Founder of NW Kansas Insurance Business Pleads Guilty

When Brooke Corporation declared bankruptcy in late 2008, hundreds of insurance franchises were forced out of business. courts-gavel

More than 200 jobs were lost in Phillipsburg, which once counted Brooke among its largest employers

On Thursday, Robert D. Orr, 59, formerly of  Smith Center pleaded guilty to one count of making false statements in a report to the Securities and Exchange Commission. In his plea, he admitted that while he served as founder and non-executive chairman of the board of directors of Brooke Corporation, the company filed a 2007 annual report (Form 10-K) that presented a more financially robust position for Brooke Corporation’s investment in Brooke Capital Corporation than was supported by the actual financial conditions within the company. Orr knew that the report omitted material facts including the specific number of failed Brooke Capital Corporation franchise locations and the exact or total amount of financial assistance being provided by Brooke Capital Corporation to under-performing franchises.

Co-defendant Leland Orr of Phillipsburg is set for trial Feb. 24, 2014. Robert Orr is set for sentencing Oct. 7. The parties have agreed to recommend a sentence of three years probation and a fine of $48,000.

primary representative for the Kansas Soybean Commission (KSC) on the NBB for 12 years and is retiring from the position.

“Harold has been a tremendous advocate for the biodiesel industry who will definitely be missed,” NBB CEO Joe Jobe said. “The industry has grown out of infancy to a billion-gallon industry due in large part to the efforts of champions like Mr. Kraus.”

NBB presented Kraus with a Friend of Biodiesel award June 11 at a membership meeting in Washington, D.C.

“Any time your peers pat you on the back you have to feel better,” Kraus said. “When I came on board, there were 55 members. Now, we’re in the hundreds. We’ve got a good number of people, and they’re doing their job.”

Biodiesel is made from an increasingly diverse mix of resources, such as soybean oil, animal fats and recycled cooking oil. It is the first and only “advanced biofuel,” as designated by the Environmental Protection Agency, that is produced on a commercial scale across the United States. It is produced in nearly every state in the country and is used in existing diesel engines without modifying them. In 2012, the biodiesel industry produced more than 1 billion gallons, supporting about 50,000 jobs across the country.

“From the start, the soybean checkoff has played a major role in developing the U.S. biodiesel industry, and soybean farmers like Harold have invested a lot of time, energy and resources into bringing American-made, high-performing biodiesel to the marketplace,” said Dennis Hupe, KSC director of field services. “The award never can express fully the thanks that Harold deserves for his dedication to the development of the biodiesel industry.”

Strong storms rolled across Kansas Thursday evening
Strong storms rolled across Kansas Thursday evening

7:30 a.m. Friday  update  Thousands of residents in south central Kansas remain without power after storms swept through the region, downing trees and power lines.

Most of the damage from Thursday’s storms was reported near Wichita, where about 13,000 customers remained without power early Friday, down from a peak of about 21,000. The utility said it hoped to have power restored by Friday night. Power outages also were reported in Harvey, McPherson and Reno counties.

The National Weather Service says winds topped 70 mph, causing limbs to fall on cars and homes and knock down power poles. Winds also damaged some fireworks stands set up for the upcoming holiday.

The Kansas Highway Patrol says winds blew over a semi-trailer truck on the Kansas Turnpike Thursday evening. The driver was hospitalized with critical injuries.

5 a.m. Friday The strong storm that swept the state on Thursday evening brought  three dozen reports of large hail, quarter size up to softball size. There were as many as 90 reports of wind gusts in excess of 60 miles per hour including several reports of 80 to 90 mile per hour wind in McPherson and a 76 mph wind gust reported in Rush County, near Otis.

The Wichita area had reports of 69 to 89 mph wind. Several thousand Westar customers in Wichita and other parts of central Kansas are without electricity today due to downed power lines.

The electricity for parts of Ellsworth was knocked out. According to the Ellsworth Police Department there are reports of damage to trees, cars and electrical poles. Officials are working to asses total property damage in the community. We will have more information as it becomes available.

Ford Vehicle Recall

(AP) — Ford is recalling just over 13,000 Explorer, Taurus and Lincoln MKS cars and SUVs because the child safety locks might not work on the rear doors.Ford

The recall affects 2013 model cars sold mainly in the U.S., Canada and Mexico.

Ford says the safety locks can be turned off when the doors are opened or closed. That could allow a door to be opened with the inside door handle and possibly hurt a child. The company says no injuries have been reported from the problem.

The recall covers cars and SUVs built from Nov. 29 to Dec. 12 of last year. Dealers will test the locks and replace door latches if needed at no cost to owners.

Senator MORAN On CFTC Complaint against MF Global VIDEO

U.S. Senator Jerry Moran (R-Kan.) released the following statement today regarding the Commodity Futures Trading Commission’s investigation of MF Global:

“During my conversation with CFTC Chairman Gensler earlier this week, I asked about the CFTC’s investigation of the downfall of MF Global. Though the Chairman offered no specifics, he agreed that violations of customer protection laws should be actively pursued as both civil and criminal violations.

