One injured in Wednesday crash

KHPOne person was injured in a Wednesday crash in Russell County.

According to the Kansas Highway Patrol sixty eight year old John W. Brown of Rancho Cucamonga, California was driving a 2014 GMC 4 wheel drive vehicle in the left lane and a 2000 GMC Freightliner driven by forty-four year old Javier Carmona-Ceballos of Kissimmee, Florida was in right lane of Interstate 70 westbound approaching the rest area entrance, east of Russell.

The semi truck changed lanes and hit the GMC.

Sandra M. Brown age 64 of Rancho Cucamonga, California, a passenger in the GMC, was transported to the hospital in Russell. No other injuries were reported. All were wearing seat belts.

Huelskamp to take part in Kansas Pro Life Rally

HuelskampOn Friday, Congressman Tim Huelskamp (KS-01) will join with St. John’s Catholic High School for their annual pro-life prayer vigil. It will take place outside the former George Tiller abortion clinic in Wichita, Kansas. Created five years ago, the St. John’s event has grown nationwide — asking schools to join them in prayer for the unborn. Congressman Huelskamp made the following statement about the upcoming event:

“It is said that a society is judged by how it treats its weakest members. If that is the barometer by which America is to be judged, then America is failing because millions of defenseless unborn children and mothers that have fallen victim to abortion. Every life is precious and irreplaceable. I am humbled to join these courageous students from St. John’s High School who are committed to protecting and defending the lives of the unborn.”

DA: Officers justified in standoff shooting

Law 003 court(AP) — The Sedgwick County district attorney says law enforcement officers were justified in a fatal shooting that ended a 32-hour standoff at an apartment complex.

District Attorney Marc Bennett said Wednesday no officers will be charged in the death of 24-year-old Jared Woosypiti.

Woosypiti holed up at the Southlake Village Apartments in south Wichita for 32 hours last July before dying in a gunfight.

Bennett said Woosypiti fired at officers twice before they shot him. The fatal shooting came only after officers used several other tactics to end the standoff, including tear gas and water cannons.

Bennett says during the standoff, Woosypiti said he wouldn’t go back to prison and threatened to set off explosives.

Brownback: rural housing may be issue in 2014

Brownback(AP) — Gov. Sam Brownback says creating a new rural housing program may be on Kansas legislators’ agenda next year because communities see it as important to attracting new workers.

Brownback said during a meeting of economic advisers Wednesday that as he’s traveled across the state, he has advised rural lawmakers to get together to deal with housing issues.

The  meeting of the economic advisers focused on rural housing needs. The group heard multiple cases of rural communities having housing shortages.

Cohen-Esrey Real Estate Service CEO Lee Harris called the state’s $2.3 million low-income housing program “paltry.” He suggested that the state use some of the taxes paid by insurance companies on the value of premiums for tax breaks for rural housing developers.

 

Yeverino, Cabral Named to All-America Team

https://www.horizonappliance.com/After the most successful season in school history, the Fort Hays State University men’s soccer team had two players – Diego Cabral and Ricardo Yeverino – named honorable mention on the 2013 Daktronics NCAA Division II Men’s Soccer All-America Team, as announced by Daktronics on Wednesday.

The duo has combined to hold nearly every offensive school record, and helped the Tigers finish 12-5-3 en route to reaching the finals in the Central Regional of the NCAA Tournament.

Yeverino, a senior from Dodge City, Kan., led the Tigers with 28 points on the season, scoring 11 goals and adding six assists.  In 1,485 minutes of action, Yeverino had a .585 shot on goal percentage and four game-winners.  The forward finished his career with just less than 3,000 minutes logged (2,994) and 26 goals.  In two years of wearing an FHSU jersey, Yeverino rose atop the school’s career record book in points per game (1.75), goals (26), goals per game (0.72), game-winning goals (eight), shots per game (3.89), shots on goal (79) and shots on goal per game (2.19).  Additionally, Yeverino is second in career points (63), assists (11), assists per game (0.31) and shots (140).

