Kan. man accused of child porn on his phone enters plea agreement

HUTCHINSON — A Kansas man charged with sexual exploitation of a child saw that charge go away on Thursday while he entered a “guilty” plea to the second count of aggravated violation of the offender registration act.

Douglas A. Kennel, 45, Hutchinson, was arrested on January 27 following an investigation that began when he took an old phone to have data transferred to a new phone.

The phone store employee transferring the data saw images that he thought to be child porn.

District Attorney Keith Schroeder said after the hearing Thursday that he found a lot of mitigating factors with this case including the fact that the defendant had deleted the pictures several years ago, even reformatted his phone so he wouldn’t have access to them, but they were still apparently on the SD card.

As part of the plea agreement, both sides will recommend nearly 20-years in prison, but will also recommend five years of intense community corrections.

They also convinced Magistrate Judge Cheryl Allen to reduce the bond down from $250,000 to the original amount of $10,000.

Although the state dropped the charge of sexual exploitation of a child, Schroeder told the court he would dismiss the charge without prejudice, meaning he can re-file the charge at anytime within the next five years.
Kennel will also be under some strict rules before and after sentencing. He must remain in contact with his attorney and his bonding agent and have a sex offender evaluation completed.

Prior to sentencing, he’ll be under court supervision and can’t leave the county without their permission, other than for the evaluation, which will be done at Prairie View in Newton.

He also can’t have any contact with a child under the age of 18, without supervision of his wife or pastor. However, he can have contact with his three stepchildren.

He also can’t have any access to a computer, cell phone or other electronic device that can be connected to the Internet.

Any computer in his home will be password protected in a manner that would prevent him from gaining access to the Internet, but wouldn’t hinder other members of the household.

He’s also forbidden from consuming alcohol or illegal drugs and must obey all laws of Kansas and the United States.

He also agreed to waive any right to appeal any legal sentence handed down by the Judge.

Sentencing in the case is scheduled for May 20.

James L. ‘Jim’ Lalicker

James L. “Jim” Lalicker, 76, La Crosse, Kansas, died Friday, February 12, 2016, at his home in La Crosse, Kansas.

Mr. Lalicker was born January 10, 1940, in Gage, Oklahoma, the son of Hugh Elwood and Stella Ann (Lamb) Lalicker. He was a resident of La Crosse, Kansas, for 13 years, moving from Hays, Kansas. A 1958 graduate of Gage High School, Gage, Oklahoma, he was an auto mechanic, and auto salesman before his retirement.

He was a member of the United Methodist Church, La Crosse, Kansas; a life member of VFW Post 9076, Hays, Kansas; a former coach for the Meade REC, Meade, Kansas; and a former boy scout leader in Gage, Oklahoma.

He was a United States Army veteran serving in Iceland during the Vietnam War.

On April 8, 1961, he married Barbara Pace in the State of Washington. They divorced.

On December 5, 1975, he married Judy Kay (Conway) Hammer in Meade, Kansas.

Survivors include: his wife, Judy Kay Lalicker, La Crosse, Kansas; three sons, Robert Alan Lalicker (Amy), Graham, Washington, Jack Lee Lalicker (Laurel), Wellington, Colorado, and Jason Eugene Lalicker (Paula), Oklahoma City, Oklahoma; three daughters, Brenda Lalicker, Rio De Janeiro, Brazil; Darla Lalicker, Seattle, Washington, and Dianna Kelly, Seattle Washington; 18 grandchildren, Misty Dryden (Doug), Justin Lalicker (Amber), Lacey Bonner (Lucas), Joshua Lalicker, McKenzie Wilkinson, Olivia DeGoy Moreira, Marcus DeGoy Moreira, Mario DeGoy Moreira, Cecilia DeGoy Moreira, Jeffrey, Nucci, Timothy Kelly, Caleb Kelly, Jordan Lalicker, Michael Lalicker, Travis Lalicker, Bethany Lalicker, Channing Smith (Brian), and Mallorie Patrick; 10 great grandchildren; one brother, Larry Jo Lalicker, Gage, Oklahoma; one sister, Donna Jean Lalicker, Gage, Oklahoma, and his former wife, Barbara Jamal, Seattle, Washington.

He was preceded in death by his parents; and one brother, Donald Lalicker.

Memorial service will be Wednesday, February 17, 2016, at 10:00 A.M. at the Janousek Funeral Home, La Crosse, Kansas, with Brother Terry Warner officiating.

Mark ‘Ruppy’ Rupp

56bd41337d6caMark “Ruppy” Rupp, age 52, of Hays, passed away Thursday, February 11, 2016 at Salina Regional Health Center in Salina. He was born October 10, 1963 in Hays, Kansas to Robert and Mary Alice (Klaus) Rupp.

He was a long time local owner operator of Roto-Rooter and also a longtime volunteer manager at the Hays VFW. He also owned “Ruppy’s Place” in the mid to late 1980’s. Mark enjoyed family and friends and competition BBQ and catering.

