Kansas man re-sentenced for child abuse

HUTCHINSON, Kan. (AP) — A Hutchinson man convicted of sodomizing a 4-month-old child has been resentenced to about 14 years in prison.

Michael Sherman pleaded guilty in 2012 to abusing the infant and was sentenced to life without parole for 25 years.

The Hutchinson News reports the Kansas Court of Appeals ordered a resentencing because Reno County Senior District Judge William Lyle did not fully address his reasons for not granting Sherman a departure from the full sentence.

Sherman was resentenced Thursday by Judge Trish Rose, who cited Sherman’s lack of criminal history and the fact that Sherman turned himself into police after the abuse. Rose ordered Sherman to serve nearly 14 years, plus lifetime post-release supervision.

City of Hays: Several seal coat projects will begin Monday

Beginning Monday, the city of Hays will begin a series of seal coat projects on city streets.

Affected streets will be restricted to the traveling public for approximately one month for repairs. They include Newton Circle, 45th Street, Larned Circle, Jefferson, Augusta (south of 27th), Indian Trail (27th to 33rd), Trinity Drive, Sternberg Drive, 29th Street, Copper Creek, East 14th (along Tallgrass) and Tallgrass Drive.

Signs will be in place to direct the traveling public. Motorists are advised to use caution and, if at all possible, avoid these areas.

Monthlong curb and brick repair project will restrict traffic

Beginning Monday, the 2014 curb and brick repair project will begin, the city of Hays announced Friday. Various areas from West Fifth to Ninth streets between Walnut and Main will be restricted for approximately one month for repairs.

Signs will be in place to direct the traveling public, and motorists are advised to use caution and, if at all possible, avoid these areas.

Congress votes to stop prosecuting medical marijuana users

WASHINGTON (AP) — The GOP-controlled House has come out in favor of blocking the federal government from interfering with states that permit the use of medical marijuana.

The somewhat surprising 219-189 vote early Friday came as the House debated a bill funding the Justice Department’s budget.

The amendment by conservative GOP Rep. Dana Rohrabacher of California — the first state to legalize medical marijuana — came as almost half the states have legalized marijuana for medical uses such as improving the appetites of cancer patients undergoing chemotherapy.

Oregon Democrat Earl Blumenauer told opponents that “this train has already left the station.”

Opponents said that marijuana is regulated too loosely by the states and has negative effects on the brain.

Hays Dog Park improvements continue

The Hays Dog Park continues to add improvements as donations are made to the third and final fundraising phase.

Four new benches, for humans, adorned with plaques honoring the donors, were installed Thursday.

dog park kiosk removedCity crews also removed the rules sign and kiosk outside of the park fence. Friends of the Hays Dog Park President Kim Perez said work will begin soon on installation of a sidewalk which will be paved with bricks purchased by donors.

“Hays Dog Park” has also been added to the “Maintenance” locator sign in the Bickle Schmidt Sports Complex, making it easier for patrons to find the dog park.

Sunflower Foundation announces four new trustees

Kansas Attorney General Derek Schmidt appointed Krista Postai of Pittsburg; Martie Ross of Kansas City; and Don Sherman of Wichita. The fourth trustee, Beryl Lowery-Born of Topeka, was appointed by Blue Cross Blue Shield of Kansas.

All four trustees were appointed to first three-year terms that start in June.

Two members of the Sunflower Foundation’s Community Advisory Committee also were re-appointed by Schmidt. Dr. Kent Bradley of Valley Center and Francie Currie of Neodesha will start their second three-year terms in June.

Postai is chief executive of the Community Health Center of Southeast Kansas, the only federally qualified health center serving Southeast Kansas, thestate’s poorest region. She worked previously as a vice president at Mt. Carmel Regional Medical Center in Pittsburg, where she was employed 23 years.

Postai graduated from the University of Kansas with a bachelor of science in journalism. She is a board member of the Kansas Health Information Network and is the immediate past president of the Kansas Association for the Medically Underserved.

Martie Ross works at Pershing Yoakley & Associates healthcare consultants advising doctors and hospitals nationwide on navigating healthcare regulations. She is an expert in new payment and delivery systems and public payer initiatives, and advises clients on health information technology, health reform, patient privacy and security, and rural health strategies. Previously Ross was partner at several Kansas-based law firms: Spencer Fane Britt & Browne; Lathrop & Gage; and Foulston Siefkin.

Ross graduated from KU of the University of Kansas with degrees in law, sociology and philosophy.