Cabral, a junior from Asuncion, Paraguay, finished the 2013 season with 23 points, notching seven assists and eight goals.  As a midfielder/forward combination, Cabral played 1,598 minutes and had two game winners while adding 48 corner kicks and had a .481 shots on goal percentage.  Cabral has played three seasons for the Tigers and holds career records in points (66), assists (26), assists per game (0.46) and shots attempted (158).  Cabral is second in career points per game (1.16), goals (20), shots per game (2.77), shots on goal (77), shots on goal per game (1.35) and penalty kicks made (three).

FHSU Baseball Announces Signing

https://www.horizonappliance.com/Fort Hays State head baseball coach Steve Johnson announced the signing of Connor Boyer from Southeast of Saline High School in Gypsum, Kan. Boyer is currently a senior in high school and will join the program in 2014-15.

Boyer, a pitcher and corner infielder, is a two-time first team all-league selection at Southeast of Saline. As a junior in 2013, he hit .578 with 27 RBI and 37 runs scored, while helping the Trojans to a league title. He played American Legion ball for the Salina Pestinger Falcons in the summer of 2013, hitting .370 with 31 RBI and 41 runs scored. As a pitcher for the Falcons, he posted a 0.98 ERA and 18 strikeouts in 14.1 innings of work.

“We are excited to have Connor join the Tiger Baseball family next year,” said Johnson. “He does a great job both on the field and in the classroom and we’re looking for great things out of him in the future here at Fort Hays State.”

Salina Police have released video of a suspect who stole a computer from a waiting area for families in the pediatric wing of Salina Regional Health Center.

The HP thin client desktop computer was on a counter top and was taken from the waiting area just before 7:00 p.m., on December 1st. The computer is valued at $1,000 and damage caused by removing the computer placed at $100.

Restaurant Owner Charged With Drug Trafficking and more

Gerald BeasleyA Wichita restaurant owner has been charged with drug trafficking, firearms violations, bank fraud and money laundering, U.S. Attorney Barry Grissom said today.

Gerald Beasley, 58, Andover, Kan., was charged in June with one count of unlawful possession of a firearm after a felony conviction.  A 23-count superseding indictment returned by a grand jury Wednesday in U.S. District Court in Wichita includes the following charges:

  1. Three counts of unlawful possession of a firearm after a felony conviction.
  2. Three counts of unlawful possession of a firearm in furtherance of drug trafficking.
  3. One count of maintaining a drug involved premises at 1122 N. Piatt in Wichita.
  4. One count of maintaining a drug involved premises at Tiara’s Place, a restaurant at 1339 N. Hillside in Wichita.
  5. One count of possession with intent to distribute heroin.
  6. One count of possession with intent to distribute cocaine.
  7. One count of possession with intent to distribute crack cocaine.
  8. One count of conspiracy to possess with intent to distribute five kilograms or more of cocaine.
  9. One count of conspiracy to possess with intent to distribute 280 grams or more of crack cocaine.
  10. One count of conspiracy to possess with intent to distribute one kilogram or more of heroin.
  11. One count of conspiracy to commit bank fraud.
  12. Five counts of bank fraud.
  13. Two counts of money laundering.
  14. One count of conspiracy to commit money laundering.

The indictment alleges investigators monitored Beasley’s telephone calls and examined his tax records, bank records and real estate purchases to obtain evidence that he derived his income from criminal activities including drug trafficking and counterfeit checks.  Law enforcement officers served search warrants in June and seized more than $229,000 from bank accounts and $346,000 in cash from residences and a business location.  They also seized firearms, ammunition, controlled substances and drug trafficking paraphernalia.

Other allegations in the indictment include the following:

  • Tiara’s Place restaurant, owned by Beasley, reported $104,864 in gross receipts for July 1, 2003, through Dec. 31, 2012. The restaurant’s total gross income reported to the Internal Revenue Service during the same period was $493,707.
  • Law enforcement officers determined Beasley operated a counterfeit check and identity theft operation locally and in other states. He made counterfeit checks, recruited people to cash the checks and then split the cash proceeds with the check passers. He provided cars he owned or rented for their use while passing counterfeit checks.
  • Beasley unlawfully possessed firearms and ammunition despite being prohibited from doing so because of a prior felony conviction.

