Kansas man injured in highway construction zone accident

pedestrian-accident-genericOTTAWA—A man flagging traffic in a Kansas Construction Zone was injured in a Thursday accident in Franklin County.

The Kansas Highway Patrol reported a 1989 Chevy Pickup driven by William R. McNish, 73, Ottawa, was westbound on K-68 highway just east Ottawa entering a construction zone.

William R. VanDorn, 62, Overbrook, was in the lane of traffic flagging traffic for a separate non-injury accident involving a dump truck.

The driver of the pickup did not see VanDorn and struck him with the passenger-side front corner of the vehicle.

The KHP also reported McNish was not wearing a seat belt at the time of the accident.

Kansas man sentenced for killing ailing wife

jail  prisonLAWRENCE, Kan. (AP) — A 67-year-old Lawrence man who told investigators he killed his wife because of her many health problems has been sentenced to life in prison.

The Lawrence Journal-World reports that Larry Hopkins will be eligible for parole after 25 years under the sentence he received Thursday in Douglas County District Court.

Hopkins shot and killed 61-year-old Margaret Hopkins on Nov. 5, 2013, at their Lawrence home. He pleaded no contest earlier this year to first-degree murder, turning down a plea deal that included lesser offenses.

In court Thursday, Hopkins read a statement describing the many ailments suffered by his wife of 24 years, including diabetes, multiple strokes and knee replacement surgeries.

Larry Hopkins also had suffered a stroke and had heart problems as well.

Fatal crash leads to murder conviction

jail barsWICHITA, Kan. (AP) — A Sedgwick County jury has convicted a driver of first-degree murder for killing another motorist while fleeing from police in a stolen pickup truck.

The Wichita Eagle reports the jury took less than an hour Wednesday to find 35-year-old Keith Ritz guilty on seven charges, including murder and fleeing from police.

Prosecutors said Ritz was speeding through residential areas when he drove through a stop sign and struck a pickup driven by 38-year-old Venancio Perez. The crash occurred on March 5, 2013, after a chase that lasted about 90 seconds.

No sentencing date has been set.

The victim’s family has sued the city of Wichita for $3 million, claiming police carried out the chase without regard for public safety. The city’s legal department has declined to comment.

8-year-old hailed as a hero after mom loses conciousness at wheel

emergency lightsemergency lightsemergency lightsGALENA (AP) — An 8-year-old Kansas girl is being hailed for her quick thinking after she took control of the family’s SUV when her mom fell unconscious at the wheel during their highway ride to school.

Abby Porter and her mom, Shelly, were on Kanas 66 headed to school in Riverton early Wednesday when Shelly had a medical emergency and passed out.

Galena Police Officer Jimmy Hamilton noticed the SUV weaving along at about 20 mph and saw Abby at the wheel alongside her unconscious mom. Hamilton positioned his car in front of the SUV, and Abby steered into the patrol car until they both stopped.

The police department in Galena, about 150 miles south of Kansas City, is presenting Abby with a plaque for “outstanding bravery in a life-threatening situation.”

Caroline (Schaus) Schumm

Caroline (Schaus) Schumm of Ellis died at age 97, Wednesday, May 14, 2014 after spending her final Mother’s Day and week of life enjoying being pampered at Trego County-Lemke Memorial Hospital & Long-Term Care Center. Her birthplace was rural Ellis County on January 23, 1917, to John (Ast) and Wilhemina (Wentling) Schaus.

She is preceded in death by her parents and siblings Edgar, Edna Ptaschek, Frieda Bollig, Lena Bollig, William, Edith Hughes Malone and Raymond, as well as one grandson, Clay Kutina. Her survivors include husband, Martin, who she married February 4, 1938 in Tulsa, Oklahoma; one sister, Henriettta (Chris) Hansen of Clackamas, Oregon; and two daughters: Beverly McLaury of Ellis and Aleta (Lea) McCloud of Wichita, Kansas.

From those daughters, seven grandchildren survive–six in Kansas: Kirk Kutina, Topeka; Cindi Renyer, Valley Falls; Todd McLaury, Topeka; Monica Fisher, Overland Park; Darrin McCloud, Clearwater, and Andrea McCloud Johnson, Wichita. Her oldest granddaughter, Laurie Bishop, lives in Gordonville, Texas Of the 19 great grandchildren, 18 reside around Kansas and one is becoming a Marine in California. There are currently 12 great-great grandchildren.

With an 8th grade education, Caroline worked for more than 20 years in the Ellis Public School District’s School Lunch program progressing to the position of Manager; of her many accomplishments she was most proud to have helped design the kitchen for the current Ellis High School and planned many special banquets for FFA and proms. Many EHS graduates remember the hot lunches she and her team served with generous portions and smiles.

She and Martin have been members of Christ Lutheran Church since 1946. During her homemaking years she served in volunteer leadership at both school and church. In later years she spearheaded the “Sewing Ladies” who transformed old clothes and donated fabric into warm quilts that were sent to Lutheran World Missions and disasters.

Funeral services will be 10:30 AM Monday, May 19, 2014 at Christ Lutheran Church in Ellis.

Visitation will be Sunday 5 PM – 8 PM at Keithley Funeral Chapel 400 E. 17th Ellis, KS 67637.

