Kans. Inmate released after 4 years waiting for a trial

jail  prisonWICHITA, Kan. (AP) — A Wichita man has been released from the Sedgwick County Jail after spending 4½ years waiting for a trial in a sexual predator case.

Forty-five-year-old Todd Ellison was supposed to go to trial next week to determine whether he should be held for life as a sexual predator.

Instead, District Judge Ben Burgess released Ellison Friday, saying his right to a speedy trial had been violated.

The Wichita Eagle reports Ellison completed a sentence for sexual crimes involving children from cases in 1996 and 1997. When he was about to be released in 2009, prosecutors filed a petition to argue that he might be determined to be a sexually violent predator.

Ellison fought the allegation since then, although he says the state also delayed hearings in the case.

 

Survey says don’t move date of Kan. State Fair

Kansas State Fair 002HUTCHINSON, Kan. (AP) — A proposal to start the Kansas State Fair on Labor Day weekend wasn’t popular with people who responded to a survey.

Nearly 75 percent of 2,500 people responding to a survey conducted by University of Kansas Jayhawk Consulting either disagreed or strongly disagreed with Gov. Sam Brownback’s proposal to move the fair’s starting date. Only 11 percent agreed with the idea, with the rest neither agreed nor disagreed.

The Hutchinson News reports  more than half of the respondents said they probably would not attend the 10-day fair if the dates changed.

Brownback had suggested that moving the date would increase attendance at the fair.

However, some fair officials said many Kansans go to state parks and other events on Labor Day, rather than to the state fair.

Measure aims to cut Kansas out of health overhaul

TOPEKA, Kan. (AP) — A proposal designed to allow Kansas to opt out of the federal health care overhaul is being reviewed by a state House committee.

The Federal and State Affairs Committee’s hearing Tuesday was on a bill that brings Kansas into a compact among states to take control of health care policy within their borders.

Most Republican lawmakers and GOP Gov. Sam Brownback have been highly critical of the federal health law championed by Democratic President Barack Obama.

The compact is the project of Competitive Governance Action. The conservative Texas-based group says on its website that it favors the devolution of government power.

Congress would have to approve the compact and cede power to the states on health care. Compact supporters think that’s a possibility if Republicans control both chambers.

 

Kan. governor raising wildfire danger awareness

FIRE 2TOPEKA, Kan. (AP) — Kansas residents are being urged to act cautiously with outdoor burning as the state marks a week of awareness of the dangers of wildfires.

Gov. Sam Brownback has signed a proclamation declaring this Wildfire Awareness Week.

The state fire marshal’s office said in a news release Monday that Kansas had more than 3,200 vegetation fires last year, resulting in more than $4 million in property damage and losses and six injuries.

The fire marshal also says those fires burned more than 125,000 acres of land.

Brownback’s proclamation says preventing wildfires is a public safety issue affecting all of Kansas, not just rural areas. Residents are urged to follow posted guidelines for outdoor burning and avoid dangerous use of fireworks.

NICODEMUS– On Saturday, February 22, Nicodemus National Historic Site will hold their third program for Black History Month, from 10:00 am to 12:00 pm in the Township Hall/visitor center. It will be a come and go conversation with Robert Brogden, Jr.

Brogden is a successful entrepreneur who is a descendant from Nicodemus. and owns an auto dealership in Olathe.   Brogden will talk about life  growing up in Nicodemus, striking out on his own, going to work, and starting his own business.

Kan. Senate leader appoints pensions committee

TOPEKA, Kan. (AP) — Kansas Senate President Susan Wagle has created a special committee to review issues surrounding the state Public Employees Retirement System.

Wagle named nine senators to the panel Monday. Its chairman is Independence Republican and Senate Vice President Jeff King, and its vice chairman is Emporia Republican Jeff Longbine.

The Senate doesn’t have a standing committee on pensions, as the House does. The House committee is reviewing multiple pension issues, including a proposal to start a 401(k)-style plan for new public employees.

The other Republicans on the Senate panel are Elaine Bowers of Concordia, Jim Denning of Overland Park, Mitch Holmes of St. John, Forrest Knox of Altoona and Ty Masterson of Andover.

Senate Minority Leader Anthony Hensley and Laura Kelly are the committee’s Democratic members. Both are from Topeka.

 

TMP boys win; girls lose

Girls:  Ellinwood 58, TMP 43
The TMP Lady Monarchs dropped their second game of the season to Ellinwood on Monday night, 58-43.  Ellinwood used a 14 to four run to end the first half up 32-22.  They led by as many as 15 points in the third quarter before TMP caught fire.  The Lady Monarchs went on a 16-4 tear to end the quarter and scored the first two points of the fourth quarter to pull within one at 43-42.

The last run of the night belonged to Ellinwood.  The Lady Eagles finished the game on a 15 to one run to dash TMP’s hopes of upsetting the number four ranked team in 2A.  Melissa Pfeifer and Samantha Younie scored nine points apiece to lead TMP.  The Lady Monarchs dropped to five and 10 overall and will play Hoisington Tuesday night at Hays Middle School.

A slow start turned into a big finish for the TMP Monarchs in their 63-41 win on Monday night in Ellinwood.  The Monarchs jumped out of the gates slow, using Max Megaffin three pointers at the end of the first quarter and then again at the end of the first half to take a 29-18 lead at the break.  Ellinwood would cut the lead to as little as seven points in the third quarter but that would be as close as they would get.

Megaffin led Joe Hertel’s Monarchs with 20 points on the night.  Ryan Mayorga chipped in 12 for the eight and seven Monarchs who will  host Hoisington, a team they beat 49-31 on January 30th, Tuesday night at Hays Middle School.

Earlier this month a man claiming to be connected to Jason Aldean scammed the non-profit and a Louisville club out of more than $9,000, money meant to benefit two year-old Addilyn Roberts’ fight against Leukemia. “It says a lot about who Gary is as a person and an artist to take the time to do a show like this,” says WQNU OM Shane Collins. “I’m happy we can be there,” Allan says. “I feel for the Roberts family. It’s clear they were lied to. It is a real shame anyone would take advantage of a family in a situation like that. We plan to have a good time and hopefully raise some money to help them.” Only 250 tickets will be sold for the March 25 show, with sales starting Monday (2/17). VIP and meet-and-greet ticket packages will also be available. All proceeds will be donated to Addie’s Army. More here.

KU Hospital receives gifts for expansion

KANSAS CITY, Kan. (AP) — The University of Kansas Hospital has received $3.5 million in private donations toward construction of a new facility.

The Lawrence Journal-World reported the donations were announced Monday at a news conference at the hospital’s campus in Kansas City, Kan.

The hospital bought 14 acres of land near the campus in 2005 with the expectation of needing to accommodate more patients and surgery space. There’s no timetable yet for construction of what’s planned as a 92-bed facility.

Hospital spokesman Dennis McCulloch says the donations announced Monday are the first funds raised so far for the $250 million project. McCulloch says officials hope to raise $100 million in gifts.
