Court documents detail fatal officer shooting

TOPEKA, Kan. (AP) — Court documents show a 30-year-old Kansas man accused of fatally shooting a Topeka police officer earlier this month told investigators he had used methamphetamine two hours before the incident.

Ross Preston Lane is charged with capital murder in the Sept. 7 shooting death of 40-year-old police Cpl. Jason Harwood during a routine traffic stop in Topeka.

According to affidavits filed Sept. 8 and obtained Friday through an open-records request, Lane told a passenger in the car that he didn’t want to go back to prison, before pulling a gun from between the front seats and shooting Harwood.

Lane was taken into custody several hours later after calling a Topeka television station and saying he wanted to give up. He is being held without bond.

Third set comeback propels FHSU volleyball win over Missouri Southern

Fort Hays State moved to 6-4 overall and 1-1 in the MIAA with a 3-1 win over Missouri Southern in conference play on Friday night (Sept. 19) in Hays. Tied 1-1 in the match, FHSU reeled off four straight points to win the third set by two, then went on to hold off the Lions in the fourth.

FHSU took control early, holding a four-point lead in the first set eight times before taking their biggest lead at 24-19. FHSU closed out the set by five with a 25-20 win. Rebekah Spainhour, Mallory Flagor and Taylor Mares all had four kills in the opening set, while Keanu Bradley posted 11 digs.

A rash of inconsistency plagued the Tigers in the second set, committing 10 attacking errors even though they recorded 19 kills in the set. It was not enough to counteract a .270 hitting percentage from the Lions in the second. MSSU led by four at 20-16, but FHSU rallied to tie the set at 23-23. The Lions had two set points before pulling out a 26-24 win to even the match. Spainhour added five kills in the set, while Mares added four.

The third set was a rollercoaster with the Tigers moving out to a 13-10 lead midway through the set. Missouri Southern stormed back with an 8-1 run to take an 18-14 advantage and kept the Tigers at arm’s length, maintaining the lead at 21-17. The Tigers started to chip away, going on a three-point run to get within one. With the Lions leading 23-21, the Tigers rallied for four straight points to grab the pivotal third set 25-23. The Lions committed three straight hitting errors to close the set, including an assisted block by Spainhour and Mares to win the set. Teresa Wade had the hot hand in the set with five kills, helping the Tigers to a .433 hitting percentage in the set (16 kills, 3 errors, 30 attempts).

Wade continued that hot play in the fourth, putting down six more kills to finish with a team-high 15 for the night. Her service ace made it 18-14 in favor of the Tigers, their biggest lead of the fourth before the final point made it 25-20. Wade finished the night with a great stat line, 15 kills and 0 errors on 29 attempts, hitting .517 for the match, while adding 16 digs for a double-double and two service aces.

Flagor added 14 kills, hitting .312, Spainhour had 11 and hit .200, and Sara Hewson had 10 and hit .318. Kristin Conor led FHSU in assists with 29, while Libby Ary added 22. Reagan Vanderplas saw action over the final two sets to add 11 assists. From the libero position, Kanu Bradley led FHSU in digs with 26.

Fort Hays State finished the night hitting .271 as a team with 69 kills overall. Missouri Southern hit .201 as a team, but the Tigers held them under the .200 mark in both the first and fourth sets.

Katie Politte led MSSU in kills with 21, while Callie Whetstone and Krishna Merriman each added 11. Abby Finder had 42 assists and posted a double-double adding 15 digs. Katie Wiele led MSSU in digs with 16.

The Tigers look to move about .500 in conference play on Saturday when they host Central Oklahoma at 3 pm.

Firefighters will train this weekend at NCK Tech Big Creek campus

Firefighters from the Ellis County Rural Fire Department and the cities of Ellis, Hays and Victoria will be participating in firefighter skills training from 8 a.m. to 5 p.m. Saturday and Sunday.

The training will be conducted at the NCK Tech Big Creek campus at 101 Main in Hays.

Presented by the University of Kansas Fire and Rescue Training Institute, the training covers the skills needed by firefighters to force entry into locked buildings, open up walls, ceilings and roofs to find and extinguish hidden fires and to work with automatic fire sprinkler systems.

