Judge upholds jury’s verdict for man who says Roundup weed killer caused cancer

SAN FRANCISCO (AP) – A Northern California judge has upheld a jury’s verdict finding Monsanto’s weed killer caused a groundskeeper’s cancer, but she slashed his $289 million award to $78 million.

Roundup, the Monsanto brand name pesticide built on the chemical glyphosate, is used on farm fields and on lawns and gardens.

San Francisco Superior Court Judge Suzanne Bolanos ruled Monday

A San Francisco jury’s August verdict included $250 million in punitive damages, which the judge said was too high. She reduced the punitive damages to $39 million, matching the jury’s underlying damage award.

Jurors found Monsanto purposely ignored warnings and evidence that its popular Roundup product caused DeWayne Johnson’s lymphoma.

In a tentative ruling on Oct. 11, Bolanos said she was considering wiping out the punitive damage award because there appeared to be no evidence presented at trial that Monsanto employees ignored evidence that the weed killer caused cancer.

 

School board member questions Oak Park project contract

The Hays USD 489 school board heard an update on the Oak Park building project Monday night. This included questions about the ownership of the property.

The district plans to buy the Oak Park Medical Plaza on 13th Street and remodel it for use by the Early Childhood program. The district has received a $1.47 million federal grant to remodel the building.

Board member Lance Bickle said he had received multiple communications about the ownership of the property.

The complex has five owners. Four of the owners have signed off on the contract with the district. HaysMed owns the largest portion of the property.

The fifth portion of the property is under contract for sale. The person who has the contract on the property and not the present owner signed the contract with the school district.

Bickle questioned this.

“To me that would be like me putting my house on the market and having it scheduled to close next year and the person that was going to do it goes ahead and sells it when they don’t even own it yet,” Bickle said.

Board attorney Bill Jeter said there would be a simultaneous closing on the property when the time came.

The current owner would sell their unit to the party who is under contract to buy the property, and then the new owner would sell the property to the school district.

“If it doesn’t, then we have an issue with title and it’s not going to happen,” Jeter said.

The board heard a timeline for the project at the meeting. The district approved $2 million in financing for the purchase of the building on Oct. 15. The district will pay back the lease-purchase agreement $216,000 per year for 10 years.

Because the lease-purchase agreement is more than $100,000 per year, a 30-day protest period is required. That protest period will end on Nov. 25. If a protest petition is signed by 5 percent or more of the school district voters, the issue would have to go to a public vote.

The district only has until the end of June to use the federal grant funds. If a protest is successful, the project would have to be scrapped because the public vote would delay the project to the point the district would not be able to complete the renovation by the deadline for the federal grant.

If the district passes the protest period hurdle, work on the renovations would begin in January, be finished in June and classes would start at the new building in August.

Tigers No. 7 in first NCAA Super Region 3 Rankings

INDIANAPOLIS – The NCAA released its first set of football super region rankings on Monday (Oct. 22). At the end of the regular season, the top seven teams in each of the four super regions will be selected for the NCAA Playoffs. Looking for an appearance in the playoffs for a second-straight year, Fort Hays State sits at No. 7 in the first release of the Super Region 3 rankings.

The Tigers are the top two-loss team in the Super Region, a group that also includes Harding (Ark.), Pittsburg State (Kan.), and Saginaw Valley State (Mich.). Harding advanced through the Super Region 3 bracket last year and reached the national semifinals before getting knocked out of the playoffs.

Ferris State (Mich.), the school FHSU lost to in the Super Region semifinals last year, holds the No. 1 ranking in the first release. The Bulldogs are a perfect 8-0 so far this year. Ouachita Baptist (Ark.) is also perfect on the season at 8-0 and holds the No. 2 ranking. Grand Valley State (Mich.), Northwest Missouri State, Indianapolis, and Southern Arkansas all have one loss, sitting in front of the Tigers in the rankings.

Fort Hays State (6-2) hosts Lindenwood (3-5) this Saturday in Hays at 2 pm.

Kansas woman jailed for stabbing woman in the neck

SEDGWICK COUNTY — Law enforcement authorities are investigating a stabbing and have a suspect in custody.

Just after 9:30 p.m. Sunday, police responded to an unknown call for EMS at the Relax Inn, 2232 S. Broadway in Wichita, according to officer Charley Davidson.

Upon arrival, Officers located a 25-year-old female with a laceration to her neck. Officers also found 26-year old Teka Pardue armed with a knife. She dropped the knife and was taken into custody without incident.

