HUTCHINSON — The jury found a Mulvane-area man not guilty of rape or the alternate count of attempted rape, but did find Jodie Mosier “guilty” of aggravated sexual battery.
The jury got the case against Mosier approximately 11:20 a.m. Thursday and had a verdict at approximately 4:40 p.m.
He had been accused of raping or attempting to rape the victim, committing a sexual battery and taking pictures of the victim when she should have had the expectation of privacy. These alleged crimes occurring on the 32-year-old at M&M Point at Cheney Lake on May 30, 2010.
The defense argued the alleged victim didn’t report the incidents when they occurred and only did after it was clear that her mother and the defendant were going to get a divorce. They also argued there was no proof who took the pictures of the victim. The state had argued it was Mosier, because it matches the phone he had at the time, a Blackberry 95-30 and the pictures had been loaded to his computer two days after the alleged incident.
The pictures were found by Wichita Police while investigating similar allegations in that city.
Sentencing in Reno County is set for Feb. 7. Mosier was taken into custody on a $50,000 bond.
He also faces criminal charges involving the same victim and her daughter for allegations involving rape and inappropriate touching of a small child in Sedgwick County.
