District Attorney Keith Schroeder has confirmed that he filed a motion to prosecute the 14-year-old alleged to have set a fire that killed his mother and sister

as an adult, but so far no date has been set for any hearing.
Sam Vonachen is accused of two counts of first degree murder. The fire killed his mother and 11 year old sister. He’s also charged with attempted murder of his father and aggravated arson for allegedly setting the family home on fire.
Schroeder says in his motion that the teen confessed to planning and executing his mother and sister and the attempt on his father. The motion goes on to say that he designed the fire to trap them in the upstairs bedrooms and poured gas throughout the downstairs twice to “do a thorough job.” He allegedly waited until they were in bed before pouring the gas in the doorways and stairway to block their escape.
Schroeder says in his motion, if he had been four years older, he would qualify for the death penalty.
Schroeder told us Wednesday that the judge has three options. Judge Patty Macke-Dick can deny the states motion, which means if she finds him guilty, the court would have jurisdiction over him till age 18, however she can also decide on an extended jurisdiction which gives the court jurisdiction over him till he turns 23.
If the case goes to adult court and he’s convicted, Schroeder says he would be placed in a juvenile facility within the Kansas Department of Corrections until he turns 18, then would go into the regular adult prison population.
