Suspect to face trial in Kansas deputy’s shooting

(AP) — A 41-year-old man will stand trial for attempted capital murder and other charges in the shooting of a Butler County sheriff’s deputy.

The Butler County District Court Judge David Ricke ruled Friday that there was probable cause to bind Jan Tracy Kilbourne over for trial. Prosecutors allege that Kilbourne fired the round that injured Deputy Jacob Lawrence on Sept. 2 near Augusta.

Kilbourne was captured after a four-day search. He also faces one count of criminal possession of a firearm by a convicted felon and one count of interfering with a law enforcement officer stemming from the Labor Day incident.

Butler County Attorney Darrin Devinney says Kilbourne’s trial is set for Dec. 16. Kilbourne is jailed in Butler County on $1 million bond.