The government is seeking the forfeiture of all money and property representing the proceeds of the crimes including the following real estate owned by Beasley: 660 N. Estelle, 1322 N. Estelle, 1815 E. 23rd, 907 N. Wabash, 2341 N. Piatt, 618 Hedgewood (Andover), 2001 Colt Court (Andover), 2826 E. 23rd, 1648 N. Estelle, 907 and 907 1/2 N. Cleveland, 655 N. Estelle, 1118 N. Piatt, 1728 McFarland, 2244 N. Kansas, 1339 N. Hillside, 1343 N. Hillside, 3623 E. Funston, 1122 N. Piatt, and 1304 N. Grove.

Upon conviction, the alleged crimes carry the following penalties:

  • Unlawful possession of a firearm after a felony conviction, a maximum penalty of 10 years in federal prison and a fine up to $250,000.
  • Unlawful possession of a firearm in furtherance of drug trafficking: Not less than five years — consecutive to a sentence on the underlying drug charge — and a fine up to $250,000.
  • Maintaining a drug involved premises: A maximum penalty of 20 years and a fine up to $500,000.
  • Possession with intent to distribute heroin: Not less than five years and not more than 40 years and a fine up to $5 million.
  • Possession with intent to distribute cocaine and crack cocaine: A maximum penalty of 20 years and a fine up to $1 million.
  • Conspiracy to possess with intent to distribute cocaine, crack cocaine and heroin: Not less than 10 years and a fine up to $4 million.
  • Conspiracy to commit bank fraud and bank fraud: A maximum penalty of 30 years and a fine up to $1 million.
  • Money laundering: A maximum penalty of 20 years and a fine up to $500,000.

The following agencies worked on the case: Wichita Police Department, the Sedgwick County Sheriff’s Office, the Drug Enforcement Administration, the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Internal Revenue Service and the Sedgwick County District Attorney’s Office. Assistant U.S. Attorney Debra Barnett and Special Assistant U.S. Attorney Michelle Jacobs are prosecuting.

Hays Winter Art Walk

HAC 2012-2013 5 State Photography ContestThe Hays Art Center (HAC) is hosting their Winter Art Walk Friday, December 6th.  The anchor to the art walk is the opening reception for the 30th Annual Five State Photography Exhibition.  HAC Executive Director Brenda Meder told Hays Post that the photography exhibition will open to the public at 7:00 pm, though some of the guest photographers will be seen entering the gallery before then.

Around 450 entries were received for the photography contest, and from those over 160 were selected for exhibition.  Meder said that this year, the exhibition will be dedicated to Jack Logan, who passed away in August.  Logan had been a long time supporter of HAC, the photography contest, and the Hays community, and some of his work will be showcased during the art walk as well.

Meder added that there are a few places a little ways from Main Street (designated below with *) that offer unique exhibits as part of the art walk.

“I really want to encourage people to take advantage of that; check out those sites that are a little off the beaten path because they will be worth it.”

The Governing Body of the City of WaKeeney, Kansas met in a regular session at City Hall 408 Russell Ave at 7:00 PM with the Mayor presiding and the following members present:

The minutes of the previous meeting were approved as written, printed and distributed.

Jason Hickson, Trego REC Director and members of the Trego REC Board of Directors were present before the City Council to discuss the idea of relocating the north Legion baseball field onto city owned land adjacent to the south ball fields and then redeveloping the north field into residential housing lots. The idea was discussed at length but no decision was made pending additional cost and funding information.

CHIEF OF POLICE: Terry Eberle provided his monthly departmental report. Also presented was Ordinance #1432 allowing for the operation of special purpose vehicles (ATV’s, golf carts, worksite utility vehicles) within the city upon receiving a permit from the police department. After a short review, Allen Weigel motioned to approve ordinance #1432, Troy Leiker seconded. Motion carried.