The training is provided using a 50-foot-long trailer specially equipped with an array of training devices and props. This is part of the University of Kansas’ fire academy on wheel program to bring fire training to firefighters throughout the state.

Kobach to add disclaimer to Kansas Senate ballots

Screen Shot 2014-09-19 at 4.30.35 PMTOPEKA, Kan. (AP) — Kansas Secretary of State Kris Kobach says about 500 voters living overseas will be told they may have to re-vote in the U.S. Senate race after ballots are mailed to them Saturday.

The Kansas election official on Friday directed counties to begin mailing overseas ballots under a federal deadline.

The ballots will have no Democratic candidate in the U.S. Senate race after the Kansas Supreme Court ordered Kobach to honor nominee Chad Taylor’s request to remove his name. Some Democrats pushed Taylor out to help independent candidate Greg Orman’s chances of defeating Republican Sen. Pat Roberts.

Kobach said Democrats are still obligated to pick a new nominee.

The ballots going out Saturday will come with a disclaimer saying a new ballot will come later if Democrats pick a new candidate.

Kansas City area medical team heading to Africa

Screen Shot 2014-09-19 at 4.10.34 PMOLATHE, Kan. (AP) — The Kansas City-area medical relief nonprofit Heart to Heart International is sending a team to West Africa to assess how its volunteers could help with the Ebola crisis.

The Kansas City Star reports  the four medical professionals plan to leave Sunday for a weeklong fact-finding trip in Liberia.

Heart to Heart, based in Olathe, provides medical assistance worldwide following earthquakes, hurricanes and other disasters. Operations director Dan Neal the West African mission is different because the Ebola epidemic is ongoing.

Once the assessment group returns, the plan is to send a series of medical teams over at least the next six months for two-week stints each. The teams would be comprised of about 10 people each.

Kansas schools panel delves into unspent cash

TOPEKA, Kan. (AP) — Statewide data presented to a Kansas commission studying school efficiency shows districts are hanging onto more cash.

Several members of the K-12 Student Performance and Efficiency Commission expressed concerns Friday about a $152 million increase in unspent balances from 2008 to 2014. But there weren’t enough votes to request a study of how money is carried over for use in future years.

Commission member Mike O’Neal noted that a 2011 state law was designed to make it easier to transfer unspent money into a fund where it can be spent on general expenses such as salaries. But data shows the size of those transfers dropped from $18.1 million in the 2011-12 school year to $6.3 million this year.

School officials say funding uncertainty is one reason for saving money.

 

County Attorney: Shooting death ruled justified

police shootingWINFIELD, Kan. (AP) — The Cowley County Attorney says the fatal shooting of an Arkansas City man by a sheriff’s deputy was justified.

Attorney Chris Smith said Friday that the deputy had reason to believe he was going to die if he did not shoot 22-year-old Tayler Rand Rock after a traffic stop in May. The deputy stopped Rock, of Arkansas City, on U.S. 166 near Dexter for a traffic violation.

Smith said Rock refused to get out of the car before grabbing the officer’s wrist and trying to drive away, dragging the deputy with the car. The deputy shot Rock several times.

Rock’s 9-month-old child was in the car but was not injured. The deputy continues to receive medical treatment for injuries to his left ankle, knee, foot, shoulder and hand.

alice raise mainJust in time for Halloween, Alice Cooper’s 2013 appearance at the the Wacken Open Air festival in Wacken, Germany, is ready to be unleashed.

Raise the Dead — Live from Wacken is set for an Oct. 21 release on CD and DVD by UDR-Home of Legends.

The full concert features 22 songs, including covers of “Break on Through” by The Doors, “My Generation” by The Who, and “Another Brick in the Wall” by Pink Floyd.

The CD/DVD also includes an interview with Cooper, who describes his show as being akin to a Broadway show divided into three acts: Alice Glam, Alice Dark, and Raise the Dead.

“If you are going to say ‘Welcome to My Nightmare,’ give them the nightmare,” he says to the camera. “Don’t just say it. Give it to them.”

A portion of the proceeds from sales of Raise the Dead — Live from Wacken will benefit the Wacken Foundation, which supports the growth of new rock and heavy metal bands.

The Wacken Foundation plans to release more performances from the festival.