“In light of today’s complaint, I remain convinced that the CFTC should press on with their coordinated efforts with authorities as they weigh the appropriateness of further charges stemming from the collapse of MF Global. It is necessary for U.S. authorities to hold the perpetrators fully accountable for any illegal activity. If we are to restore the country’s faith in American financial markets, our regulatory and judicial systems must reaffirm that lawbreakers are brought to justice regardless of their wealth or influence.

“While I have questioned Chairman Gensler about his involvement in the CFTC’s pursuit of MF Global, I encourage the Commission to continue to investigate the decisions and events that resulted in inappropriate use of customer segregated funds and deteriorated consumer faith in our financial system.”

Harvest Update: Cutting Past Halfway in the Region

Combines are running from Norton to Marshall counties along the Nebraska border, as the 2013 harvest gets into the second big week of harvesting.wheat grain cart auger

Midland Marketing in Hays believed that many farmers in this area are finishing their harvest. They thought that 80% of the wheat adjacent to town was cut and yields were varied from 5 -50 bushels an acre with an average of 25 -30.

The staff at Golden Belt in Ellis also believe harvest was past the half way point and the most recent yields averaged 25 bushels an acre.

At Cargill in Trego County, Caleb told Hays Post, “I don’t think harvest is at the half way. There is a lot more to come in from the north and northwest area of the county. We have taken in approximately 300,000 bushels in the WaKeeny elevator so far.”

Ag Valley Co-op in Norton has seen scattered activity in the last few days, with just a few thousand bushels of wheat taken in. The crop so far has 55-56 pound test weights, but it is too early for yield and protein information. Many fields still have green cast to them, but harvest should get into full swing by early next week.

Travis Mason, manager of the Southeast Nebraska Co-op location in Herkimer, says farmers are bringing in wheat in northern Marshall County. Test weights are 60 pounds or higher, and yields are in excess of 60 bushels per acre. No protein values have been received yet.

Highway 14 seems to be a dividing line for good yields and quality, according to Jeff Bechard, president of AgMark, LLC in Beloit. The company markets grain for 20 elevators from Cawker City east to Leonardville, and Westfall north to Jewell. Wednesday was the first day that the entire area had good harvest conditions. Yields range mostly from 35 to 65 bushels per acre, with the better wheat in the eastern side of Hwy. 14; protein ranges from 9 to 11 east of Hwy. 14 and 11 to 14 west of Hwy. 14. About 25% of the crop is harvested in AgMark’s trade area, and Bechard expects this crop to be above average in terms of total bushels received.

Duane Reif, manager at the United Ag Service location in Hoisington, says the area harvest is about 50% complete. Test weights at the Hoisington location range from 56 to 62 pounds per bushel, protein from 13 to 16 and yields range from 20 to 50 bushels per acre. At the company’s Stickney location just 10 miles north, test weights average above 60 pounds per bushel and yields range from 40 to 60 bushels per acre.

Doug Johnson, manager of the Scott Cooperative location in Marienthal, says harvest just got started on Monday. At 60 pounds per bushel on average, test weight is a bit better than he expected, but yields are poor, ranging from 15 to 20 bushels per acre. In isolated cases where showers fell last fall, some farmers report 30 bushel per acre yields. However, much of the area’s crop has been destroyed. Johnson says early protein tests show 11.7 protein, but will probably improve as harvest continues. This location will take in about 35% of an average crop.

The 2013 Harvest Report is brought to you by the Kansas Wheat Commission, Kansas Association of Wheat Growers and sponsors Kansas City Board of Trade, and the Kansas Grain & Feed Association.

New Kansas law will require roofers to register

(AP) — A new Kansas law taking effect Monday will require roofing contractors to register annually with the attorney general’s office before they can be paid for Roof worktheir work.

The new law was enacted this year by legislators and is designed to protect consumers. It had the support of Attorney General Derek Schmidt, AARP and the roofing industry itself.

The law says that roofing contractors must obtain an annual certificate from the attorney general’s office to solicit business or collect fees for residential or commercial jobs.

Roofers must be at least 18 years old, and they or their companies must show that they carry $500,000 in liability insurance.

The attorney general’s office expects to charge a $250 annual registration fee.

Ex-Kansas Airman convicted of $55K fraud

(AP) — A former Kansas Air Guard National member has been convicted of fraudulently receiving nearly $55,000 in benefits by claiming she was commuting to a court-gavel-300x192.pngWichita base from Arizona.

The U.S. Attorney’s office says a jury on Thursday found 28-year-old Wichita resident Eledria J. Bradley guilty of one count of wire fraud.

Bradley was a senior airman assigned to McConnell Air Force Base in Wichita. Prosecutors said she used an online system for service members to change her address from Wichita to Chandler, Ariz., which put her outside the commuting distance from McConnell.

Prosecutors said the phony address allowed Bradley to collect nearly $55,000 in lodging and per diem benefits from April 2009 until April 2011.

A sentencing date has not been set.