CITY ADMINISTRATOR: City Administrator Hardy Howard discussed providing WAMPUM bucks to the employees as a Christmas bonus. A motion was made by Mary Jo Clevenger and seconded by Lynelle Shubert to allocate $50 WAMPUM per employee. Motion carried.

The city’s five year Capital Improvement Plan was reviewed by the Governing Body.

No further business appearing, the meeting was adjourned.

Mayor Lyle Johnston called the meeting to order at 7:30 p.m. Present were Council members Jeff Wolf, John Walz, John Leiker, Jolene Niernberger, Loran Gottschalk and Terry Redetzke.  Also present were Public Works Director Alan Scheuerman, City Clerk Amy Burton, Police Chief Taft Yates, Fire Chief Denis Vine, and City Attorney Olavee Raub.

Councilmember Jolene Niernberger moved to approve the consent agenda containing the Minutes from Regular Meeting on November 18, 2013, Bills Ordinance #1938, and the October manual journal entries. Councilmember Terry Redetzke seconded the motion. The Council approved the consent agenda unanimously.

PUBLIC COMMENTS

John Kroeger addressed Council about a water leak he had outside of his house.  The leak was fixed the same day it was discovered.  Mr. Kroeger asked Council for an adjustment on his utility bill to have the additional 11,000 gallons attributed to the leak charged at the regular water rate, rather than the water conservation rate.  Council member Jolene Niernberger moved and Council member John Walz seconded a motion to adjust Mr. Kroeger’s October 1, 2013 utility bill to reflect all water usage at the regular water rate of $3.58 per thousand gallons.  Motion carried unanimously.

SPECIAL ORDER

Water: Committee

Ron Johnson provided an update from the recent Water Advisory Committee meetings.  The Committee recommends amending Ellis City Code Section 15-507 to shorten the allowed outdoor watering times under Stage 1 and Stage 2.  The Committee proposes only allowing watering from 6:00 a.m. – 10:00 a.m. and from 8:00 p.m. – 11:00 p.m.  (Ellis is currently in Stage 3 Water Emergency and NO outside watering is allowed at this time.)  The Committee also proposes to leave the current fine schedule as is.  Mr. Johnson then relayed a conversation Committee member John Douglas had with Kelly Stewart from the Kansas Division of Water Resource office.  The City of Ellis has 567 acre feet included in its current water right.  However, the Water Resource office recognizes that the City does not have 567 acre feet of water available.  Therefore, the State will allow the City to explore water sources outside of our water right without penalty.  Mr. Johnson would like to have Mr. Stewart talk to the Council and the Water Advisory Committee in a work session to discuss the steps needed to begin the water exploration process and to see if the process is something the City is interested in.

UNFINISHED BUSINESS

Water: Repair/Maintenance

Public Works Director Alan Scheuerman presented two bids for inspection and cleaning of the water tower.  Mr. Scheuerman recommends the low bid from LiquiVision.  This item was budgeted for in 2014; therefore this item will be tabled until January.

Swimming Pool: Capital Outlay

Public Works Director Alan Scheuerman asked for reconsideration of the purchase of a DuraMAX Duo Commercial Pool Cleaner.  Council considered the purchase in September and tabled the item until closer to year end to ensure funding was available.  Mr. Scheuerman recommends the low bid from Aqua Products K.C. in the amount of $4,325.00.  Council member John Walz moved to approve the purchase of the DuraMAX DUO Commercial Pool Cleaner from Aqua Products K.C. in the amount of $4,325.00 with funds to come from General Fund – Swimming Pool.  Council member Jolene Niernberger seconded the motion.  Motion carried unanimously.

NEW BUSINESS

Personnel: Entry – Fire

Fire Chief Denis Vine asked for approval to add Chris Lee to the volunteer fire department.    Council member John Leiker moved and Council member John Walz seconded a motion to approve Chris Lee as a volunteer fireman.  Motion carried 6-0.

