Panel Backs KanCare Renewal Plan; Opponents Hope To Block Implementation

Rep. Dan Hawkins, left, a Wichita Republican, and other GOP legislators on an oversight committee this week approved the Brownback administration’s proposal to seek renewal of its privatized Medicaid program for five years.

Republican legislators have temporarily sidetracked an effort to block the Brownback administration from obtaining federal approval to renew KanCare, the state’s privatized Medicaid program.

Democrats on a joint committee that oversees KanCare wanted the panel’s report to the full Legislature to recommend keeping the current program in place until a newly elected governor takes office in January 2019.

“If we are to extend KanCare by five years, which is what this does, we are going to take this right through the entire first term of the next administration,” said Sen. Laura Kelly, from Topeka, the top Democrat on the oversight committee. “I’m not comfortable as a legislator doing that.”

In addition to the timing issue, advocates and some lawmakers are concerned about several provisions in the administration’s KanCare 2.0 plan, including work requirements and lifetime caps on services for some beneficiaries.

But with two Democrats and a moderate Republican who has been critical of KanCare absent at the time of this week’s vote, Kelly had no chance of prevailing. So Sen. Vicki Schmidt, a moderate Republican from Topeka and chairwoman of the committee, suggested that the panel take no position.

That didn’t sit well with conservative Republicans who wanted to go on record in support of the administration, specifically Lt. Gov. Jeff Colyer, who will take the reins of state government if and when the U.S. Senate confirms Gov. Sam Brownback’s nomination to a State Department post.

Colyer, a physician, is the architect of KanCare, which in 2013 transferred the health care of more than 400,000 low-income, elderly and disabled Kansans to three for-profit managed care organizations.

“I think we’ve got to move forward,” said Rep. Dan Hawkins, a Wichita Republican, in making a motion to back the administration’s plan to implement KanCare 2.0 by Jan. 1, 2019.

Members approved the motion on a voice vote. But representatives of advocacy groups opposed to “doubling down” on a KanCare program that they say continues to be plagued by administrative and service delivery problems blamed the outcome on timing.

“Had that vote taken place when everybody was here, his motion fails,” said Tim Graham, associate director of InterHab, a nonprofit organization that represents providers of community services to Kansans with developmental disabilities.

Opponents will continue their efforts to block or delay implementation, Graham said.

“This is a non-binding recommendation,” he said. “We need to take the conversation into the Legislature as a whole.”

Opponents hope to use the departure of several top officials at the Kansas Department of Health and Environment, the state’s lead Medicaid agency, to bolster their case for delaying a decision on renewing KanCare until a newly elected administration takes office.

The Tigers (6-2, 2-0 MIAA) used an 18-4 first half run to overcome an early 12-point deficit. Down eight early in the second half, Gillum and Werth combined to score 12 points in a 14-2 run that put FHSU up 52-50 with 12:44 to play.

Judge: Kan. officials in contempt over records request on alleged cop killer

Jamaal Lewis- photo KCK police

KANSAS CITY, Kan. (AP) — A judge says he will find officials at Larned State Hospital in contempt for not turning over records on the man charged with the murder of a Kansas police officer.

Wyandotte County District Judge Wes Griffin said Friday the hospital has not responded to repeated record requests on Jamaal Lewis. He is charged with capital murder in the death of Kansas City, Kansas, police Capt. Robert Melton.

Griffin says mental health experts need them to determine competency for trial, and requests from prosecutors and defense attorneys have not been met.

Griffin says he is reluctant to enter a contempt order and would wait until Monday to send the notice.

Melton was killed last year while attempting to stop a suspect in a drive-by shooting.

Graham’s 35 carries No. 2 Kansas past Syracuse

MIAMI (AP) — Devonte’ Graham matched his career-high with 35 points for the second consecutive game, Lagerald Vick added 20 and No. 2 Kansas remained unbeaten by topping Syracuse 76-60 in the HoopHall Miami Invitational on Saturday night.

Graham shot 10 for 17 from the field and 7 for 13 from 3-point range for Kansas (7-0), which is off to its best start in seven years. Graham missed his first three tries from beyond the arc, then made seven of his next eight.

Svi Mykhailuk added 11 points for the Jayhawks, who shot 49 percent.

Tyus Battle scored 22 points for Syracuse (6-1), which was playing away from the Carrier Dome for the first time this season. Frank Howard scored 15 and Oshae Brissett had 13 for Syracuse.

The Orange trailed by 21 early in the second half before a 16-2 run over 2 1/2 minutes got Syracuse within 49-42, with Battle and Howard combining for 14 points during that stretch.

Graham connected on a deep straightaway 3 to end that Orange flurry, and Syracuse went cold quickly. The Orange managed only five points in the next 6 minutes, and Kansas rebuilt a 17-point lead on a dunk by Vick with 7:39 left.

The Orange didn’t get closer than nine again, and finished shooting only 32 percent.