The investigation revealed Pardue and the victim got into a verbal argument, and Pardue stabbed the victim one time. EMS transported the victim to an area hospital in critical, according to Davidson.

Police arrested Pardue on charges of attempted 1st degree murder, aggravated weapons violation and possession of drug paraphernalia. The case will be presented to the District Attorney’s Office.

Perdue has a previous drug conviction in Harvey County, according to the Kansas Department of Corrections.

TMP-Marian boys soccer in Regional final after edging Rose Hill

HAYS, Kan. – The TMP-Marian boys soccer team advanced to their 4-3-2-1A Regional final with a 4-3 win over Rose Hill Monday at the Bickle-Schmidt Sports Complex. Ethan Lang’s goal early in the second half broke a 3-3 tie and proved to be the winner.

Ethan Brummer, Tanner Diehl and Zach Braun each scored first half goals for the Monarchs who improve to 7-7. They will now travel to Coffeyville to face top-seeded Field Kindley on Thursday at 6 p.m..

FHSU’s Brown named MIAA Special Teams Athlete of the Week for fourth time

KANSAS CITY, Mo. – Fort Hays State junior kicker/punter Dante Brown earned MIAA Football Special Teams Athlete of the Week for the fourth time this season on Monday following his great performance in the 29-26 double-overtime win at Nebraska-Kearney on Saturday. Brown matched his single-game school record of five field goals, booting through a pair in overtime to help lift FHSU to the road win.

Brown went a perfect 5-of-5 on his field goal attempts. Brown pushed his season field goal total to 20 and continues to lead NCAA Division II. In overtime, he converted a 34-yard field goal to give FHSU a 26-23 lead before UNK matched the field goal to extend the game to another overtime. After UNK missed a field goal on its possession in the second overtime, Brown nailed a 26-yard field goal for the win. He also made field goals from 47 and 46 yards in the fourth quarter, pushing the Tigers to a three-point lead each time. His other field goal was at the end of the second quarter from 22 yards. Brown also punted the ball seven times for an average of 37.7 yards per attempt, with a game long of 46 yards.

Brown has now won the Special Teams Athlete of the Week honor following Weeks 1, 4, 5, and 8 this year.

Joining Brown for the weekly honors from the conference are Central Oklahoma quarterback Will Collins and Pittsburg State running back Tucker Horak (Co-Offensive Athletes of the Week) and Pittsburg State defensive lineman Simanu’a Thomas (Defensive Athlete of the Week).

Kan. man jailed for alleged shoplifting, driving stolen vehicle

SALINE COUNTY — Law enforcement authorities are investigating a suspect for shoplifting and vehicle theft.

On October 19, Police were called to Walmart, 2900 S. Ninth in Salina for the report of a man who went through the self-checkout, paid for four packages of Kool-Aid, but concealed approximately $80 worth of other items that he took with him when he left the store, according Salina Police Captain Paul Forrester.

The items taken included charcoal, four arrows, a phone case, a Nerf toy and a blanket. Walmart loss-prevention personnel witnessed the incident, according to Forrester.

Store personnel told police that the man and a woman were seen getting into a gray PT Cruiser type of vehicle that traveled from the store and north on Interstate I35.

Shortly thereafter, a Salina police officer pulled over a gray Chevrolet HHR at I-135 and Magnolia. The vehicle was confirmed as stolen from Lyon County on Wednesday, according to Forrester.

The suspect identified as Jacob Vaughan, 20, Salina, from the Walmart shoplifting case and the woman seen with him earlier were in the HHR.

Police arrested Vaughan and charged him with one count of felony possession of stolen property, one count of misdemeanor attempted theft, and one count of driving while suspended, according to Forrester. Vaughan also had a probation violation warrant out of Lyon County.

2 charged in Kan. road-rage shooting that left 4-year-old wounded

WICHITA, Kan. (AP) — A man and woman have been charged in a road-rage shooting that wounded a 4-year-old boy in Wichita.

Nineteen-year-old Tylin Atkinson, and 21-year-old Ramonyka Smith, both of Wichita, were charged Monday with criminal discharge of a firearm. Atkinson also faces a charge of aggravated assault and is jailed on $250,000 bond. Smith is jailed on $100,000 bond. Their attorneys didn’t immediately return phone messages seeking comment.

Police say Atkinson got out of a car last week and fired two shots at a sport utility vehicle in which six children were riding, striking the 4-year-old once in the abdomen. Police say Smith was driving the car.

The child was in stable condition shortly after the shooting. Police didn’t immediately return phone calls Monday seeking an update on the boy’s condition.

