Roberts Demands Details of Unwarranted Searches of General Aviation Aircraft

Roberts U.S. Senator Pat Roberts and seven others sent a letter to the Acting Secretary of the U.S. Department of Homeland Security, Rand Beers, requesting an explanation for a rise in unwarranted stops and searches of U.S. general aviation (GA) aircraft that had not crossed the U.S. border by Customs and Border Protection.

“There is a lot of justified frustration from pilots who feel their constitutional rights may have been violated,” Roberts said. “We need to know all of the facts behind these stops and searches to ensure our constituents are not being unlawfully singled out by the federal government.”

Senator Roberts was joined on the letter by Senators James Risch (R-ID), James Inhofe (R-OK), John Boozman (R-AR), Jerry Moran (R-KS), Mike Crapo (R-ID), David Vitter (R-LA) and Mike Johanns (R-NE).

The following is the text of the letter sent:

Dear Secretary Beers:

Recent reports and first-hand accounts from pilots indicate a significant rise in the number of unwarranted stops and searches of U.S. general aviation (GA) aircraft that did not cross the U.S. border by the Air and Marine Division of the Customs and Border Protection (CBP) agency.

While we appreciate law enforcement efforts to protect our national interests and combat illegal activity, the abrupt increase in the number of stops and searches of personnel aboard general aviation aircraft raises concerns that CBP may be violating our citizens’ Fourth Amendment rights.

It is our understanding that in ongoing communications between the CBP and Members of Congress that CBP has claimed authority under 14 C.F.R. §§ 61.3(l) and 91.203, and 49 U.S.C. § 44103(d) for conducting these stops and searches of GA aircraft. We do not disagree that agents working for CBP have limited authority to stop a plane and ask for proof of an airman certificate, medical certificate, authorization, or license. However, we wholly disagree with agents demanding access to search an aircraft without reasonable suspicion or probable cause that illegal activity is occurring.

No later than November 15, 2013, please provide us with the following information:

–          A record of every stop and search of general aviation aircraft in the United States by CBP agents since the beginning of calendar year 2009. These records should be broken down by state and should include the relevant facts surrounding each search. Specifically, we want to know the reason(s) these searches took place, what “reasonable suspicion” existed that led to a stop and what “probable cause” CBP agents had to conduct these searches.

Senator Roberts is an outspoken advocate of General Aviation.

KBA sees significant drop in revenue

kba logo (AP) — Total revenue for the Kansas Bioscience Authority dropped by 45 percent this fiscal year, and most of the loss was attributed to a decrease in state funding.

The KBA’s latest financial report says state support went from $14 million in the 2012 fiscal year to $3.2 million in fiscal year 2013.

The KBA, a state-funded business accelerator that invests in ventures related to animal and human health, agriculture and bio-energy, was created in 2004. Since then it has invested $272 million in 90 companies and institutions.

Total revenues for the KBA are at about $8 million, down from $14.5 million in 2012. Expenses also dropped slightly, from $3.3 million at this time last year to $2.8 million in 2013.

High School Football Players Arrested In Hazing Incident UPDATE

Handcuffs20

1:40 p.m.AP) — Three students at Hutchinson High School are accused of forcibly branding other students on school property.

Police say the students are accused of branding four other students on their abdomens with wire hangers. All of the students, including the victims, are on the football team.

Hutchinson Police Detective Paul Sack says police learned of the branding from parents of the alleged victims.

Ray Hemman, spokesman for the school district, says head football coach Randy Dreiling learned Thursday of an alleged hazing incident that possibly occurred Wednesday and turned the matter over to administrators and police.

One 18-year-old student is being held on various charges, including criminal restraint. Another 18-year-old was released on bond. A 16-year-old student is being held by juvenile authorities.

Friday  p.m. Several students at Hutchinson High School have reported they were battered by other students of the school. On Friday police made three arrests of students who are said to be  members of the Hutchinson High School Football team.

18-year-old Kendric S. Hudson was arrested for aggravated battery, criminal restraint, hazing and tattooing and body piercing a minor without their consent.

18-year-old Jaiden M. Casanova was also arrested for aggravated battery,.tattooing, body piercing a minor without their consent and hazing.

16-year-old Cody R. Curl, was taken to the Reno County Juvenile Detention Facility on charges of aggravated battery, tattooing and body piercing without consent and possession of tobacco.

Casanova is free on bond, while Hudson is jailed on a 12-thousand  dollar bond.

Another step toward decriminalizing pot possession

Marijuana 001(AP) — The District of Columbia is on the fast track toward decriminalizing possession of small amounts of marijuana.

The D.C. Council is poised to approve a bill that would make possession of less than 1 ounce of pot a civil offense, punishable by a fine as low as $25. Democratic Mayor Vincent Gray says he supports it. He could sign the bill as early as January.

Some activists want the city to go further by legalizing marijuana. They’re considering a ballot initiative if the council doesn’t take that step.

D.C. leaders have long been cautious about pot, in part because Congress has the final say on city laws. Congress held up medical marijuana in D.C. for a decade. But with 17 states having some form of decriminalization, many believe Congress won’t intervene.