He is survived by two daughters, Kiley Rupp of Hays and Adalyn Rupp of Denton, TX; three brothers, Ricky Rupp of Thornton, CO, Dave Rupp and Bruce Rupp of Hays; granddaughter, McKinnley Rupp of Denton, TX his former wife and best friend, Lesly Rupp of Hays and friends to numerous to mention.

He was preceded in death by his parents as well as several close friends and relatives.

Funeral services will be 11 AM Monday, Feb 15, 2016 at Immaculate Heart of Mary Church in Hays. Private inurnment will be at later date.

Strong finish lifts Tigers past Missouri Southern; Johnson wins 300th game

JOPLIN, Mo. – Craig Nicholson nailed a 3-pointer with 1:35 to play to give Fort Hays State the lead for good as they score the final five points in an 85-82 win over Missouri Southern Saturday at the Leggett & Platt Athletic Center. The Tigers (16-8, 10-8 MIAA) led by 12 in the first half and were up nine with 5:28 to play before the Lions (14-11, 11-8 MIAA) put together a 10-2 run to take the lead 1:56 to play.

The win snapped the Tigers six-game road losing streak and was the 300th for head coach Mark Johnson.

Rob Davis led five Tigers in double-figures with 24 points. Nicholson added 15, Jake Stoppel and Hadley Gillum 12 and Kenny Enoch 11.

Taevaunn Prince, who leads the country in scoring, led the Lions with 21 points, six below his season average.

The Tigers shot 53-percent from the floor including 8-of-19 from beyond the arc. They hit 23-of-25 free throws and outrebounded the Lions by nine.

Tiger baseball falls in home opener

HAYS, Kan. – Fort Hays State baseball dropped its home opener to Regis University on Saturday (Feb. 13) by the score of 9-2. With the loss the Tigers now sit even on the season with a 2-2 record. Regis claimed its first game of the season, going to 1-0.

Tiger starting pitcher DJ Carr suffered his first loss of the season going just four innings. He gave up eight runs (six earned) on nine hits with just one strikeout and one walk. Will Amen, Clayton Basgall and Connor Boyer did well in relief allowing just three hits and one run over the final four innings.

The Fort Hays State bats struggled during the chilly afternoon in Hays, collecting just two runs on five hits. A highlight of the offense was Joe Mapes’ second home run of the season, which he blasted down the right field line in the fourth inning. Ty Redington, Austin Unrein and Trevor Hughes also picked up singles, and Casey Sedbrook had a pinch hit double to lead off the ninth.

Brad Thoutt picked up the win for the Rangers going six strong innings, giving up just two runs on three hits while walking five and striking out three. Will Waterman recorded the three-inning save by allowing just two hits and striking out four.

This was the first of three games being played over two days. A doubleheader will be played on Sunday (Feb. 14) starting at noon to wrap up the series. Both games will be 9-inning contests.

Supreme Court Associate Justice Scalia found dead at Texas ranch

WASHINGTON (AP) — Antonin Scalia, the influential conservative and most provocative member of the Supreme Court, has died. He was 79.

The U.S. Marshals Service in Washington confirmed Scalia’s death at a private residence in the Big Bend area of South Texas.

The service’s spokeswoman, Donna Sellers, says Scalia had retired for the evening and was found dead Saturday morning when he did not appear for breakfast.

Graham’s 27 lead No. 6 Kansas past No. 3 Oklahoma

NORMAN, Okla. (AP) — Devonte’ Graham scored a career-high 27 points and did a tenacious job defending Buddy Hield to help No. 6 Kansas defeat No. 3 Oklahoma 76-72 on Saturday.

Graham made 6 of 9 3-point attempts for the Jayhawks (21-4, 9-3 Big 12), who swept the regular-season series. Kansas won the first meeting 109-106 in triple overtime on Jan. 4.

Hield, who scored 46 points in the first meeting, scored 18 of his 24 points in the second half for Oklahoma. Isaiah Cousins added 21 points for the Sooners (20-4, 8-4), who fell out of a tie for the conference lead.

It was Kansas’ fifth straight win, and it snapped Oklahoma’s 19-game home winning streak. Kansas was coming off a win over No. 10 West Virginia on Tuesday.

Oklahoma matched a season-low by shooting 33.3 percent from the field. The Sooners, who entered the game leading the nation in 3-point percentage, made just 10 of 32 from beyond the arc.

JOPLIN, Mo. – Chelsea Mason scored 16 and Nikola Kacperska went 8-for-8 from the free throw line and added 15 points to lead No. 5 Fort Hays State to a 68-62 win at Missouri Southern at the Leggett & Platt Athletic Center. The Tigers (21-3, 15-3 MIAA) used a 14-0 first half run to go up 10, then scored eight straight late in the third quarter after the Lions (16-9, 10-9 MIAA) had battled back to tie it.

Budget patches have Kansas lawmakers seeing broader problems

TOPEKA, Kan. (AP) — Kansas legislators are preparing to close a deficit largely with budget juggling, and a growing number are seeing broad problems with how the state is managing its finances.

