Judge: Kansas has no right to millions from unclaimed bonds

TOPEKA, Kan. (AP) — A federal judge has rejected a lawsuit filed by the Kansas state treasurer that argued the state had a right to claim ownership to savings bonds it deemed abandoned, in many cases, because the original bond holder had died without a will or legal heir.

The Wichita Eagle reports the ruling was handed down Monday. State treasurer Ron Estes says the state is considering appealing the ruling.

The U.S. Treasury Department adopted rules in 2015 that require states to have bonds in their possession and sufficient evidence of their abandonment in order to claim them as property. Estes sued the department in March in an attempt to block the new rules and recover the funds. The state treasurers of South Dakota, Louisiana, Mississippi and Kentucky joined Estes as plaintiffs in the case.

Police: Kansas man hospitalized after knife attack

RENO COUNTY – Law enforcement authorities in Reno County are investigating a Monday night stabbing.

Just after 9p.m., Ronald Boyd, 23, Hutchinson, and his girlfriend were in Carey Park when a white male approached them resulting in a verbal altercation, according to police.

Boyd was stabbed in the chest one time and was taken to the hospital for treatment.

Police had not spoken with Boyd on Tuesday because he was sedated.

No arrests have been made.

Kan. wildlife cameras capture jokers dressed as monsters

GARDNER, Kan. (AP) — Motion-activated cameras intended to capture images of mountain lions in a Kansas park have instead snapped pictures of pranksters dressed as animals, monsters and Santa Claus.

Police said they found the images on the two cameras at the park in Gardner on Monday.

Interspersed among images of skunks and coyotes were photos of people wearing costumes pretending to be lions wrestling, a gorilla, various monsters and an old person with a walker. And of course Santa made an appearance during the three nights of high jinks.

Cpl. Robert Huff said it was “pretty comical” and “creative.” The pranksters have not come forward.

 

The cameras were established this month to investigate reports of mountain lions. No mountain lions were detected.

Gardner is 30 miles southwest of downtown Kansas City, Missouri.

Man arrested for crash that killed 80-year-old Kan. woman

FINNEY COUNTY- Law enforcement authorities in Finney County continue to investigate a fatal Saturday, November 26, hit and run accident.

On Monday evening, police arrested Rafael Lopez, 62, Garden City, for his involvement in the accident, according to a media release.

Lopez had earlier responded to the Law Enforcement Center voluntarily.

Just before 7 p.m. on Saturday, police were called to the area of 700 W. Kansas Avenue for a reported pedestrian accident.

First responders located Maria Leonarda Macias De Ubiarco, 80, Garden City, dead in the roadway.

The initial investigation revealed Ubiarco was crossing the street southbound on foot in the 700 Block of W. Kansas Ave near Mildred Drive when she was struck by a light colored Chrysler PT Cruiser that was traveling East on Kansas Avenue. The PT Cruiser fled the scene.

Lopez is being held in the Finney County Jail on charges of Leaving the Scene of an Accident involving a Fatality, Failing to Provide Information at the Scene of an Accident, and Interference with Law Enforcement.

A search warrant was also executed at Lopez’ residence and the vehicle involved was recovered.

Christmas from the days of the one-room schoolhouse will be remembered and celebrated, along with Christmas present, in an open house at Fort Hays State University’s Plymouth Schoolhouse from 2:30 p.m. to 4:30 p.m. on Thursday, Dec. 1.

Christmas Open House, sponsored by the university’s Science and Mathematics Education Institute, is free and open to the public. Refreshments will be provided.

FHSU gets most text pledges, but ESU wins “Don’t Text #Just Drive”contest

TOPEKA-–Emporia State University received the highest number of votes by percentage of students enrolled to win the initial “Don’t Text #Just Drive” fall contest among seven Kansas Universities.

In all, nearly 35,000 pledge votes were cast by students, alumni and supporters of each university, all taking the pledge not to text while driving. Those votes account for one-third of the universities’ student populations.

Emporia State’s 3,749 pledge votes counted as 63.68 percent of the total student population, the highest percentage among the seven universities.

