Suspects in fatal Kan. drug sale gunfight bound over for trial

HUTCHINSON — Two men accused of murder for the shooting death of a Hutchinson man on June 26 have been bound over for trial.

Eighteen-year-old Tristan Delaney and 26-year-old Curtis Garcia are accused of being involved with the killing of 18-year-old Norman Cushinberry. He had multiple gunshot wounds and his leg may have been run over with a green pickup.

The theory for the crime involves Delaney and Cushinberry purchasing drugs. According to court testimony, Delaney and Garcia had been texting the day of the shooting about the purchase of around a quarter pound of marijuana.

There is also some indication over phony money being involved. Garcia claims he was there to sell an Xbox and not drugs.

Police found Cushinberry in the street suffering from gunshot wounds to his upper chest, on his side around the rib cage, and around his upper arm. Efforts to revive him were unsuccessful.

According to testimony, Delaney came out of a home in the 500 block of Washington with a shotgun. That gun was later found near Cushinberry.

Because of the dispute between the two suspects, it’s likely they will be tried separately.

Both will be arraigned before separate judges in separate Reno County courtrooms on Monday December 3.

Kansas teen jailed for alleged weekend armed robbery

SEDGWICK COUNTY Law enforcement authorities are investigating an armed robbery and have a suspect in custody.

Just after 2a.m. Saturday, police responded to an armed robbery call at a convenience store in the 700 Block of West 29th Street North, according to officer Charley Davidson.  A 23-year-old f employee told police a suspect later identified as 18-year-old Ivan Vasquez entered the business, pointed a handgun at her and demanded money.  Vasquez took the cash and fled on foot.

On Saturday evening, investigators located and arrested Vasquez. He was booked into the Sedgwick County Jail for aggravated robbery, possession of marijuana and obstruction, according to Davidson.

Investigators are working to determine if this Vasquez is also responsible for other armed robberies in the area.  Police will present the case of Saturday’s robbery to the district attorney later this week, according to Davidson.

Police: 74-year-old Kan. woman fatally shoots possible burglar

LEAVENWORTH, Kan. (AP) — Leavenworth police say a 74-year-old woman fatally shot a man who she thought was trying to burglarize her home.

Byrd has previous convictions for burglary and drugs, according to the Kan. Dept. of Corrections

Police Chief Pat Kitchens says when officers responded to the woman’s call early Saturday they found the 41-year-old suspect, Ralph Byrd Jr., of Leavenworth suffering from a gunshot wound.

Byrd was pronounced dead at the scene.

Kitchens says the woman suffered a “medical event” after the shooting and was taken to a hospital but was expected to survive.

Kitchens says the focus of the investigation will be to determine if Byrd was committing a burglary when he was shot.

Delores E. Rous

Delores E. Rous died November 25, 2018, at Woodhaven Care Center, Ellinwood. She was born August 14, 1934, in Cootie’s Bluff, Oklahoma, the daughter of William Victor “W.V.” and Goldia Ula (Adamson) Coker. Delores was in the 1952 class of Claflin High School.

She was a lifetime resident of Claflin, until moving to Great Bend in 2010 and later to Ellinwood in 2014.

On January 16, 1953, she married Lester D. Shaw in Great Bend. He preceded her in death on July 15, 1983. She then married Clarence Rous on April 30, 1989, in Claflin. He preceded her in death on September 27, 2009.

Survivors include; son, Kirby Shaw and wife Paula of Bison; daughter, Vicky Webb of Ellinwood; step sons, Vernon Rous of Hays, Steven Rous and wife Linda of Fairmont, Oklahoma, Sheldon Rous and Bennie of Claflin, and Calvin Rous and wife Terri of Hoisington; step daughters, Kathy Kirmer and husband Alan of Claflin, Kayleen Gaddis and husband Mike of Claflin; 10 grandchildren; 12 step grandchildren; and numerous great grandchildren.

She was preceded in death by her parents, husbands, daughter, Debra Kay Shaw and son, Mickey Ray Shaw, brother, Kenneth Coker, and sisters, Betty Straub, Shirley Foos, and Gene Simmons.

Funeral service will be 2:30 p.m. Wednesday, Nov. 28, 2018, at Nicholson-Ricke Funeral Home. Burial will follow in Claflin Cemetery. Family receive friends Tuesday, Nov. 27, from 6 to 8 p.m.

Kansas teen hospitalized in Russell after car rolls

ELLSWORTH COUNTY — One person was injured in an accident just after 11 a.m. Monday in Ellsworth County.

The Kansas Highway Patrol reported a 2002 Chevy Impala driven by Summer R. Reece, 18, Derby, was westbound on Interstate 70 one mile northeast of Wilson.

The driver lost control of the vehicle. It traveled off the right side of the roadway, entered the north ditch and rolled.