Conservative Republican Gov. Sam Brownback’s critics blame his aggressive tax-cutting policies for crises across state government. The problems include inadequate pay at state prisons and short staffing in state mental hospitals.

Lawmakers in both parties also argued in recent debates that the fixes proposed by Brownback paper over the state’s budget gap rather than close it.

Brownback’s spokeswoman dismissed what she called “the sky is falling” criticism.

But even some allies acknowledged they’ll be largely doing a quick patch with budget-balancing legislation. The projected deficit is nearly $200 million in the state’s $16.1 billion budget for the fiscal year beginning July 1.

Oklahoma State outlasts Kansas State in overtime

STILLWATER, Okla. (AP) — Tavarius Shine came off the bench to score 11 points, five in overtime, to lead Oklahoma State to an 58-55 victory over Kansas State on Saturday.

Leyton Hammonds led the Cowboys (12-13, 3-9 Big 12) with 13 points, while adding six rebounds, as his team snapped a three-game losing streak. Oklahoma State had lost nine of its previous 11, with five of those defeats decided by five points or fewer.

Justin Edwards scored 14 points and posted 13 rebounds to lead Kansas State (14-11, 3-9).

Oklahoma State nearly won it at the end of regulation, as it appeared that Jeff Newberry hit a 3-pointer from half court just as the buzzer sounded. The officials called it good, but a video review showed that Newberry released the ball a split second after the clock expired, overturning the verdict.

Kansas State missed four shots in the final 15 seconds of overtime.

Northern Iowa holds on to beat No. 25 Wichita State

WICHITA, Kan. (AP) — Klint Carlson scored 12 points, Wyatt Lohaus had 11 and Northern Iowa held on to beat No. 25 Wichita State 53-50 on Saturday, ending the Shockers’ nation-leading 43-game home winning streak.

The Panthers (16-11, 8-6 Missouri Valley) blew a 15-point second-half lead before pulling back ahead on consecutive baskets by Lohaus with about 6 minutes left in the game.

The Shockers (18-7, 12-2) got within 53-50 when Shaq Morris made the second of two free throws with 40.2 seconds left, then got the ball back when Wes Washpun had his shot blocked with 10 seconds to go.

Ron Baker missed a potential tying 3 at the other end, but the ball bounced off a Northern Iowa player out of bounds. Given another chance, the Shockers got the ball to Connor Frankamp in front of his own bench, but his 3-pointer bounced off the rim as the buzzer sounded.

Massage Parlor Owner Charged in Kan. Sex Trafficking Case

sexWICHITA, KAN. – The owner of a Wichita massage parlor was charged Friday in federal court with harboring a Chinese woman who worked as a prostitute, according to U.S. Attorney Barry Grissom.

Samir F. Elias, 60, Wichita, Kan., is charged with one count of transporting an alien who is in the United States unlawfully, one count of harboring an alien who is in the United States unlawfully, one count of harboring an alien for the purpose for prostitution and two counts of money laundering.

The charges allege Elias was the owner of GiGi’s Elite Massage, which operated at 357 N. Hillside in Wichita after moving from a previous location at 6611 E. Central. Elias employed a Chinese woman who used the name Angel. An undercover vice detective with the Wichita Police Department arrested the woman after she offered to perform sexual services during a massage.

Investigators learned that:

The woman lived at the massage parlor or at times at Elias’ home.

She usually worked seven days a week.

She had no formal training in how to give a massage.

Patrons paid $40 for 30 minutes and $60 for an hour of massage. She paid Elias $10 of the fee for the $40 massage and $20 of the fee for the $60 massage. She was allowed to keep her tips.

The woman was convicted in Wichita municipal court on a charge of sale of sexual relations. She is appealing the conviction.If convicted, she faces a maximum penalty of 10 years in federal prison and a fine up to $250,000 on counts 1, 2 and 3, and a maximum penalty of 20 years and a fine up $500,000 on counts 4 and 5.

The Wichita Police Department and Homeland Security Investigations (HSI) investigated. Assistant U.S. Attorney Jason Hart is prosecuting.

Earthquakes felt across Kansas, 6 other states

FAIRVIEW, Okla. (AP) — The U.S. Geological Survey reports a 5.1 magnitude earthquake in northwest Oklahoma that was reportedly felt across Kansas, Missouri, New Mexico, Nebraska, Texas, Arkansas and Iowa.

Fairview police and the Major County Sheriff’s Office say there are no reports of injury or damage as a result of the quake that struck Saturday at 11:07 a.m. about 17 miles north of Fairview. A second earthquake measured at magnitude 3.9 struck in the same area at 11:17 a.m. The area is about 100 miles northwest of Oklahoma City.

The strongest earthquake on record in Oklahoma is a magnitude 5.6 centered in Prague in November 2011 that damaged 200 buildings.

The temblors are the latest in a series of earthquakes linked to the injection of wastewater underground from oil and gas production.