Don Sherman is vice president of community relations and strategic partnerships at Westar Energy, Kansas’ largest electric utility. Prior to joining Westar in 2007, Sherman was for two decades a successful entrepreneur, founding the first and only African-American-owned radio station group in Kansas, as well as building Wichita’s largest private security and investigation firm.

Sherman graduated from Baker University in Baldwin City with a degree in business administration. He has an associates degree in administration of justice from Butler Community College in El Dorado.

Beryl “Bebo” Lowery-Born retired from Blue Cross Blue Shield of Kansas as the company’s chief financial officer in 2013. Previously, she was the company’s vice president of finance. Lowery-Born oversaw the Blue Cross operating division, which included actuarial research, accounting, underwriting and management engineering departments.

She graduated from Washburn University with a master’s in business administration and a bachelor’s in accounting. She also has a degree in biological science from Kansas State University.

Dr. Kent Bradley is a Valley Center physician in obstetrics and gynecology..

Francie Currie is an office manager for a family practice clinic in Neodesha.

The new trustees will replace Marty Beezley, Chris Ruder, Howard Shuler and Caroline Williams.

The Sunflower Foundation is governed by a nine-member board. Eight trustees are appointed through a process overseen by the Kansas Attorney General and the ninth member is appointed by Blue Cross Blue Shield of Kansas. Trustees are limited to serving three, three-year terms. The nine-member Community Advisory Committee nominates candidates for the foundation’s board. The committee also advises the foundation.

The foundation was established in 2000. Its mission is improving the health of Kansans, which it supports through a program of grants, special initiatives and related activities. More information about the foundation’s programs and grants is available atSunflowerFoundation.org.

HPD will conduct sobriety checkpoint (CORRECTED)

Officers from the Hays Police Department will conduct a sobriety checkpoint from 12:30 to 2:30 a.m. Saturday, June 7, in the 1000 block of Vine.

The purpose of the lane is to improve the safety of the community by identifying impaired drivers and removing them from the roadway. Motorists suspected of driving under the influence will be given on-site sobriety tests.

Efforts will be made to minimize the interruption of traffic flow, but many drivers will be stopped as part of this program.

The event is being conducted in accordance with the Kansas Department of Transportation’s Impaired Driving Deterrence Program.

Delbert Lee Cochran

Delbert Lee Cochran, 92 of Waldo, Kansas died Monday, May 26, 2014 at the Hays Medical Center in Hays, Kansas.

Delbert was born April 9, 1922 in Waldo, the son of Commodore Perry and Bertha Alice (Crawford) Cochrun.

Delbert served his country in the U.S. Army during WWII.  He was a light Machine Gunner. He received the Purple Heart with Oak Leaf Clusters from injuries received in Italy. He also received the good Conduct Medal and European African Middle Eastern Service Medal. After coming home from the war, he resumed his occupation of farming and dairy. He measured all the production farmland that was effected by Lake Wilson.

Delbert was united in marriage to Barbara Lee Mansfield on December 3, 1943. This union was blessed with four children; James, Virginia, Jack and Diane.

Delbert was a member of the Otterbein United Methodist Church. He was a life member of the Russell V.F.W. Post #6240, a member of the Disabled American Veteran and served on the Waldo School Board. He enjoyed the outdoors, square dancing with Barbara, watching westerns and K.C. Chiefs and collecting flashlights.

Surviving family include two sons, James Lee Cochran (Sharon) of Russell, Kansas and Jack Leon Cochran (Jody) of Luray, Kansas; two daughters, Virginia Ann “Ginger” Langdon (Craig) of Lucas, Kansas and Diane Lee Mai (Randy) of Webb City, Missouri; grandchildren, Peter Cochran, Danny Cochran, Amy Kvasnicka, Jeremy Kvasnicka, Emily Bretz, Lori Versluys, Charity Schmidt, Candy Chadwick, Jed Cochran, Shane Mai, Pamela Carley, Scott Mai and Troy Mai; and 18 great grandchildren.

Delbert was preceded in death by his parents, beloved wife Barbara, sisters Virginia Thomas and Doris Trapp.

Celebration of Delbert’s Life will be held at 10:30 A.M. Saturday, May 31, 2014 at Pohlman-Varner-Peeler Mortuary of Russell.  Burial will follow at the Luray City Cemetery where Russell V.F.W. Honor Guard will conduct Military Rites.  Visitation will be from 9 AM to 8 PM Friday, May, 30, 2014 at the mortuary.  A Memorial has been established to the First Responders of Waldo and Paradise.

