Court orders new sentence for former KSU student in fatal crash

TOPEKA, Kan. (AP) — A Kansas appeals court says probation and house arrest was not enough of a sentence for a former Kansas State University student whose drunken driving crash claimed two lives.

The Kansas Court of Appeals on Friday ordered a lower court to resentence Miles Theurer. He was 23 on May 14, 2012, when he drove in the wrong lane through a construction zone along Kansas 18 while returning to Manhattan after a night of drinking at a Junction City strip club.

The Topeka Capital-Journal  reports the crash at 2:45 a.m. killed two occupants in the second car.

The three-member appeals panel said the judge erred in applying an incorrect legal standard in departing from the presumptive sentence of 41 months behind bars.

Long Beach State holds off Kansas State

LONG BEACH, Calif. (AP) – Branford Jones scored 14 points, Mike Caffey had 13 and Long Beach State beat Kansas State 69-60 on Friday night.

The 49ers (2-2) never trailed and held the Wildcats (2-1) to 33 percent shooting. David Samuels had 10 points and 10 rebounds and Eric McKnight had eight points.

Thomas Gipson led Kansas State with 13 points and Nino Williams had 12. The Wildcats shot 3-for-21 from 3-point range.

Gipson twice closed Kansas State’s deficit to four points in the final 1:09, including a basket inside with 48.5 seconds left. Jevon Thomas missed on a drive after Long Beach State missed a free throw and Kansas State was forced to foul.

Jones made four free throws in the final minute to seal the win for the 49ers in front of a packed home arena. Kansas State’s leading scorer, Marcus Foster, had five points on 1-for-13 shooting.

No. 23 FHSU men’s soccer advances to Elite Eight after shootout with Northeastern State

No. 23 Fort Hays State drew with No. 12 Northeastern State, 1-1, on Friday evening in the NCAA Championship, but advanced with a 3-2 penalty kick advantage in a shootout.

The Tigers (11-5-4) advance to the Elite Eight of the NCAA Championships on Sunday, Nov. 23, where they will face off with No. 5 Quincy at 2 p.m. from DeLoache Field.

Michael Cole got the scoring started for FHSU in the 50th minute, breaking away from the Northeastern State defense before rifling a shot from the upper left corner of the box.  Cole’s attempt cleared the keeper and found net, giving FHSU a 1-0 lead.

In the 63rd, however, NSU answered.  After a free kick was awarded the RiverHawks, a long cross into the box found Paul Samia, who fired at the net before his shot was deflected by FHSU goalkeeper Kent Freund. The deflection fell into the control of Crosby Lee, who finished on a rebound to the low post.

After 110 minutes of play left the game tied, the teams headed to a shootout where Anthony Hernandez, Maurizio Costa and Diego Cabral hit penalty kicks for the Tigers.

NSU’s first two attempts in the shootout went wide left, and though Tanner Brock’s first attempt was blocked by goalkeeper Jackson Biles, Hernandez’s attempt was good – giving FHSU a 1-0 advantage.  The RiverHawks tied the shootout in the next round, 1-1, after Jordan Schmoker hit on his attempt (and Biles again came up with a save on Mauricio Castorino’s turn) before grabbing a 2-1 advantage on Juan Peralta’s goal.

Costa answered Peralta with a make of his own, setting up the fifth round of PK’s, tied 2-2. Kent Freund made his mark in the shootout on Ricardo Palomino’s shot, diving to his left to stop Palomino’s shot and giving FHSU a chance to clinch – which Cabral did, putting it past the keeper for the 3-2 shootout victory.

Freund had four saves on the day, playing all 120 minutes while helping the Tigers advance to the Elite Eight for the first time in school history.

Cole and Castorino led the team with two shots for the day, as Cole had FHSU’s only shot on goal.

Fort Hays State and Northeastern State remained even in the series history, moving the overall record to 3-3-5 in 11 matches between the teams in the last four years.

Quincy reached the Elite Eight with a 3-0 victory over Saginaw Valley State in the first game of Friday’s action.

Luminaries turn out as Martin embraces duty as FHSU ‘lightkeeper’

After serving as president for the past five months, Dr. Mirta Martin was officially inaugurated as president on Friday morning. Attendees included Gov. Sam Brownback, Sen. Jerry Moran and Chancellor Bernadette Gray-Little from the University of Kansas, as well as other legislators and officials from around the state.

“You’ve got a great president coming into the university and you’ve got a great president leaving the university, and I don’t think there will be a beat missed in the process,” Brownback said. “Fort Hays State will continue to prosper and grow and be a fabulous institution for the state of Kansas.”

Fred Logan, chairman of the Board of Regents when Martin was named president, talked about Martin’s journey to the United States. After fleeing from the communist regime in Cuba, Martin and her grandmother lived in a covenant in Cuba for seven years before the opportunity arose to come to the United States. Logan said Martin was terrified due to the fact that she did not speak English and because of the change of scenery.

