Ellis Co. Attorney: Driver dies at the scene of deputy-involved shooting north of Hays

On Nov. 8, at approximately 3 a.m., a motorist was stopped by Hays Police officers in the 1800 block of Vine Street (U.S. 183) in Hays for driving left of center.

The driver initially complied with the traffic stop, then unexpectedly fled north. The vehicle reached speeds in excess of 70 mph in the city of Hays (35 mph zone) on North Vine Street.

The vehicle continued to drive erratic and at a high rate of speed as it left Hays northbound on U.S. 183. An Ellis County Sheriff’s Deputy attempted to intercept the vehicle at the Interstate 70/U.S. 183 intersection. The sheriff’s deputy and the Hays Police officers continued to pursue the vehicle northbound on U.S. 183.

The vehicle continued to drive erratic, and at one point left the roadway entering the west ditch (driving left of center). The speed of the vehicle was checked by radar to be in excess of 100 mph. The vehicle continued northbound on U.S. 183 when it attempted to pass a northbound vehicle. The fleeing driver lost control of the vehicle and entered the west ditch. The vehicle came to rest in a field approximately 1/3 of a mile south of the Ellis County/Rooks County line.

The driver of the vehicle got out of the vehicle. The driver then approached the Ellis County Sheriff’s Deputy. The driver was ordered to the ground. The driver initially complied with the Officer’s command and lied on the ground. The driver then stood up in a confrontational manner, refused the officer’s commands and attacked the officer. The driver was tased twice but continued to attack the officer. The driver knocked the officer to the ground.

The officer pulled his weapon and ordered the driver to get back. The driver again attacked the Officer and attempted to take the officer’s gun from the officer. The physical confrontation continued to occur on the ground. As the driver continued trying to take the officers’ gun from the officer, the officer fired multiple shots striking the driver. The driver died at the scene. The Ellis County Sheriff’s Deputy was treated at Hays Medical Center for injuries he received during the altercation and has been released.

Ellis County Sheriff’s Office immediately contacted Ellis County Coroner Dr. Lyle Noordhoek and the Kansas Bureau of Investigation and asked them to investigate the fatality officer involved shooting. The incident remains under investigation by the Coroner and the KBI. At this time, the decedent has not been positivity identified and, therefore, no next of kin notification has occurred.

The deputy, pursuant to Ellis County Sheriff’s Department policy, has been placed on paid administrative leave pending the investigation.

The names of the decedent and the Deputy involved will not be released while the investigation is pending because it is an ongoing criminal investigation [K.S.A. 45-221(a)(10)] and because it would be a disclosure of a personal nature that constitutes a clearly unwarranted invasion of personal privacy [K.S.A. 45-221(a)(30)]. The Coroner and the KBI ask for the public’s patience while the investigation continues.

Kansas high school group arrives safely after SUV hits a deer

KHPRILEY COUNTY – A Kansas school group was involved in an accident at 7a.m. on Tuesday in Riley County.

The Kansas Highway Patrol reported a 2008 Chevy Suburban from Pike Valley USD 246 and driven by Stephanie K. Jensen, 49, Courtland, was southbound on U.S. 77 two miles north of Randolph.

The SUV hit a deer.

Jensen and seven teen students were not injured and arrived for the KAYS conference scheduled at Wabaunsee High on Tuesday, according to principal Jeremy Luedke.

Sharon Faye Schuetz

3998397Sharon Faye Schuetz was born February 9, 1941, in Oberlin, Kansas, to Robert John Drury and Edna Faye (Peters) Rush. She passed away peacefully at her home on Friday, November 4, 2016, at the age of 75.

Sharon and her three siblings were raised on the family farm northeast of Oberlin. She attended Vallonia country school and graduated from Decatur Community High School in 1959.

On November 26, 1960, Sharon was united in marriage to Jerry V. Schuetz in Oberlin. They began married life in Oberlin then resided in Columbus, Abilene and Grainfield before returning home to Oberlin. Sharon was a very loving and devoted wife, mother of four daughters, grandmother of four grandsons, sister and friend to many. She took a lot of pride in her family and providing a good home for them while her daughters were growing up. In addition, Sharon worked for Custom Trophy and Engraving as an engraver for many years. Her grandsons held a very special place in her heart, and she enjoyed spending time with her family.

