gov. Sam Brownback. Each would spend some $6 billion in general state revenues and $8 billion from federal funds and other sources in each of the next two years.

Negotiator will try to forge a compromise on spending priorities before legislators are scheduled to take a one-month break starting in early April.

Company Barred from Operating in Kansas

Derek-Schmidt-150x150The Kansas attorney general’s office says an environmental services company has to repay about $2,400 after the company was accused of sending false billings to four cities in Kansas.

Kansas Attorney General Derek Schmidt’s office says in a release Wednesday that the attorney general’s office has entered into a consent judgment with Commercial Maintenance Chemical Corporation under the Kansas False Claims Act. The New York-based company was accused of sending false billings to four cities in Kansas after delivering free samples and unordered products.

The consent judgment demands repayment to Emporia, Cawker City, Wilson and Concordia and prohibits Commercial Maintenance Chemical Corporation from operating in Kansas again.

Moran’s Military Tuition Assistance Amendment Moving

Late Wednesday,  the U.S. Senate passed an amendment to the Senate Continuing Resolution (CR) cosponsored by U.S. Senator Jerry MoranMoran 1— a member of the Senate Veterans Affairs Committee — that reinstates the Tuition Assistance program for service members. The passage of this amendment will stop the suspension of Tuition Assistance benefits for members of the U.S. Army, U.S. Marine Corps and U.S. Air Force as a result of sequestration, and direct the Department of Defense to find savings elsewhere.

“Sacrifices in sequestration are to be expected, but we must be smarter with our spending decisions and make cuts in ways that do not intentionally and unnecessarily inflict hardship and aggravation upon our service men and women,” Sen. Moran said. “The passage of this amendment will reinstate the Tuition Assistance program, which gives our active-duty service members the quality education they deserve, and helps make certain our military has the best and brightest defending our freedom.”

In Fiscal Year 2012, approximately 300,000 service members participated in the Tuition Assistance program, which allows active military to attend school part time while serving their nation. During that time, active duty service members enrolled in the program took 870,000 courses and earned more than 50,000 degrees, diplomas or certificates.

The Administration’s decision to target the Tuition Assistance program exempted those who are already receiving aid, but prevented service members from submitting new requests for the assistance. The CR will now move to conference where the differences between the Senate and House versions will be reconciled. If included in the final CR, the Administration’s decision will be reversed, and the Tuition Assistance program will continue to be available to active duty service members.

Country Music Star Added to State Fair Lineup

Country music star Toby Keith has been announced as the latest act in this year’s Kansas State Fair in Hutchinson.khaz toby keith 20121018

The “Should’ve Been A Cowboy” and “American Soldier” singer is slated to perform at 7:30 p.m. Sept. 15 at the U.S. Cellular Grandstand. Ticket prices range from $20 to $100.

Keith joins a lineup that already includes Kansas, the Eli Young Band, Larry Gatlin and the Gatlin Brothers with Billy Dean, and Jars of Clay.

Personal and Family Protection Act

Last week the House debated an addition to the Personal and Family Protection Act also known as the Concealed Carry Act. The addendum added to the Act ensures Kansans have the right to protect themselves in public places where adequate security is not provided. Public places which have adequate security would not be required to allow concealed carry; however, if a public building is not able to guarantee the safety and security of the public then individuals would have the right to protect themselves by carrying a concealed weapon.

If a city decided they do not want to have guns in their buildings they must be able to guarantee there are not guns. Placing a sign saying guns are not allowed is not a deterrent and does not provide the public with a safe environment.

It is a shame how we are treating our legal citizens who have gone out of their way to obtain training from a licensed individual as well as a background check by the Kansas Bureau of Investigation. The individuals who have obtained a concealed carry license are not the same people who shoot up schools. We should not treat gun owners as criminals, but rather as another line of community defense.

 

The House passed HB 2055 by a vote of 84 to 38The bill is now headed to the Senate for further consideration and action. 

 

Unlawful Discharge of a Firearm

 

Thursday, the House passed HB 2052, a bill that would establish a uniform state law addressing unlawful discharge of a firearm within or into any city. The bill would define the unlawful discharge of a firearm as the reckless discharge of any firearm within or into the corporate limits of a city and would make such a violation a misdemeanor. Additionally, the bill would provide for circumstances in which a firearm may be discharged into or within a city without being considered unlawful.

 

One of the circumstances for when a firearm may be discharged into or within a city without being considered unlawful would be in the case of lawful defense of a person or property. Cities would be prohibited from enacting ordinances that would penalize discharging a firearm even if done in defense of person or property. This bill would unify the law for all Kansans, ensuring them the ability to use a firearm lawfully to defend themselves or others anywhere in the state.

 

The House passed HB 2052 by a vote of 121 to 2The bill is now headed to the Senate for further consideration and action. 

 Second Amendment Protection Act

HB 2199, passed by the House on Thursday, would exclude from federal regulation any personal firearm, firearm accessory, or ammunition manufactured commercially or privately and owned in Kansas. As long as any such firearm, firearm accessory, or ammunition remained in Kansas, the bill would provide that it would not be subject to any federal law, regulation, or authority. Also, the bill would prevent any federal agent or contracted employee, any state employee, or any local authority from enforcing any federal regulation or law governing a personal firearm, firearm accessory, or ammunition manufactured and owned in Kansas, provided it remained within the borders of Kansas.

 

HB 2199 would essentially reaffirm the Second Amendment, which guarantees the right of Kansans to keep and bear arms. The bill would also state that because the Constitution does not grant the federal government authority in this area, any leeway to determine how the Second Amendment right is exercised is the prerogative of the states. Thus, any attempts by the federal government to regulate the use of firearms manufactured and owned in Kansas would be considered unenforceable in the state of Kansas.

Farm Bureau Honors Huelskamp

The Farm Bureau has Huelskamp Farm Bureauawarded Kansas First District Congressman, Tim Huelskamp, the Friend of Farm Bureau Award for his outstanding service to the agriculture community during the 112th Congress. Congressman Huelskamp is a fifth generation farmer, and works to ensure that the voices of the farmers and ranchers in Kansas’ Big First District are heard in Washington.

Congressman Huelskamp released this statement regarding the award:

Swift Action Expected on House Abortion Bill

Abortion 001The Kansas House Wednesday approved a bill that blocks tax breaks for abortion providers. The bill also bans public schools from using instruction materials from organizations that provide abortions. The Republican leaders in the senate promise a quick vote on the measure. If passed, it would keep medical facilities and non profit groups that provide abortions from claiming tax credits or exemptions.