Fire: Capital Outlay

Chief Vine continued by presenting bids from Hays Fire and Rescue Sales and Service, LLC and Municipal Emergency Services, Inc. for 750 feet of 4” supply line fire hose.  Both bids state that shipping will be added to the bid but do not state a firm price.  Council would like to table this item until the next meeting in order for Chief Vine to obtain a firm total price for the supply line.

Personnel: Salary

City Clerk Amy Burton presented the 2014 pay rates for City employees.  The proposed rates reflect the 2% wage increase as approved during the budget process, and the certification pay as discussed at the September 3, 2013 Council meeting.  Ms. Burton also presented an addition to the Personnel Policy outlining the certifications/specializations that will be recognized for the enhanced pay.  One revision that needs to be made is clarifying that the $50.00 per month salary listed for volunteer firemen is for the Fire Department Treasurer only, not all of the firemen.  Council member John Walz moved to approve the 2014 Wage Structure as presented with the revision clarifying the Fire Department Treasurer’s salary, and the attached certification list.   Council member Jolene Niernberger seconded the motion.  Motion carried 6-0.

Personnel: Salary

In previous years, Council has approved a Christmas bonus for all full-time and part-time employees.  Council member John Walz moved and Council member Jeff Wolf seconded a motion to approve giving all full-time and part-time City employees a Christmas bonus of $125.00.

General Government: Event Request

Council discussed the annual Christmas party for City employees and officials.  Council member John Walz moved to approve the Christmas party for City employees, officials, and their spouse and/or guest at a cost not to exceed $500.00.  Motion carried unanimously.  City Clerk Amy Burton will coordinate arrangements in the City Clerk’s office.

General Government: Financial

City Clerk Amy Burton presented Council with a list of bad debts to be written off in the amount of $9,060.79, which represents less than 1% of the City’s 2013 receivables.  This is an annual accounting procedure and in no way affects the City’s ability to collect these debts.  All of the debts listed have already been submitted for collection.  Prior to the Council meeting Council member Jolene Niernberger reviewed the individual names of the accounts to be written off, per auditor recommendation.  Council member Jolene Niernberger moved and Council member John Leiker seconded a motion to approve the write off of the utility bad debts in the amount of $9,060.79.  Motion carried unanimously.

General Government: License/Permit

Council member John Walz moved and Council member Terry Redetzke seconded a motion to approve 2014 cereal malt beverage licenses for All in a Day’s Grind, Arthur’s Pizza & Mexican Foods, Casey’s General Stores, Love’s Travel Stops and Weber’s Service & Repair.  The motion carried unanimously.

General Government: Committee – Planning/Zoning

Mayor Johnston would like to appoint Vic Winter to fill the vacant position on the Planning Commission/Board of Zoning Appeals with a term expiring 2016.  Council member John Walz moved and Council member Jeff Wolf seconded a motion to approve the appointment of Vic Winter to the Planning Commission/Board of Zoning Appeals.  Motion carried 6-0.

Public Works

Personnel: Position Change

Public Works Director Alan Scheuerman asked for approval to move Danny Wickham into the recently created Crew Foreman position.  Council member John Walz moved to change the probationary time period to 90 days.  Motion failed due to lack of a second.  Council member Jolene Niernberger moved to hire Danny Wickham in the position of Crew Foreman at a probationary wage per policy of $14.44 effective December 7, 2013.  Council member John Walz seconded the motion.  Motion carried unanimously.

Public Works: Special Project

Public Works Director Alan Scheuerman is requesting the County’s assistance in excavating several large dead trees in the creek bed of Big Creek.  Council member John Walz moved and Council member Terry Redetzke seconded a motion to authorize Mayor Johnston to sign the letter to be sent to the County requesting equipment assistance with the cleanup of Big Creek.  Motion carried unanimously.

Public Works: Training

Mr. Scheuerman requested approval to attend the Kansas Organization of Recyclers Annual Meeting on December 11, 2013 in Salina, KS.  Council member John Walz moved and Council member Jolene Niernberger seconded a motion to allow Public Works Director to attend the KOR Annual Meeting on December 11, 2013 in Salina, KS.  Motion carried 6-0.

