Stramel and Calvin enter into pleas in deadly hit-and-run accident in Ellis Co.

By JONATHAN ZWEYGARDT
Hays Post

The two people facing charges in connection with the 2015 fatal hit-and-run accident that left a rural Ellis County man dead entered into plea agreements Wednesday in Ellis County District Court.

Holliann Marie Stramel, Hays, pleaded no contest Wednesday to failure to stop and render aid at a fatality accident (a level 5 person felony) and vehicular homicide (a class A misdemeanor). As a result of the plea agreement, a third charge, concealing/altering evidence of a crime/interference with law enforcement was dropped.

According to court documents, Stramel admitted driving the Dodge Ram pickup belonging to Trevor Jay Calvin that, on July 18, 2015, struck and killed 67-year-old John Befort who was walking on the county road near his home on 210th Avenue.

Under the agreement, Stramel faces between 31 and 136 months in prison and a fine of up to $300,000 for the felony and up to 12 months and a fine of up to $2,500 for the misdemeanor.

Calvin, Hays, was charged with unlawfully, feloniously and knowing, conceal or materially alter evidence. Calvin allegedly lied to authorities about the location of the pickup and helped take the vehicle to Colorado for repairs following the accident.

Under Kansas sentencing laws, concealing or altering evidence of a crime is a level 8 felony and, as a result of Calvin’s no contest plea to the charge, he faces between seven and 23 months in prison as well as a fine.

A civil case between Befort’s family and Stramel and Calvin has been resolved, according to court documents, so no restitution will be paid in the case.

Sentencing for both Calvin and Stramel will be scheduled at a later date following the completion of a presentence investigation.

Mumps cases reported at University of Kansas

Mumps virus-CDC image

LAWRENCE, Kan. (AP) — Health officials have confirmed one case of mumps at the University of Kansas and are investigating nine other suspected cases since mid-December.

The Lawrence-Douglas County Health Department announced the findings Wednesday. Mary Beverly, the department’s director of epidemiology, says it’s not clear where the cases were contracted but some likely spread before the university’s winter break on Dec. 16. The first day for spring classes is Jan. 17.

The Lawrence Journal-World reports Beverly said some of the students who became ill lived in group housing but others did not. She declined to share more details.

The University of Missouri reported more than 220 mumps cases by mid-December.

Federal officials say the 258 cases of mumps nationwide as of early December is the largest outbreak since 2006.

Court: City of Hays interests outweigh worker’s speech rights

WICHITA, Kan. (AP) — A federal appeals court has ruled that the “operational interests” of a city as a public employer outweigh the free speech rights of a former secretary who provided an affidavit in support of a fired police officer’s lawsuit.

The 10th Circuit Court of Appeals sided with the city of Hays.

A three-judge panel found administrative secretary Firma Helget’s disclosure of confidences in the voluntary affidavit caused her superiors to lose trust in her, undermining the department’s operations.

Helget was fired in 2012 after her affidavit saying she had been instructed to not order a ballistic vest for a police officer known for union organizing. The officer contended in a wrongful termination lawsuit the city decided not to order the vest prior to the incident used to justify his termination.

According to court documents, on Nov. 16, 2011, former Hays Police Department Officer Blaine Dryden filed a
lawsuit against the City of Hays, City Manager Toby Dougherty and then-Chief of Police James Braun. Dryden claimed that defendants had fired him in retaliation for union activities.

His complaint alleged that in early December of 2010, the city had decided not to replace his worn out
ballistics vest. This allegation was relevant because the city claimed that it fired him for an
incident which occurred in late December of 2010. Thus, the fact that the city decided in early
December not to replace Dryden’s ballistics vest supported his claim that the city’s stated reason
for firing him was a pretext.

US Senate takes first vote to eliminate Obamacare

WASHINGTON (AP) — The Senate has taken its first vote on the way to repealing Obamacare. The 51-48 procedural tally broke mostly along party lines and officially begins debate on a special budget measure. It’s a precursor to a follow-up bill to repeal Obama’s health care law. Kentucky Republican Rand Paul opposed the measure since it endorses large budget deficits.

President Barack Obama is urging House and Senate Democrats to “look out for the American people.” Those were his parting words after a lengthy closed-door meeting about preserving his health care law. Senate Democratic leader Chuck Schumer warns that repeal would throw the insurance marketplace into chaos.

Wednesday morning marked the first sendoff of the highly anticipated return of the early morning flight to Denver from Hays Regional Airport.

The Fill the Plane celebration took place at the airport at 6 a.m. The event was organized by Hays High School DECA students, who have put on several other Fly Hays events. Seniors Griffin Lowry and Daniel Lopez worked on the event as part of their DECA creative marketing project for Hays Regional Airport.

griffin
Griffin Mowry, HHS DECA, discusses his creative marketing project for Hays Regional Airport.

“The project is basically assessing a problem within our community and trying to figure out marketing strategies to help solve that. The problem with the Hays airport is not enough people are using it to fly, and we’re going to figure out what we need to do to help solve that,” Lowry said.

“We worked with Gail Kuehl, who’s been very on top of the project and trying to get a survey out to see what people need,” Lopez said. “People have been saying they want an earlier flight.”

Attendees enjoyed complimentary coffee, orange juice and breakfast courtesy of McDonald’s, as well as the opportunity to enter a raffle to win two free vouchers for round-trip tickets to Denver. The tickets were awarded to Calder Craig.

Daniel Lopez, HHS DECA, is amused he got out of bed so early to make the event.

The high school students were among the first to arrive to set up the breakfast buffet.

“I got a call from Griffin this morning at 5 o’clock and I was like, ugh,” Lopez grimaced.

Several local businesses purchased tickets for employees in support of the reinstated 6:50 a.m. flight. These businesses included Hays Area Chamber of Commerce, city of Hays, Hays Convention and Visitors Bureau, Hays Med, Enersys, Eagle Communications, SkyWest, Ellis County Coalition for Economic Development, Walmart, McDonald’s and Golden Belt Bank.

Attendees included city officials, Ellis county commissioners and Fort Hays State University officials.

henry
Henry Schwaller, Hays city commissioner, encourages the public to take advantage of early morning flights to Denver.

City Commissioner Henry Schwaller boarded the flight after thanking all the elected officials and community members for attending the celebration. Schwaller reinforced the importance of the community’s usage of the flight.

“We want to get over 10,000 boardings and, the last two months, we’ve had over 900 boardings each month,” he said.

He was joined by chamber Executive Director Tammy Wellbrock who echoed the importance of flying for the economy of Hays.

“We are so excited in the community of Hays to have a service like SkyWest United that is flying between Hays and Denver round-trip throughout the day, and they brought back our morning flight. That is because of all of you,” she said.

The audience followed with an enthusiastic applause.

deice
SkyWest plane is deiced in single-digit temperatures this morning before takeoff.

The flight departed at approximately 7:10 a.m. about 20 minutes later than scheduled due to procedural deicing. The temperature in Hays at 7 a.m. was in the single digits.