Vernon Edward Morgenstern

Vernon Edward Morgenstern, 89, of Russell died Saturday morning, May 24, 2014, at Deseret Heath Care in Kensington, Kansas.

Vernon was born June 12, 1924, in Barton County, Kansas, the son of Edward and Minnie (Boxberger) Morgenstern. He grew up in the Galatia area and graduated from Russell High School in 1942.

He was drafted into the Army Air Corp and was honorably discharged in 1946.
Vernon was united in marriage to Mary Lou Keener on July 17, 1948. This union was blessed with two sons, Michael and Todd. They made their home in Russell.

Vernon had a long career in aviation and was a contract Pipeline Pilot for 53 years and flew for numerous oil and gas pipeline companies including Kaw and Jayhawk Pipeline.  In 2011 he was awarded the Wright Brothers Master Pilot Award from the Federal Aviation Administration.
Vernon was a member of Aircraft Owners and Pilots Association, Russell Elks Club, St. John’s Lutheran Church, Masonic Lodge, Consistory and Shrine, and the University of Kansas Williams Fund.  He enjoyed hunting, gardening and golf in his spare time.

Surviving family include his wife of 65 years, Mary Lou of Russell; two sons, Michael (Susan) of Lone Tree, Colorado and Todd (Kim) of Ellinwood, Kansas, three grandchildren, Jill Morgenstern, Hannah Morgenstern and Katie Morgenstern.

Cremation has been selected by the family and a private memorial service for Vernon will take place at a later date.  The register book will be available from 9 A.M. to 5 P.M. on Friday, May 30, 2014, at the mortuary.  Memorials may be given to the Russell County EMS or the Russell City Fire Department in care of the mortuary.

David Martin Mai Jr.

David Martin Mai Jr., 84, of Russell, Kansas, died on Monday, May 19, 2014, at the Russell Regional Hospital.

David was born on March 20, 1930, in Hays, Kansas, the son of David Sr. and Christine (Kerbs) Mai. He grew up in Gorham, Kansas, and attended school at the Center School District #63.

He met, fell in love and was united in marriage to Emma Jean Gosser on August 08, 1949 in Hays, Kansas at the Trinity Lutheran Church.  From this union David and Jean were blessed with 4 children, 3 sons Michael, Randall and Mark and daughter Robin.

David worked as a heavy equipment operator for Bill Ingram and Red Rhyne for 10 years. In 1964, he started his own business and became owner and operator of Mai Excavating.  After a very successful career he retired in 1998.

He was a longtime member of St. John Lutheran Church in Russell.  When his children were young he was a Boy Scout master of Pack #134 and enjoyed taking the boys camping. He was also a member of the Russell Elks Club, Kansas State Square Dancing Board and Russell Square Dancing Club.  He enjoyed being a farmer and stockman, golfing, square dancing, computer games and his cats and birds.  Most of all he enjoyed spending time with his family, especially his many grandchildren, great grandchildren and great-great grandchildren.

David is survived by his wife Emma Jean Mai of the home; sons Michael David Mai and wife Diana Lynn (Milberger-Wells) Mai, Randall Ward Mai and wife Diane Lee Cochran of Webb City, Missouri and Mark William Mai and companion Annette Stierlen of Russell; daughter Robin Faye Mai Logsdon Leiker and husband Daniel of Russell; sisters Ella Marie Mai Westmoreland of Denver, Colorado and Irene Ruth Mai Harzman and husband Fredrick “Uncle Bud” of Kingfisher, Oklahoma; David’s 14 grandchildren, 21 great grandchildren and 4 great-great grandchildren; daughters Martine Chauveau and Mireille Roland both from France.

He was preceded in death by his parents, brothers Bill and Ray Mai; sisters Ophelia Griffey, Elma Christine Steinert and Edna Olinda Joyner and grandsons Rex Wells and Jeremy Logsdon.

A memorial service to celebrate David’s life will be held at 10:30 A.M. on Friday, May 30, 2014, at the St. John Lutheran Church in Russell with Pastor Roger Dennis officiating.  Visitation will be from 9 A.M. to 8 P.M. on Thursday, May 29, 2014, at the mortuary with the family present to greet guests from 6 P.M. to 7 P.M. Thursday evening. Memorials may be given to St. John Lutheran Church or Russell Regional Hospital Therapy Center and sent in care of the mortuary.