Survivors include her husband, Jerry of the home; two daughters and their husbands, Kathy and Stephen Campbell of Aurora, CO, and Lisa and Rick Johnson of Salina; a brother, Vyrl “Pete” Rush of Colorado Springs, CO; one sister and brother-in-law, Donna and Elmer Lawver of Colby; four grandsons, Joshua Campbell and Ian, Nash and Levi Johnson; nephews and nieces; other family members and friends. Sharon was preceded in death by her parents; two daughters, Iva Marie and Janet Schuetz; and a brother, Lemoin Rush.

Funeral Mass: Tuesday, November 8th at 11:00 a.m. at Sacred Heart Catholic Church in Oberlin with Rev. Mark Berland officiating

Jamie ‘Jay’ Dee Duff

Jamie was born to parents Jay Dee and Gloria K. “Katy” (Maupin) Duff on June 5, 1957 in Russell, Kansas.
His parents divorced and his mother married Stephen T. “Steve” Heinen in 1960.  The family lived in Osborne, Kansas and later moved to Russell in 1971, where Jamie attended and graduated from Russell High School.  Jamie left Russell and lived in several different states including Pennsylvania, New Jersey, and Florida.  While in Pennsylvania he met, fell in love with and married Sandra Harter Shade.  He and Sandra had one son together, Elijah.

Surviving family include his mother Katy Herrman (Raymond) of Russell, Kansas; son, Elijah Loren Duff of Harrisburg, Pennsylvania; brother, Stephen g. Heinen of Wichita, Kansas; two sisters, Gwenda Kay Radcliffe (Keith) of Meadows Place, Texas and Susanne Yarmer (Verlin) of Russell, Kansas; three nieces, Tina Rye, Kayla Jones (Chris), and Jennie Heinen; four nephews, Craig White, Justin White, Stephen G. II and John Heinen; one grand-niece and three grand-nephews; an uncle, aunts and cousins.

Jamie was preceded in death by his grandfather, Leland Maupin; step-father Steve Heinen; grandmother Ruby (Wallace) Maupin Keller; and father Jay Dee Duff.

A Celebration of Jamie’s Life will be held at 10:30 AM, Saturday, November 12, 2016 at St. Mary, Queen of Angels Catholic Church of Russell.  A private burial of ashes will take place at a later date.  The family will be available to greet friends from 9:00 AM to Service time at the Church.  Memorials may be made to Daystar Life Center of St. Petersburg.  Contributions and condolences may be sent to Pohlman-Varner-Peeler Mortuary of Russell, who is in charge of these arrangements.

Frederick Richard Boxberger

Fred was born February 14, 1927 to Frederick and Katherine (Ebel) Boxberger at the family farm west of Russell. He married Viola Schmitt Dufey. She preceded him in death. On April 7, 2000, he was married to Melva Kaufman at the Immanuel Lutheran Church in Wilson, Kansas.

Fred is survived by his wife Melva of Russell, Kansas; brother, Robert Boxberger of Russell, Kansas; four step daughters, Sharilyn Wilhelm (Don) of Wilson, Kansas, Carla Soukup of Dorrance, Kansas, LeAnne Hlaus (Frank) and Brenda Buehler (Wes) all of Wilson, Kansas; four grandchildren, eleven great grandchildren and three great-great grandchildren; three nephews including Steve Boxberger (Coleen) and Perry Boxberger (Kris) all of Russell, Kansas; six nieces; and numerous great nephews and nieces including Jacob Boxberger (Marie) and Blake Boxberger.

Fred was a life member of the Russell V.F.W. Post #6240 and the Russell American Legion Post #99. Fred served in the Korean War from 1950 to 1956. He was also a member of the Russell Elks Lodge and was involved with the German’s from Russia. He was a member of the St. John Lutheran Church and taught Sunday school for 23 years and served on the Church Council and various committees.