Other schools (in order of percentage votes) in the contest were Pittsburg State University, 60.01 percent (4,262 votes); Wichita State University, 38.39 percent (5,556 votes); Washburn University, 37.85 percent (3,017 votes); Fort Hays State University, 34.53 percent (5,062 votes); Kansas State University, 26.38 percent (6,272 votes); and the University of Kansas, 19.71 percent (5,599 votes).

Besides Emporia State’s percentage win, each school had a unique attribute to its pledge campaign, according to statistics compiled during the contest. Kansas State had the highest number of pledges; KU had the most widespread support throughout the state; Pittsburg State had the best “drive for change” in promoting downloads to block text messages while driving; Washburn had the biggest jump in votes in one week; Fort Hays State had the most pledges by text message; and Wichita State had the most student government promotional involvement.

“We are gratified by the number of students, alumni and school supporters who pledged their vote and their willingness to stop needless traffic accidents because of distracted driving,” said Ken Selzer, CPA, Kansas Commissioner of Insurance.

The Kansas Insurance Department, the Kansas Department of Transportation, AT&T, The Kansas Automobile Insurance Plan, the Kansas Turnpike Authority, The Kansas Highway Patrol, Allstate Insurance Company, State Farm Mutual Insurance Company, Farmers Insurance and Upland Mutual Insurance Company sponsored the fall campaign, which ended Nov. 22.

Activities publicizing the pledge contest were conducted at each university, and public service announcements were aired and editorials printed by statewide news media throughout the campaign. Assisting with the campaign was Kendall Schoenekase, Miss Kansas 2016, who chose “Stay Alive, Don’t Text and Drive” as her public issue during her reign.

“We couldn’t have had the response we did without the public commitments from our sponsors, Miss Kansas and our university student leaders,” Commissioner Selzer said. “Their willingness to consistently get the message out will make a statement for Kansas drivers for years to come.”

A national study found that three out of four people surveyed admitted to texting while driving, even though they agreed that the activity is dangerous to themselves and others.

“All Kansans are winners through this campaign,” Commissioner Selzer said. “We’ve shown pride in our universities and made a safety statement at the same time. Now it’s up to those who pledged to follow through on their commitments.”

A reception for an exhibit of Korean ceramics at Fort Hays State University’s Forsyth Library will begin at 6:30 p.m. Wednesday, Nov. 30.

The exhibit is curated by Jessica Hayes, an Abilene senior in the Bachelor of Fine Arts program at FHSU.

The reception is open to the public.

An earlier FHSU news release incorrectly had the reception date for Nov. 29.

Two events are scheduled for this week from the ceramics section of Fort Hays State University’s Department of Art and Design.

The fall edition of the two-day Pottery Sale begins at 9 a.m. Tuesday, Nov. 29, in the Memorial Union. Wednesday, Nov. 30, the sale also begins at 9 a.m. On both days, the sale ends at 1 p.m. Works by students and by Linda Ganstrom, professor of art and design, will be on sale.

Proceeds support travel by ceramics students and the visiting ceramic artist program.

Neal A. Petrie

Neal A. Petrie, age 87, of Oakley, died Thursday, November 24, 2016 at the Colby Health and Rehab Center, Colby.

He was born on September 1, 1929 in Pratt, KS to Samuel David Petrie and Clara Francis (Gessley) Petrie. Neal married Retha Loree Roberts on November 12, 1949 in Oakley. He was a Soil Conservation Service Technician and farmer. Neal enjoyed hunting and fishing, farming, and was an arborist.

Preceded in death by his parents, brother Stanley, and two sisters, Bernice Dickinson and Marian Machtan.

Survivors include his wife Retha of the home, son Gary Petrie and wife Cindy of Everett, PA, daughter, Janis Petrie of Bandon, OR, and granddaughter, Katelyn Dibert and husband Derek of Bedford, PA.