BIG PICTURE

Syracuse: As of now, this may be the only game Syracuse plays against a ranked opponent until facing Notre Dame on Jan. 6. None of the next eight opponents on the Orange schedule are currently in the AP Top 25, nor were any of their first six. … Miami coach Jim Larranaga, whose Hurricanes played in the second game Saturday night, spent some time watching Syracuse-Kansas — from behind the Syracuse bench.

Kansas: Graham had 60 points in Kansas’ first five games; he’s got 70 in his last two. … It’s still an unbeaten season for Jayhawk basketball — not only is the men’s team perfect so far, but Kansas’ women’s team is off to a 6-0 start. … Kansas is 3-3 against Syracuse all-time, and snapped a two-game slide against the Orange — one that included a loss in the 2003 NCAA championship game.

WAITERS WATCHES

Miami Heat guard Dion Waiters had a rare chance to see his beloved Orange — he played for Syracuse from 2010 through 2012 — in person, sitting courtside with Heat managing general partner Micky Arison and president Pat Riley. He said he expected Kansas to be surprised by the quality of Syracuse’s famed 2-3 zone. “That zone’s for real,” Waiters said, quickly adding that he led the Big East in steals thanks to that zone.

SUNSHINE STATERS

Syracuse will be in Florida at least three times this season — this game, plus Atlantic Coast Conference games at Florida State on Jan. 13 and Miami on Feb. 17. This was the third visit by Kansas to the Sunshine State in the last 20 years. The Jayhawks went to Florida in 2013-14, and won a tournament in Orlando the following season. Kansas hadn’t played in Miami since 1990.

Kennett’s fifth 3-pointer near the end of the third quarter put the Tigers (7-0, 2-0 MIAA) ahead for good at 54-51. Carly Heim hit a three to push the lead to eight and FHSU hit seven of their eight free throws in the fourth quarter to hold off the Gorillas.

Kansas wind industry fights against tax-credit reversal

TOPEKA, Kan. (AP) — Wind industry executives are pressing Gov. Sam Brownback to lobby Kansas’ congressional delegation in opposition to a cut to a federal tax credit that could threaten $1.5 billion in planned projects across the state.

A provision weakening the production tax credit was incorporated into the U.S. House bill endorsed by all four Kansas representatives. But executives of seven wind energy companies asked Brownback and Lt. Gov. Jeff Colyer to encourage Republican U.S. Sens. Pat Roberts and Jerry Moran to keep changes to the tax credit out of the Senate’s bill and the final legislation.

Wind officials say the tax credit is originally scheduled to be phased out in 2020 based on a 2015 agreement approved by Congress. The House bill gets rid of that agreement.

No. 8 Wichita State tops No. 16 Baylor

WACO, Texas (AP) — Conner Frankamp scored 17 points and No. 8 Wichita State closed the game on a 7-0 run to beat No. 16 Baylor 69-62 on Saturday, ending the Bears’ 46-game nonconference home winning streak.

The Shockers (6-1) shot 63 percent (10-for-16) from 3-point range, with Frankamp’s 5-for-8 from beyond the arc leading the way. It was the senior’s 3-pointer from the right corner with 2:50 remaining that began Wichita State’s decisive run, and the Shockers were 4-for-5 from the free throw line in the final 1:38.

Shaquille Morris added 15 points for Wichita State, which also received 11 apiece from Landry Shamet and Darral Willis Jr. Shamet also controlled the flow of the offense with seven assists and one turnover.

Manu Lecomte scored 12 of his 15 points in the first half for Baylor (5-2), and Jo Lual-Acuil Jr. overcame a scoreless first half to finish with 13 points before fouling out in the final 30 seconds. King McClure scored 12.

Neither team led by more than seven, but the Shockers never trailed after a pair of Shamet 3-pointers put them up 33-29 at halftime. Baylor got within two three times before tying the score with 3:10 to go on a three-point play by Jake Lindsey.

Baylor started the week undefeated, but lost twice to Top 25 teams. The Bears were down to seven scholarship players after their top reserve, senior forward Terry Maston, broke his shooting hand in their 76-63 loss at No. 21 Xavier on Tuesday night.

BIG PICTURE

Wichita State: The Shockers are the best team in the country on the road with a 42-6 mark over the past five seasons, and they showed that poise every time Baylor made a run. The Shockers only tried five 3-pointers in the second half, but Baylor had to respect that ability. That opened up holes in the Bears’ zone and allowed the Shockers to play inside-out.

Baylor: The Bears managed to stay in the game despite shots not falling much of the time. They shot 37 percent from the floor and 5-for-21 (24 percent) from 3-point range. Baylor held a 34-28 lead in points in the paint, 10-5 off turnovers and 12-8 on second chances, but Mark Vital’s eight points were the only real contribution the Bears had off the bench, other than Lindsey’s late three-point play.