Fred was a retired farmer and rancher. After Fred and Melva married, they lived on the family farm and enjoyed traveling until they moved to Vintage Place in Russell in 2012.

Celebration of Fred’s Life will be held at 10:30 AM Wednesday, November 9, 2016 at the St. John Lutheran Church. Burial will follow at the St. John Lutheran Cemetery in Russell where the Russell V.F.W. Post #6240 Honor Guard will conduct Military Rites. Visitation will be from 9:00 AM to 8:00 PM on Tuesday, November 8, 2016 at Pohlman-Varner-Peeler Mortuary of Russell. A Prayer Service will be held at 7:00 PM Tuesday at the Mortuary.
A Memorial has been established with St. John Lutheran Church. Contributions and condolences may be sent to Pohlman-Varner-Peeler Mortuary, who is in charge of these arrangements.

Loren N. Hillman

Loren N. Hillman, age 61, of WaKeeney, passed away November 4, 2016, at his sister’s home in Junction City.

Services are pending with Schmitt Funeral Home, WaKeeney.

Ellis Co. Commission: Blue Sky Acres stalls for lack of a second

The proposed Blue Sky Acres residential development south of Hays hit another roadblock Monday when the Ellis County Commission failed to pass the final plat.

The property, owned by Mary Alice Unrein, is located south of Hays, is within the 3-mile extraterritorial jurisdiction area and is undeveloped farm ground located next to the VonFeldt Addition.

At Monday’s county commission meeting, Commissioner Dean Haselhorst made a motion to accept the final plat presented at the meeting by Hays Planning Inspection Enforcement Superintendent Jesse Rohr, but Commissioner Marcy McClelland refused to second the motion, defeating the measure.

Commissioner Barb Wasinger had recused herself from the discussion and vote because of a conflict of interest. County Counselor Bill Jeter also recused himself.

County Attorney Tom Drees served as the commission’s legal representation in Jeter’s absence and said the proposal will now go back to the city.

“Whatever concerns there are would have to be worked out and then it would have to be resubmitted again,”
Drees said.

In April, the final plat was reviewed and approved by a 6-1 vote by the Hays Area Planning Commission.

The property was originally zoned for agriculture and, in January, the Hays City Commission went against the recommendation of the HAPC and city staff and rezoned it to residential suburban. Staff cited the 2012 comprehensive plan as the reason for not recommending the change.

The city of Hays and the county are in talks on potential changes to the 3-mile zone. But Drees said if the plat would have been approved, it would have been grandfathered in under the current rules, which is why both the county and the city have to approve the final plat.

Rohr, as the zoning administrator for the city of Hays, would oversee the inspections for zoning and subdivision. The city, according to Rohr, does not enforce building inspections outside the city.

Under the residential proposal, Unrein was not asking for the county or city to provide any services. Unrein said she would hire someone to build and maintain the roads and that the residents of the subdivision would pay for maintenance through a housing authority.

The plat called for six lots ranging from 2.5 to 3 acres and included a dedicated road and alley right of way.

In October, a group of residents living in the VonFeldt Addition submitted a petition requesting the county vacate Randall Lane, the only road connecting Unrein’s property to a public road. The commission voted not to vacate the road, allowing for the development of the road.

In other business, the commission:

• Opened the two sealed bids for the sale of the Tholen Building, located at 209 W. 12th. They accepted the high bid of $41,911 from Mark Ottley. The building was appraised at $60,000. The county will draw up the contract and bring it back before the commission at a later date.

• Approved a lease with the Western Kansas Child Advocacy Center to build a building at the fairgrounds to store its Mobile Child Advocacy Unit. The Fair Board will vote on the agreement later this month.

• Authorized County Administrator Phillip Smith-Hanes to negotiate an agreement for snow removal at the county buildings with Flatlander Dirt Works. Flatlander provided snow removal services last winter. The county is looking for a multi-year agreement.