Sewer: Repair/Replacement

Director Scheuerman discussed with Council the need to repair or replace one of the sewer pumps in the treatment facility.  This is the only pump with a grinder on it, therefore, it is imperative that it be fixed or replaced soon.  Mr. Scheuerman is still waiting to receive bids for the pump, but with a lead time of 3-4 weeks, he doesn’t feel the repair or replacement can wait until the next Council meeting for consideration.  Due to the timeliness of the needed repair, Council member John Walz moved to approve the purchase of a sewer pump with grinder at a cost not to exceed $10,000.00, and to proceed with the repair of the broken pump.  Funds for the purchase of the sewer pump to come from the Sewer Depreciation Reserve Fund.  Council member Jolene Niernberger seconded the motion.  Motion carried unanimously.

Water

Mr. Scheuerman continued by recommending that in future expansion of the City, the water lines be placed in the front of the houses rather than the back alley.  The utility lines are difficult to backhoe around and it is time consuming to hand dig around the other lines and cables.  Mr. Scheuerman also noted that Midwest Energy will be in town Tuesday to help with the Christmas lights.

Police Chief Taft Yates presented the December officer calendar noting that Officer Smull is no longer on the calendar.  The field of candidates to replace Officer Smull has been narrowed down to four, and those interviews will take place on December 7, 2013.  Of the four candidates, two are already certified officers.  The Crown Victoria will be up for auction on Tuesday on the Purple Wave website.  Chief Yates also reported that he has spoken to Josh Dreher, Love’s manager, and the parking lot to the east of the store has been cleaned up and graveled.

City Clerk

City Clerk Amy Burton presented the October Financial Statements consisting of the Statement of Accounts, Treasurer’s Report, and Security Deposit worksheet.  Ms. Burton also noted that she has received notification from Lamar Signs that the trees around the City’s billboard at mile marker 211 have been trimmed.

MAYOR/COUNCIL

Council member Jolene Niernberger would like for Council to consider asking entities that receive appropriations from the City to reduce their 2015 request by a certain percentage.  She would also like to inform the entities that they should only make one request of the City, at budget time, rather than off and on throughout the year.  The City must budget for an entire year; therefore it can be difficult to be able to help other entities outside of their annual budget request.  Ms. Niernberger also noted that she will be attending the LKM Mini Governing Body Institute this Saturday in Great Bend.

EXECUTIVE SESSIONS

City Attorney Olavee Raub requested an executive session under attorney-client privilege.  A 10-minute executive session was proposed starting at 9:16 p.m.  Mayor Johnston asked for a motion to recess.  Council member John Walz moved to recess to executive session under attorney-client privilege with Council present.  Council member Jeff Wolf seconded the motion.  Motion carried 6-0.  The meeting recessed at 9:16 p.m.  The Council returned to open session at 9:26 p.m.   No action was taken in executive session.

ADJOURNMENT

Council member Terry Redetzke moved and Council member Jeff Wolf seconded a motion to adjourn the meeting.  The motion carried unanimously.  The meeting adjourned at 9:28 p.m.

 

 

Careless smoking blamed for deadly blaze

fire(AP) — Wichita fire officials say careless smoking caused a blaze that killed four people last week.

Capt. Stuart Bevis said Wednesday that the Nov. 26 fire started in an upholstered chair in the living room of a double-wide mobile home. Several adults had smoked in that area beforehand. Bevis says a combination of wood paneling and combustible ceiling tiles contributed to the blaze spreading rapidly.

The fire killed 21-year-old Amanda Nichols; her 1-year-old son, Isaaca; 27-year-old Camaron McGowan, and his 2-year-old son, K’dyn McGowan.

The home’s smoke alarms apparently weren’t working. And Bevis said it was fortunate that three other people in the mobile home managed to escape with their lives. Those three, a firefighter and a neighbor who helped sustained minor injuries