“When we talked to her about it, you could almost feel a sense of despair,” Logan said.

Martin then went to work at Miami gift shop to “help put food on the table” and went to school where she realized the plethora of opportunities available. According to Logan, once her other family members made their way to the United States, Martin found the power in education due to both her own and her families successes.

“As she puts it, through education we can achieve anything,” Logan said. “From there, we know the rest of the story — a successful student, banker, and a successful career in higher education.”

Brownback“Mirta Martin followed her own Smoky Hill Trail and it brought her to Fort Hays State University,” he added. “Mirta Martin — an educator, dreamer, and now the ninth president of Fort Hays State University.”

Before Martin gave her inaugural address, Kenny Wilk, current Regents chairman, spoke of the unique goals each president has brought to Fort Hays State, but noted each has had one main goal in mind throughout their tenure.

“To make this institution a beacon for education on the plains of western Kansas,” Wilk said. “My colleagues at the Kansas Board of Regents have no doubt that Dr. Martin will do great things during her time as president earning her historic place on this inspirational list as FHSU’s first female and hispanic president.”

After former President Edward Hammond officially passed the presidential medallion and mace, Martin offered her official inaugural address.

“I am honored today to wear, for the first time, our new Fort Hays State University regalia, which proudly reflects our colors and proudly displays our seal,” Martin said. “In a ceremony of renewal, together, today is an opportunity for us to share our common bonds and affirm our faith in a brilliant future.”

Martin noted FHSU is a beacon of education on the western plains of Kansas and and said it was her duty to ensure the success of the university.

“Every lighthouse has a keeper,” she told the crowd of thousands. “And it is the keeper’s duty to make sure that the light always shines brightly, illuminating the path ahead. … I am humbled and honored to be the ninth keeper of the light at Fort Hays State University.”Martin

She also laid out a set of goals for the university during her tenure, including having alumni offer paid internships to students, producing a Rhodes Scholar, and diversifying and increasing the student and staff population at the university.

Martin was unanimously voted in as Hammond’s successor in May. She previously served as dean of the Reginald F. Lewis College of Business at Virginia State University.

Unemployment in northwest Kansas remains extremely low

TOPEKA — Several northwest Kansas remain or fell below the 2.0 percent unemployment mark in October, according to statistics released this week by the Kansas Department of Labor.

Trego, Gove, Logan, Wallace and Sheridan counties in northwest Kansas recorded jobless rates ranging from 1.5 percent to 1.8 percent.

Ellis County fell against, from 2.2 percent in September to 2.0 percent in October, according to KDOL figures.

Statewide, the unemployment rate went from 4.7 percent in September to 4.4 percent in October.

“The private sector continues to lead Kansas’ comeback from the Great Recession. This month, employers boosted job levels to a new record high,” said Justin McFarland, Director, Labor Market Information Services. “Kansans also saw their earnings increase by 3.3 percent over the month. The increased income will continue to drive growth.”

Wallace County’s 1.5 percent was the state’s lowest. Click the map above for a county-by-county breakdown.

There were 11,175 initial claims for unemployment benefits in October 2014, up from 10,978 in September and down from 13,489 last year. There were 66,959 continued claims in October, down from 68,335 the previous month and down from 93,184 in October 2013. These numbers include all available programs.

The November employment report will be released on Dec. 19.

Nope, most Americans are not stupid!

I write in the hopes of changing minds about politics.My entire professional career has been in education at the high school and higher education levels.Call my writings teachable moments. That being said, you can bet, as I speak, my many diehard liberal naysayers are having a meltdown without even hearing what I have to say.

Besides the issue of abortion there are umpteen other stand alone problems with Democrats to think about when voting such as socialism vs. capitalism, over spending, higher taxes, mediocre job creation, shredding our constitution, national insecurity, global warming scam, and many others.How can we forget the many scandals this administration has engaged in and that is the point of this writing.The scandals are endless, and just recently another whopper surfaces that most readers haven’t heard about.

Did you hear or read about MIT Professor Jonathan Gruber, a major architect of ObamaCare?Probably not because mainstream media treats it as a non story or media is late to the table with miniscule coverage on this whooper!It’s huge, and it proves, without a doubt of liberal mainstream media showing its bias as it tries, as usual, to protect the president.

Did you know that your tax money and mine made a multimillionaire out of con artist Gruber who admits on three or four different videos that, as one of the ObamaCare architects, it was his job to deceive the public about Obama’s signature healthcare law? The deception was mostly about how OC would be funded.To call the funding a tax would likely kill its passage, therefore, the architects vehemently denied it was a tax.The other thing that needed to be hidden was how younger and healthier people would pay the most to cover the older and less healthy people which wouldn’t fly either. The lies, the deception, were all over the place including you can keep your doctor, you can keep your same insurance, your premiums will go down by $2500, etc. Gruber’s videos show this man bragging about deceiving you and me and all of America.

