Kansas special session raises new sentencing issues

(AP) — Kansas legislators plan to make quick work of fixing the state’s “Hard 50” criminal sentencing law during their special session this week.Kansas capitol

But their discussions ahead of Tuesday’s opening gavels have raised other issues about punishing murderers.

Lawmakers from both parties see widespread agreement on legislation to rewrite the law allowing convicted murderers to be sentenced to life in prison with no chance of parole for 50 years. A U.S. Supreme Court decision in June raised questions about the law’s constitutionality.

But in working on the quick fix last week, legislators already were pondering whether a repaired “Hard 50” law is tough enough. That, in turn, is likely to spur debate about the Kansas death penalty law, which was enacted in 1994 but so far has resulted in no executions.

 

Kansans to re-enact Civil War Battle

Screen Shot 2013-09-02 at 8.21.01 PM(AP) — More than 30 Kansans are going to Georgia this month to recreate a 150-year-old Civil War battle.

Besides re-enacting the Battle of Chickamauga, the soldiers will hold a memorial service to honor the spot where the 8th Kansas Volunteer Regiment experienced its worst moment.

The  regiment was organized in 1861, months after the start of the Civil War. It was to be a Home Guard Unit but was soon called elsewhere.

Kansas historian and filmmaker Ken Spurgeon says the unit was the state’s busiest and lost 54 percent of its men and four flag bearers at Chickamauga. He says their graves need to be visited, marked and memorialized.

River search for Kansas fisherman UPDATE

2:45 p.m. (AP) — Authorities have found a man’s body in the Kansas River downstream from where a man went missing.

Kansas City, Kan., police said in a news release that the discovery was made around 12:30 p.m. Monday. Authorities are still working on positively identifying the victim and notifying has family.

Authorities received a report early Sunday that a man had disappeared while swimming in the river, which is also known as the Kaw. Emergency crews scoured the river and its bank throughout the day Sunday and then returned Monday to continue the search.

Kansas county’s land sale draws little interest

(AP) — Geary County is having trouble unloading housing lots that were partially developed in expectation of a population boom from the return of the Army’s 1st

Developers abandoned the lots when the boom failed to materialize, and hundreds of sites are now in tax delinquency.

A recent tax sale of 280 lots ended with just 24 sold, for a total of about $2,300.

Some lots already have streets, water and other infrastructure. But many potential buyers were put off by special assessments of up to $2,000 a year on each parcel for 15 years.

For now, the county remains in the realty business, when what officials really want is to get the properties back on the tax rolls.

Deputy shot, Police looking for suspect

AP) — Authorities are searching for a man who they say shot and wounded a Butler County Sheriff’s deputy early Monday morning.

Police say the suspect is 41-year-old Jan Tracy Kilbourne.

Butler County Sheriff Kelly Herzet says that a deputy pulled over a car around 5 a.m. on Kansas Highway 54, about 16 miles east of Wichita.

Herzet said the deputy ran a warrant check on the three people inside and returned to the car when one of the passengers got out and fired at the deputy, striking him in the shoulder. He said the deputy returned fire and hit the man, who ran off afterward.

The Wichita Eagle reported the deputy is in fair to serious condition. His name has not been released.

The other two people are in custody.

 

 

 

 

 

 

 

Kansas man gets Nebraska prison time for crash death

(AP) — A Kansas man has been given 20 years in a Nebraska prison for vehicular homicide in Lexington.Prison Wire Fence

23-year-old Destry Swartz, of Coats, Kan., was sentenced Friday. He’d pleaded guilty to vehicular homicide while driving drunk and to flight to avoid arrest. Prosecutors dropped three other charges in exchange for Swartz’s pleas.

The Nebraska State Patrol says Swartz violated a Lexington traffic signal and raced south on U.S. Highway 283 to get away from a state trooper on Oct. 8 last year. The patrol says Swartz ran a red light and slammed into a pickup driven by 68-year-old Ruben Maravilla-Cortes, of Lexington. Maravilla-Cortes died at the scene.

Updated Ellis County Registered Offender Map

Updated Registered Offender Map for Ellis County and update on offenders that have moved during the past 30 days.

The registry of offenders is compiled by the Kansas Bureau of Investigation and lists the names, offenses, and addresses of Kansans convicted of certain sexual, violent, and drug crimes.

The registry includes information about offenders who committed crimes after April 14, 1994.

Three type of offenders are listed in the registry: sexual, violent and drug offenders.

There are a wide range of crimes that can land someone on the registry. For instance, someone might have to register as a sex offender for crimes such as prostitution, sexual battery or rape.

Violent crimes that can require registration include such crimes as murder, kidnapping, or an assault with a deadly weapon.

Drug crimes that require registration can include drug manufacturing, selling or possession of certain substances.

One killed, three injured in Western Kansas rollover crash

A man was killed and three others were injured in a rollover accident in Hodgeman County on Sunday evening.KHP

According to the Kansas Highway Patrol twenty-seven year old Carlos Perez-Gonzalez of Dodge City was driving a 2005 Ford Expedition westbound on H road, 5 miles south of Jetmore. The vehicle came to the top of a hill traveling too fast for road conditions. The driver lost control and the vehicle started to skid from ditch to ditch. The vehicle rolled 4 times coming to rest on the drivers side facing southeast in a field on south side of the highway.  A passenger in the vehicle Manuel Perez-Gonzalez age 33 of Dodge City was not wearing a seat belt. He died at the scene of accident.

The driver, Carlos Perez-Gonzalez was transported to the Hodgeman County Health Center and then flown to a hospital in Wichita. Two other passengers in the vehicle Jamie Cancino age 35 of Dodge City and Cristobal J Juandiego age 32 of Ford were transported to the hospital in Jetmore. Only Juandiego was wearing a seat belt.