WaKeeney gets serious about property nuisances

The problem has been discussed several times by the WaKeeney city council.

After considerable discussion once again during the Sept. 2 city council meeting, members voted to move forward with certified letter notices to several property owners within the city.

It was a close vote, three to two.

RECORD OF THE PROCEEDINGS OF THE GOVERNING BODY 2 SEPTEMBER 2014
The Governing Body of the City of WaKeeney, Kansas met in a regular session at City Hall 408 Russell Ave at 7:00 PM with the Mayor presiding and the following members present:
Mayor Kenneth Roy and Council Members Mary Jo Clevenger, Irene Dirks, Troy Leiker, Lynelle Shubert, and Allen Weigel
BEING ABSENT: None
The minutes of the previous meeting were approved as written, printed and distributed.
GUESTS: Shawnee Phillips, Mikalya Cody, Molly Moden, Isaiah Fabrizius, Abraham Pfannenstiel, John Kuhn, Cole Gillman-Goss, Tanner Townley, Ian Conness, Sean Conness, Alex Haxton, Caden Kemp, Alexis Haxton, Lance Brister, and Janelle Miller.
CITY ADMINISTRATOR: Hardy Howard presented two ordinances dealing with the Clark annexation. After a short discussion, Lynelle Shubert motioned to approve ordinance #1438 rescinding prior ordinance #1436. Allen Weigel seconded. Motion carried. Then Troy Leiker motioned to approve ordinance #1439 annexing a tract of the Clark property. Irene Dirks seconded. Motion carried.
A proposal for the inspection and washout of the city’s 75K gallon water tower from Utility Service Company was reviewed by the Governing Body. A motion was made by Mary Jo Clevenger and seconded by Irene Dirks to approve the quote in the amount of $1,295.00. Motion carried.
The City Administrator presented a quote for the 2014 audit from Mapes & Miller, CPA’s. The quote was tabled pending additional information.
A motion was made by Mary Jo Clevenger and seconded by Lynelle Shubert to replace the pool bathhouse parking lot with concrete for an approximate cost of $3,200.00 with the city providing the labor. Motion carried.
At this time an ordinance making appropriation for the payment of claims for the month of August 2014 was read, whereupon, Mary Jo Clevenger motioned to approve claims in the amount of $174,552.44 Troy Leiker seconded. Motion carried. Warrants #10248, 10252, 10258, 10259, 10265, 10279, 10286, 10287, 10290, and 10291 were reviewed prior to approval.
Property nuisance abatements were again discussed at length by the Governing Body. After a lengthy discussion, Lynelle Shubert motioned to move forward with certified letter notices to several property owners within the city. Irene Dirks seconded. Voting YES Clevenger, Dirks, Shubert. Voting NO Leiker and Weigel. Motion carried 3-2.

No further business appearing, the meeting was adjourned.

State commission orders shutdown of oil company

KCC logoWICHITA, Kan. (AP) — The Kansas Corporation Commission this week ordered its staff to shut down and seal an oil company’s wells, saying it reaped more than $1 million from illegal drilling operations.

The Wichita Eagle reports Viva International Inc. was also issued a $75,000 fine by the state commission on Thursday.

According to commission records, the company has been penalized for 87 different violations of state oil regulations and had its license suspended 11 times since June 2013.

Kansas law requires oil companies to acquire licenses and provide the commission with information on well locations and operations. The commission says the company has given incomplete and wrong records, ignored repeated requests for more information and continued to operate unlicensed wells.

A message left with the company wasn’t immediately returned Friday.

Semi crash ties up I-70 traffic

TOPEKA- A semi was involved in an accident Friday morning in Shawnee County.

The Kansas Department of transportation reported the southbound U.S. 75 to eastbound Interstate 70 ramp is closed to all traffic.

A semi hit the overhead sign truss, damaging it. The truck as well as and strewn cargo are blocking the roadway. Law enforcement and first responders are on scene. The road is expected to be closed until mid afternoon Friday. No injuries are reported.

 

Eastbound Interstate 70 mainline lanes are fully open to traffic, just the ramp is closed. Southbound U.S. 75 traffic is being detoured onto westbound Interstate70 to Fairlawn Road to turnaround back onto eastbound Interstate 70.