Reece was transported to the hospital in Russell. She was properly restrained at the time of the accident, according to the KHP.

Kansas Supreme Court refuses to hear Oborny’s case on Field will

The Kansas Supreme Court on Wednesday denied a petition to review the case of a former Hays bookkeeper who was seeking millions from her former employer’s estate.

The bulk of the estate of Earl O. Field instead will go to the Fort Hays State University Foundation to be used for scholarships.

Wanda Oborny alleges Field, her employer, signed a codicil to his will shortly before his death in 2013, leaving half of his $20 million estate to her with a quarter of the estate going to Fort Hays State University and the rest going to Field’s attorney, Joseph Jeter.

Oborny alleged 98-year-old Field went to a local car dealer to have the codicil of his will witnessed by two of Oborny’s longtime friends, Steve and Kathy Little.

The Littles died in a murder/suicide after they were visited by federal agents and received federal grand jury subpoenas. However, their deaths were never definitively linked to the Field will case.

A district court ruled Oborny or someone on her request forged the codicil to the will. Oborny appealed. The appellate court ruled against her in February, and she appealed to the Kansas Supreme Court.

The FHSU Foundation has been fighting Oborny’s claim to the estate for years. Attorney for the FHSU Foundation Coy Martin said a portion of the funds from the estate were released to the university after the district court trial. However, the Kansas Supreme Court’s decision should allow the rest of the estate to be processed and the rest of the university’s portion to be released.

Oborny also faces felony charges in federal court stemming from the codicil.

Oborny is set for trial at 9 a.m. Feb. 19 in U.S. District Court in Wichita.

Dennis P. Woods

Dennis P. Woods, age 69, passed away on Sunday, November 25, 2018 at his home in Scott City, Kansas.

He was born on February 7, 1949, in Garden City, Kansas, the son of George Andrew and Thelma Lucille Coleman Woods. A resident of Scott City since 1987 moving from Garden City, he was a paint contractor.

He was a U.S. Army veteran of the Vietnam War.

On October 13, 1968, he married Linda Sue Loper in Garden City. She survives.

He was preceded in death by his parents, two brothers — Darrell Woods, Manley Woods — and one granddaughter, Shelby Woods.

Funeral services will be held at 2:00 p.m. Thursday, November 29, 2018, at Price & Sons Funeral Home in Scott City with Rev. Don Williams presiding.

Burial will be in the Scott County Cemetery in Scott City.

Memorials in lieu of flowers may be given to the Dennis P. Woods Memorial Fund in care of Price & Sons Funeral Homes.

Visitation will be from 2:00 p.m. until 8:00 p.m Tuesday and 10:00 a.m. until 8:00 p.m. Wednesday at Price & Sons Funeral Home in Scott City.

Tigers face Buccaneers in national soccer semifinal Thursday

The No. 11 ranked Fort Hays State men’s soccer team gets set for the NCAA Division II Men’s Soccer Championships this week with a matchup against No. 20 ranked Barry University on Thursday morning. The Tigers enter at 17-2-1 overall, while the Buccaneers enters the contest at 15-4-2. Kickoff is set to commence at 10 a.m. CT (11 a.m. ET) inside Highmark Stadium in Pittsburgh, Pa.

Fort Hays State enters the match riding a 14-match winning streak and a 15-match unbeaten slate. The Tigers won their second-consecutive MIAA championship in 2018 after finishing the regular season conference schedule an impressive 8-0. It was the first perfect record in the MIAA’s history (since 2012). The Tigers earned a spot among the final four teams after defeating Ohio Valley 2-0 in the national quarterfinal match. Fort Hays State earned its fourth central region championship within five years after defeating No. 19 ranked Northeastern State, 3-0.

Barry made its way to the national semifinal by upsetting No. 10 ranked Spring Hill College in the South Region Semifinal, 4-1. They then picked up another upset victory, this time over No. 24 ranked Lynn University in the South Region Championship. The Buccaneers and Fighting Knights were scoreless at the end of regulation and both overtime periods, before Barry defeated Lynn 4-2 in penalty kicks. In the National Quarterfinal against No. 8 ranked Lander University, the Buccaneers held off the Bearcats 2-1 to earn their third trip as one of the final four teams in team history.

Royals claim right-hander Greene off waivers from Cardinals

KANSAS CITY, Mo. (AP) – The Royals claimed Conner Greene off waivers from the St. Louis Cardinals and designated fellow right-hander Burch Smith for assignment on Monday.

The 23-year-old Greene spent last season at Double-A Springfield and Triple-A Memphis, going 4-5 with a 4.09 ERA in 40 appearances. He also made nine relief appearances for Surprise in the Arizona Fall League, where the Royals got a close look at him.

Smith was acquired during last year’s winter meeting draft. He went 1-6 with a 6.92 ERA in 38 games for Kansas City, making six starts in spot duty last season