Police: Kan. man stole car from jail parking lot immediately after release from jail

SHAWNEE COUNTY — Law enforcement authorities have made an arrest in connection with a stolen vehicle.

Just after 4pm Sunday a citizen noticed their vehicle was missing from the lot of the Shawnee County Department of Corrections (DOC) in Topeka, according to police Lt. Aaron Jones.

Review of the camera system a suspect was identified as 33 years-old Kevin E. Jones. He had just been released from the jail at approximately 9a.m., just prior to the theft of the vehicle.

Officers were then called to the 500 block of NE Grattan in Topeka for a report of a man attempting to break into a vehicle. The owner of the vehicle and neighbors kept the suspect on scene until the arrival of officers.

The responding officers recognized the suspect in this incident was Kevin Jones from the earlier reviewed surveillance footage.

The original stolen vehicle was then located by officers in the 700 Block of SW Taylor around 7:15 pm.

Jones was arrested under suspicion of motor vehicle theft and criminal damage. The damage to the vehicle on Grattan was estimated to be about $700, according to police.

AAA: October finally falling into cheaper gas prices

Average Kansas per gallon price down 5 cents in past week to $2.67

TOPEKA – Kansas is among more than 80 percent of states experiencing lower gas prices this week compared to last. The average price of a gallon of regular gasoline in Kansas is now $2.67, five cents lower than a week ago.

“After several weeks of unseasonably high or rising prices, Kansans are finally finding some relief at the pumps,” said AAA Kansas spokesman Shawn Steward. “Lower gasoline demand and stable supplies have contributed to the price decrease. The price decrease trend could certainly reverse itself with upcoming geopolitical issues, but for now, motorists can enjoy this welcome change of cheaper gas.”
Of the 10 Kansas cities regularly highlighted by AAA Kansas (see chart below), none saw gas prices increase this week. Prices stayed the same this week in Hays and Lawrence, while prices fell in the eight other communities. Wichita (-7 cents), Garden City (-6) and Kansas City, Kan. (-4) had the largest price declines.
“When we compare our gas prices to the rest of America, Kansas can almost always claim positive news, and that is true again this week,” AAA Kansas’ Steward said. “Our $2.67 average is 18 cents less than the national average, and Kansas currently has the 13th cheapest gas in the country.”
According to AAA Kansas, this week’s Kansas gas price extremes are:
HIGH: Potwin (Butler County) – $3.09
LOW: Hutchinson (Reno County) – $2.45
National Perspective
The national gas price average is $2.85. That is six-cents cheaper than this month’s highest price of $2.91, which was the most expensive average during the month of October since 2014. Today’s price is also four cents cheaper than last week, the same price as last month and 39- cent more than this time last year.
Reduced refinery runs, due to peak maintenance season, have contributed to stable gasoline inventories amid lower demand, which is a contributing factor driving gas prices down.
“Motorists across the country are seeing gas prices more than a dime cheaper than last week, with 41 states having less expensive state averages on the week,” said AAA Kansas’ Steward. “Prices are falling despite market concerns about global supply and geopolitical tensions, but that could change later this month ahead of the U.S. announcement of imposed sanctions on Iran.”

Woman critically wounded in Great Bend shooting, suspect in custody

BARTON COUNTY — Law enforcement authorities are investigating a suspect in connection with a weekend shooting.

Just before 5 a.m. October 20, officers from the Great Bend Police Department were dispatched to the 5900 block of Hemlock Dr. in reference to a shooting, according to a media release.

Upon officers arrival, they located a 33-year-old woman with a gunshot wound. Officers also found 36-year-old Troy Tutak at the scene.

After questioning about the incident, Police arrested Tutak and he was transported to the Barton County Jail.  The victim was transported to the hospital in Great Bend and she was later flown to a Wichita hospital with critical injuries.

Tutak was arrested on requested charges of aggravated battery with a bond set at $75,000. Tutak  also had a probation violation, according to police.

 

Jetmore man arrested on suspicion of rape after incident Sunday in Hays

A 21-year-old Jetmore man was arrested early Sunday in connection with an alleged sexual assault in Hays.

According to the Hays Police Department, Brennan G. Harms, 21, Jetmore, was arrested at 3:37 a.m. Sunday after the report of a sexual assault in the alley behind Chuck’s and On The Rocks Bar & Grill in the 500 block of West Seventh.

Lt. Brandon Wright said officers were called to the area to investigate a sexual assault at about 3:30 a.m.

Harms was located and arrested a short time later in the 300 block of West Eighth on suspicion of rape.

He made his first appearance in Ellis County District Court on Monday.