Gifts in Caroline’s memory can be designated to Trego County Lemke Memorial Endowment Foundation of WaKeeney or Christ Lutheran Church in Ellis.

Voter citizenship lawsuit looms over 2014 election

Voter IDWICHITA, Kan. (AP) — The League of Women Voters has told a federal appeals court that it has mostly confined its voter registration drives in Kansas to naturalization ceremonies where people readily have the proof-of-citizenship documents required to vote in Kansas.

But the group told the 10th U.S. Circuit Court of Appeals in a filing Thursday that immigration officials have now prohibited it from copying or photographing naturalization certificates. The League argues that means new citizens face discrimination and significant roadblocks in registering to vote.

The latest court filing by the voting rights groups portrays just a sample of the impact of the litigation.

Kansas and Arizona are seeking to force the U.S. Election Assistance Commission to change its federal voter registration form instructions to require citizenship proof from residents of the two states.

Dole criticizes federal action on prairie chickens

TOPEKA, Kan. (AP) — Kansas political icon Bob Dole says the federal government should not have listed the lesser prairie chicken as threatened.

Dole said Thursday that the listing announced in March is an example of a growing federal government that’s inserting itself into issues that should be left to states.

The 90-year-old Dole is a former U.S. Senate majority leader and the 1996 Republican presidential nominee. He came Thursday to the Statehouse for the kickoff of GOP Gov. Sam Brownback’s re-election campaign.

Brownback and other state officials argue that the listing for the lesser prairie chicken could lead to restrictions on farming, ranching an oil and natural gas production.

But federal officials say the designation is justified by a steep decline in the birds’ population.

TOPEKA, Kan. (AP) — A new Kansas law will change how property at cement manufacturing plants is valued for tax purposes and help settle a dispute involving an Overland Park company.

Officials at Ash Grove Cement estimated Thursday that the dispute could lower their property taxes in Neosho County in southeast Kansas by $4 million a year. The company has a plant in Chanute with about 140 employees.

The issue has been whether property at the plant falls under the state’s property tax exemption for business machinery and equipment. The company appealed to legislators, and they included a provision in a tax bill signed Wednesday by Gov. Sam Brownback.

The company says the change will protect jobs. Neosho County Appraiser David Thornton says it will shift the property tax burden to others.

Fort Hays State junior Cooper Langley was named to the Daktronics All-Central Region Team for the 2014 season, released on Thursday. Langley earned second team honors as a designated hitter.

Langley adds the honor to his All-MIAA Honorable Mention selection at designated hitter. It’s the second straight year the Tigers have had a designated hitter selected to the team after Horace Johnson earned first-team honors last year.

Langley started 44 games for the Tigers in 2014 with 75 percent of the starts coming at designated hitter, the rest at first base. He batted .335 and led the team in extra-base hits with 24, pounding out 19 doubles and five home runs.

Budget Host reopens after payment arrangement with state

THURSDAY UPDATE: Budget Host Villa Inn and Suites and the Kansas Department of Revenue have reach an agreement on a payment arrangement, the state announced Thursday afternoon. The business assets have been released, and the business, which was closed Monday, reopened.

TOPEKA – On Monday, Kansas Department of Revenue agents and Ellis County Sheriff’s officers seized the business assets of Vigneshvarai LLC, doing business as Budget Host Villa Inn and Suites, which owed $85,849.02 in state sales and transient taxes.

Officers seized all known bank accounts, on-site cash, business inventory and personal property assets belonging to owners Dimpal Patel and Vijay Patel. The hotel at 810 E. Eighth was sealed closed, and the assets will be sold at public auction to pay the taxes owed.

Warrant execution occurs when all other collection attempts, including multiple letters, telephone calls, letters of impending legal action, tax liens filed with the local District Court to secure the debt, previous bank levies and on-site till taps are executed to bring the taxpayer into compliance have been exhausted.

Only after several unsuccessful attempts does the department take the action of seizing assets, which in this instance resulted in the business being closed.

The Revenue Department’s standard practice is to continually encourage delinquent taxpayers, who are not lawfully filing or paying taxes — such as sales or withholding — to voluntarily enter into a repayment agreement.

According to Kansas Department of Agriculture inspection reports, Budget Host had 49 licensed rooms, but several had been shuttered.

According to an August inspection report, eight rooms were voluntarily taken out of circulation following an inspection.

Board of Regents elects western Kansan as vice-chairman

According to the Kansas Board of Regents official Twitter account, the board elected Regent Shane Bangerter of Dodge City as the vice-chairman for the board for the 2014-2015 school year. Kenny Wilk of Basehor was elected chairman of the board.

Bangerter was named to the board in 2013 by Gov. Sam Brownback. He grew up in Leoti working on a farm. After graduation, Bangerter earned a bachelor’s degree from Oral Roberts in 1987 and earned his Juris Doctorate from the University of Kansas School of Law in 1990. He has also previously served as a member of the Board of Trustees at Dodge City Community College and on the Board of Governors for the KU School of Law. The American Trial Lawyers Association has honored Bangerter as a Top 100 Trial Lawyer and as the “Top Lawyer of the Year” in 2013.

Along with his duties as a regent, Bangerter works as one of the founding partners of Rebein Bangerter Rebein P.A., a legal practice that specializes in workers compensation claims in Dodge City and Tampa, Fla.
