The Kansas Bureau of Investigation is investigating an incident involving the Hamilton County Sheriff that occurred in the early morning hours on Sunday,

September 15, 2013.
The Hamilton County Attorney, Rob Gale, requested a special prosecutor and Scott County Attorney John Shirley has been appointed.
Shirley told The Associated Press the incident involving Sheriff Richard Garza was a “family matter” and that there was no physical violence.
Garza was arrested at his home in Syracuse on suspicion of aggravated assault. He has been released on bond.
Law enforcement agencies in the area declined to comment or did not return calls.