Funeral service: 10:30 a.m. Thursday, December 1, 2016 at Kennedy-Koster Funeral Home, Oakley, with Pastor Bob Kelly officiating. Burial will follow in Oakley Cemetery. Helen L. Balthazor

screen-shot-2016-11-29-at-10-47-27-amHelen L. Balthazor, age 86 of Concordia, passed away on Sun., Nov. 27, 2016 at the Smoky Hill Health & Rehab Center, Salina, KS. Helen was born on Nov. 9, 1930 in Concordia, KS to Grant Palmer & Sophronia Helen (Buoy) Appleby.

Helen attended schools in the Ames area. She married Armand J. Balthazor on Sept. 14, 1948 in Clyde, KS. During the 50’s, Helen and Armand operated several local restaurants in the Clyde and Clifton area, including the Clyde Cafe. They also operated a restaurant in Eugene, OR until returning to Concordia to operate the Frontier Cafe. Helen also worked at Nicholson Drug Store for many years and later returned to school and was an LPN at St. Joseph Hospital in Concordia. She was a member of Our Lady of Perpetual Help Catholic Church, Concordia. For the past two years, Helen was a resident of the Smoky Hill Rehab Center in Salina where she enjoyed a renewed quality of life.

As the last of her generation, Helen is survived by her husband, Armand, Concordia; sons: James Balthazor (Cindy), Russell, Fred Balthazor, Overland Park, Greg Balthazor, Shawnee, Patrick Balthazor (Jamie), Concordia; daughters, Cynthia Cleveland (Michael), Salina & Christine Sevigny, Topeka; several grandchildren & great grandchildren & numerous nieces & nephews.

She was preceded in death by her parents; sisters, Martha Jane Partch (Leo) & Bonnie Caron (Joe); a brother, Wilbur Appleby (Josephine); grandson, Kirk Balthazor & infant great grandson, Benjamin Cleveland.

A Mass of Christian Burial will be held at 10:00 am, Thurs., Dec. 1, 2016 at Our Lady of Perpetual Help Catholic Church, Concordia with Fr. David Metz & Fr. Larry Letourneau officiating. Burial will follow at Mt. Calvary Cemetery, Clyde. Elsie Runnion

Former Phillipsburg resident Elsie Runnion passed away Sunday, Nov. 27, 2016 at the Hays Medical Center in Hays, KS at the age of 96.

She was born in Fort Morgan, CO on Sept. 14, 1920, the daughter of George & Molly (Reiber) Wagner.  Her husband, Francis Runnion, preceded her in death on July 4, 1991.

Survivors include her four sons:  Niles and Randy, both of Phillipsburg, KS; Richard of Ottumwa, IA; and Stanley, of Prairie View, KS; one daughter, Carol Shove, of Noonan, GA;       numerous grandchildren, great-grandchildren, and great-great-grandchildren.

Funeral services will be held Friday, Dec. 2, 2016 at 10:30 a.m. in the Olliff-Boeve Memorial Chapel, Phillipsburg, with Pastor Gregg Runnion officiating.  Burial will follow in the Fairview Cemetery, Phillipsburg.

Mrs. Runnion will lie in-state on Wed., Nov. 30, from 5-9 p.m. and again Thursday, Dec. 1, from 9 a.m. – 9 p.m. at the funeral home, with the family receiving friends Thursday evening from       6 p.m. – 7 p.m.

KHP releases additional details in fatal Ellis Co. crash

FatalCrashELLIS COUNTY – A Rooks County woman died in an accident just after 2 p.m. Nov. 20 in Ellis County.

Following an eight-day investigation, the Kansas Highway Patrol on Tuesday reported a 1999 Buick LeSabre driven by Matthew D. Miller, 34, Plainville, was southbound on U.S.183 thirteen miles north of Hays.

The LeSabre crossed left of center and hit a 2004 Dodge Stratus driven by Jon Stuart Olson II, 41, Hays, head-on.

Olson, Miller and a passenger in the Buick— Kay Nicole Crumble, 36, Plainville — were transported to Hays Medical Center, where Crumble died.

No additional details were released on Tuesday.