Besides the $400,000 Gruber got up front his many speeches about OC in various states made him a multimillionaire – hold on to your seats – at American taxpayer expense!I’ve seen figures as high as six million the man made of taxpayer monies for lying!

Probably the biggest part of this story is that the government under Obama deliberately set out to lie to the public.Through Gruber the government admitted deliberate deception. The White House logs show Gruber visited there some 19 times and Gruber claims Obama was present at some meetings. Obama, as usual, as with most every scandal, denies knowing about Gruber as we have lie upon lie!

Adding salt to the wound, Gruber says we the public were too “stupid” to pick up on what was being proposed as legislation.The gall of this man is unconscionable.He also claims that “lack of transparency” was a real asset in getting this law passed.

Some people might have been stupid as Democrats passed this historic abomination without one single congressional Republican vote but many were not. I wrote about it a number of times.It was and still is an abomination.No matter what you hear from this administration and its allies, including mainstream media, ObamaCare to this day is a train wreck.Unfortunately, there isn’t space in this writing to spell out the damage OC has caused to our healthcare in this country.

House Majority Leader Nancy Pelosi said it all back in 2010 – “let’s pass it Congress so we can see what’s in it.”Isn’t it stupid to say that and isn’t it stupid for all the Democrats to vote for it, not even knowing what’s in the 22,000 pages?” Yet Gruber calls you and me the stupid ones!

There are four things I would like for you to take away from this writing.One, is that there’s a whole lot more than abortion to vote against. This scandal alone is reason enough not to vote Democrat.Two, are we being deceived by mainstream media as it distorts the news and too often hides the Obama negatives?Third, the deception, the lies, the lack of transparency of our present government permeates every single thing it does!Last, but not least, some Americans need to wake up to the fact that liberals think the majority of us are stupid, and they, with big government, knows what is best for us. To heck with the liberty or freedom of making our own decisions!

Thank God for a new Congress and the awakening of a majority of Americans as shown in our recent election, nationally and statewide!

Municipal court, HPD offices will be closed during relocation

The City of Hays Municipal Court and the administrative offices of the Hays Police Department will be closed at 1 p.m. Thursday, Dec. 4, and all day Friday, Dec. 5.

The court and HPD administrative offices will reopen at the new location, 3000 New Way, on Monday, Dec. 8, during normal business hours.

The move is to accommodate the reconstruction project at the Ellis County Courthouse and Law Enforcement Center.

Stockton man dies after van hits a tree

Fatal crashOSBORNE—A Stockton man died in an accident just after 11 p.m. on Friday in Osborne County.

The Kansas Highway Patrol reported a 2014 Chevy van driven by Frank Wolfgang Post, 44,  was traveling on U.S. 81 just west of Mitchell County.

The vehicle entered the north ditch, traveled through the ditch and hit a tree.

Post was pronounced dead the scene and transported to Clark-Gashaw Mortuary in Osborne.

The KHP reported he was properly restrained at the time of the accident.

Kids give first lady sarcastic ‘thanks’ on Twitter

WASHINGTON (AP) — School kids are giving thanks to first lady Michelle Obama just in time for the holiday — with a sarcastic Twitter hashtag about unappealing school lunches.

Along with photos of unsavory-looking school meals, the hashtag #ThanksMichelleObama was among the top trends on Twitter within the United States for a stretch on Friday.

The first lady has become the symbol of healthier school lunches as she has pushed for standards implemented in 2012 that require more fruits, vegetables and whole grains in the lunch line.

Many of the photos have a Thanksgiving theme while others are everyday meals. One of the most retweeted photos was from 17-year-old Hunter Whitney of Wisconsin, who posted a photo of a soupy Spanish rice gone wrong and an apple on his tray.

Annual HACC Christmas Tree Auction scheduled for tonight

The annual Christmas Tree Auction — Bright Lights for Little Tykes — is scheduled for tonight.

The Hays Area Children’s Center event, which helps fund early intervention and education efforts, will be Saturday, Nov. 22, at Rose Garden Banquet Hall, 2350 E. Eighth. The silent auction is set to begin at 6 p.m., with the live auction following at 7 p.m.

A $50 donation includes one buffet meal and complimentary wine. Auction items include vacations, electronics, holiday trees and more.

Waterline project will affect traffic for two weeks

Beginning Monday, traffic on West 27th Street at Hickory will be restricted but will remain open to east- and westbound traffic. The construction is scheduled to be completed within two weeks, pending weather conditions. The work is related to with the 2014 waterline project on Hickory Street.

Signs will be in place to direct the traveling public. The traveling public should use caution and if at all possible avoid these areas.
