Commissioners Delay Resolution Decision

Ellis County courthouse

The Ellis County Commissioners on Monday decided to spend more time researching and gain some clarity before adopting an Insurance Proceeds resolution.

The resolution would put the County in a position to receive 15% of the earnings off any insurance payout when 75% or more of a structure is destroyed by a fire, explosion or windstorm.

If the County adopts the resolution the insurance company would send 15% of the insurance proceeds to the County, with the rest going to the property owner.

Once the County is satisfied with the cleanup job they would pay the property owner the remaining funds. The resolution would apply only to unincorporated portions of Ellis County.

County Administrator Greg Sund said that this is a way to ensure that property owners clean up demolished buildings and, “If we don’t have something like this, the chances of cleaning up are zero.”

Commissioners Dean Haselhorst and Swede Holmgren (Commissioner Barbara Wasinger was absent) both expressed concern with the resolution.

Commissioner Holmgren said he is looking at it from both sides, “from a County Commissioner’s perspective. This might have some merit in the event we have a disaster. As a personal property owner, I’m saying wait a minute. I need to read the fine print.”

Sund said that it is built into state insurance law, if the resolution is passed. There would also be a separate fund created for each individual situation and the money would have to be used for clean up of the property.

The Commissioners ask Administrator Sund to do more research before they take up the resolution again.

Sund also said they have had two of the type situations in the past few months.

The commission also approved the updated Emergency Operations Plan. It is required that the county update the plan every five years. Bill Ring, the County’s Emergency Management Coordinator said he has been working on updating the plan for about eight or nine months.

Kansas man sentenced for child porn

Prison Wire Fence

A Salina man has been sentenced to 180 months in federal prison for receiving and distributing child pornography, U.S. Attorney Barry Grissom said today.

Justin S. Tatum, 32, Salina, Kan., was sentenced Monday in U.S. District Court in Wichita. He pleaded guilty to three counts of distributing child pornography, related to two different investigations. In his plea, Tatum admitted sending images of child pornography to Jeffrey Wiederholt in exchange for child pornography that Wiederholt produced. Tatum sent a video of an adult male pulling a diaper off a girl no more than three years of age to expose her genitals to the camera. He also sent a video of an adult male sexually abusing a girl no more than five years old. The investigation began in 2011 when Immigration and Customs Enforcement agents acted on a lead related to Wiederholt, uncovering emails between Tatum and Wiederholt.

Wiederholt was charged and convicted in U.S. District Court in the Western District of Missouri. He was sentenced to 70 years.

Tatum also admitted to using an encrypted peer-to-peer program to trade child pornography with individuals he met on the Internet. An investigation into these activities began in July 2011 when a detective with the Sheriff’s Department in Martin County, Florida, downloaded images of child pornography from Tatum on July 15 and 18, 2011. On Aug. 10, 2011, officers of the Salina Police Department executed a search warrant at Tatum’s home in Salina.

Grissom commended Immigration and Customs Enforcement, the Martin County, Fla., Sheriff’s Department, the Salina Police Department and Assistant U.S. Attorney Jason Hart for their work on the case.

Moran on on Anniversary of Alan Gross’ Unjust Detainment in Cuba

Moran 1U. S. Senator Jerry Moran (R-Kan.), author of the unanimously-passed Senate resolution (S. Res. 609) which called on Cuba to immediately and unconditionally release American citizen Alan Gross, released the following statement today on the 4th Anniversary of Mr. Gross’ arrest in Havana, Cuba:

“Today marks the fourth anniversary of Alan Gross’s arrest in Cuba. For four years, Alan has been unjustly detained and punished for seeking to help a small, peaceful, non-dissident Jewish community access the Internet.

“I have not yet had the privilege to meet Alan, but I know his wife Judy, and my heart is filled with a great sadness knowing the pain Judy, Alan and their family have endured these past four years. As fellow Americans and human beings, we all share in their sadness and determination to bring Alan home.

“While their suffering continues, they are not alone in their fight for family and for justice. The United States Senate has made clear its wish that Alan be immediately released and allowed to return home to the United States. This is the sense of both the body and the citizens it represents – the wish of the American people.

“Today I reiterate this call to President Obama, asking him to do everything he can to deliver Alan from his state of detention in Cuba. This is about freedom, and family, and an American son. It’s well past time for Alan to return to the United States. I look forward with great anticipation to meeting Alan and welcoming him home. Let us not tire in our efforts until that day when Alan is free and his family is reunited.”

Alan Gross was arrested on December 3, 2009, and after a two-day trial, was given a 15-year prison sentence by Cuban authorities for facilitating communications between Cuba’s Jewish community and the rest of the world. Mr. Gross was in Cuba working as a sub-contractor for the United States Agency for International Development, helping a small, peaceful, non-dissident community. He was doing the type of work he had done his whole career in international development – helping others in need.

A 64-year-old husband and father, Mr. Gross has lost more than 100 pounds since his arrest and suffers from severe degenerative arthritis that affects his mobility, as well as other health problems. Members of his family have also faced serious illnesses during this time.

Police: Kansas Shooting probe leads to 3 bodies UPDATE

police-lights.jpg

Tuesday 10 a.m. (AP) — Authorities have identified a third deceased victim found at a Topeka home but have yet to identify a suspect or motive.

A fourth person remains hospitalized.

Topeka police identified the victim as 34-year-oled Tamesha Lee of Topeka. Her body and those of two men were found Sunday in a home not far from Washburn University.

Authorities have released few details and haven’t said how the three people were killed.

The investigation began with the shooting of 45-year-old Carla Jean Avery, who was found behind a Topeka restaurant with gunshot wound. Police say Tuesday that she remained in critical condition.

Police traced Avery’s movements back to the home where the three bodies were found. The other victims were Avery’s brother and her ex-husband.

(AP) — Police say an investigation into a shooting that left a woman wounded in Topeka has led to the discovery of three bodies at another location.

Lt. Scott Gilchrist said in a news release late Sunday night that the victims were three adults. Their names were not immediately released and police didn’t say how they are believed to have died.

Gilchrist said the woman whose gunshot injury initiated the investigation was found Sunday afternoon behind a restaurant. He said she had sustained a life-threatening gunshot wound and was taken to a hospital.

It’s not clear whether police have a suspect. No other details were included in the news release and Gilchrist did not immediately return a phone message to The Associated Press for comment.