ELLIS COUNTY – Law enforcement authorities in Ellis County are investigating an officer-involved shooting north of Hays, according to the Kansas Highway Patrol.

U.S. 183 is currently closed in both directions from Saline River Road to the Ellis-Rooks County line.

The road will be closed most of Tuesday morning, according to the KHP.

Kansas man enters plea in 3-state prostitution business

TOPEKA – A Kansas man pleaded guilty Monday to conspiring to operate an interstate sex trafficking business, according to acting U.S. Attorney Tom Beall,

Barry M. Johnson, 40, Topeka, Kan., pleaded guilty to one count of conspiracy. In his plea, he admitted conspiring with co-defendants to run a Topeka-based prostitution business that operated in Kansas, Missouri and Nebraska. At times, as many as 20 females were working as prostitutes for the organization. The leader of the organization rented houses where some of the prostitutes were allowed to live. The organization used Web sites, social media and cell phones to advertise sexual services and to keep track of prostitutes.

Johnson admitted he recruited and groomed potential sex workers for the organization. Johnson would notify the leader of the conspiracy he had a female who was ready to work and they would negotiate how much he would be paid.

Sentencing is set for Feb. 6. Both parties have agreed to recommend a sentence of 46 months in federal prison.

Police look for suspect, SUV after man hospitalized in Kansas crash

FORD COUNTY –Law enforcement authorities in Ford County are investigating a fatal hit and run accident.

Just before 1:30 a.m. on Monday, officers with the Dodge City Police Department were dispatched to the area of 2000 East Trail Street for an injury accident involving a pedestrian, according to a media release.

First responders discovered a victim identified in a media release on Wednesday as Evan Kaiser, 27, Dodge City, with life threatening injuries.  He was transported to a Wichita hospital.

Just after 6 p.m. on Tuesday, he died, according to police.

An investigation determined Kaiser was hit from behind while walking west on Trail Street.

The possible suspect vehicle is a Nissan Murano with potential damage to the passenger side.

As of Wednesday morning, the suspect and vehicle had not been located.

Kan. detective, wounded in gun battle, expected to make full recovery

TOPEKA, Kan. (AP) — Authorities say a Topeka police detective wounded in a weekend shooting is expected to make a full recovery.

Police identified the officer in a news release Monday as Det. Brian Hill, a 25-year veteran of the department. The 51-year-old underwent surgery after he was shot Saturday night while responding to a convenience store robbery. Police said previously that he was shot in the leg and abdomen.

During the confrontation, Hill returned fire, wounding the suspect. Police spokeswoman Amy McCarter said the suspect is hospitalized in critical condition. The man’s name wasn’t immediately released.

John J. Kohl

John J. Kohl, age 81, passed away on Friday, November 4, 2016 at the Park Lane Nursing Home in Scott City, Kansas. He was born on January 22, 1935 in Marienthal, Kansas, the son of Frank and Elizabeth Berning Kohl. A lifetime resident of Marienthal, Kansas, he was a farmer.

He was a member of St. Mary Catholic Church in Marienthal, Kansas.

On August 25, 1964 he married Carol Ann McLinn in Garden City, Kansas. She passed away on July 18, 1988 in Garden City, Kansas.

Survivors include his One Son – Curtis Kohl of Marienthal, Kansas, One Daughter – Jeanna & Scott Boddicker of Mesa, Arizona, Two Sisters – Marie Baker of Marienthal, Kansas and Tillie Hill of Lyman, Nebraska.

He was preceded in death by his Parents, Wife, Sister – Elizabeth Huffman and Three Infant Sisters – Anna, Johanna and Joanna Kohl.

Vigil Services will be held at 7:00 p.m. Wednesday, November 9, 2016 at St. Mary Catholic Church in Marienthal, Kansas.

Funeral Mass will be held at 10:30 a.m. Thursday, November 10, 2016 at St. Mary Catholic Church in Marienthal, Kansas with Fr. Ben Martin presiding.

Memorials in Lieu of Flowers may be given to the St. Mary Catholic Church in Marienthal, Kansas in care of Price & Sons Funeral Homes.
