WICHITA, Kan. (AP) — A suburban Kansas City couple whose home was raided by police in a fruitless search for marijuana has lost their lawsuit against Johnson County.

A federal court ruled Tuesday that Adlynn and Robert Harte of Leawood should not receive any monetary damages for the 2012 SWAT-style raid by deputies looking for a marijuana growing operation.

The Hartes contended that deputies lied to get a warrant to search their home.

Law enforcement targeted the home after Robert Harte and his children went to a hydroponics gardening store. Deputies then took loose tea leaves from their garbage. Deputies said the leaves registered positive for marijuana but they were never submitted to a lab for more definitive tests.

Attorneys for the Hartes say they will appeal.

LENEXA, Kan. (AP) — The Johnson County District Attorney says an off-duty police officer who shot and killed an armed man who was threatening customers at the Costco in Lenexa will not face any charges.

District Attorney Steve Howe said Wednesday that Kansas City, Kansas, police Capt. Michael Howell saved innocent lives during the confrontation on Nov. 26.

Ronald Hunt entered the store with a gun and was threatening to shoot customers. While store employees and customers were being evacuated, Howell identified himself as a police officer and told Hunt to drop the weapon.

Free FROSTFEST Holiday Craft Fun at the Hays Arts Council!

Join us this Saturday (Dec. 16) from 3 to 5pm for a children’s arts and crafts “open house” to be held in the Hays Arts Center Annex at 1010 Main St. – in honor of the creative & giving legacy of our friend JAN WALTERS.

Jan was an arts advocate, arts educator, and active member of the Hays Arts Council, especially during its earlier years – teaching summer youth arts classes, serving on Smoky Hill exhibition committees, and contributing to arts outreach experiences for students. Many of those were during her tenure as arts instructor for Kennedy Middle School, where she was an outstanding educator who nurtured and expanded the creative experiences and skills of her students.
Jan passed away in July and the HAC was honored to be the recipient of generous memorial gifts in her name. We think she would appreciate our using some of those funds for this holiday family arts and crafts open house.

We will have hot cocoa, candy canes and 4 different (easy!) craft stations…all before the downtown prize giveaway & Frostfest Parade. So, come join us if you’re out & about!

Kansas Tyson plant fined for accident that injured 2 workers

First responders on the scene in South Hutchinson during the June accident

RENO COUNTY — An accident at the South Hutchinson Tyson plant in June has resulted in more than $117,000 in fines. OSHA cited six serious violations and two repeat violations
related to the June 8 incident. Ammonia was released and injured two contract workers, one critically.

The fines levied Dec. 5 show that Tyson failed to provide and construct proper exit routes for employees in case of an emergency, failed to provide safety management for hazardous materials and failed to have proper emergency action plans in place. Tyson will have until Dec. 27 to correct the violations.

In 2013, Tyson agreed to pay a $3,950,000 civil penalty to settle alleged violations of Clean-Air Act regulations covering the prevention of chemical accidents at its facilities, including the plants in Hutchinson and South Hutchinson.

In October of 2006, an employee died while working on the plant’s refrigeration system. Fifty-one-year-old Michael Wiehe died after a pipe rupture and released a toxic cloud of ammonia. That accident also injured a co-worker. Federal investigators found that the pipe fitting that split while the two were trying to drain anhydrous ammonia from refrigeration equipment was responsible for the death. OSHA noted that the men weren’t using protective gear required by federal regulations.
