A plea agreement was reached Wednesday afternoon in Ellis County District Court in the case of a man who shot a Kansas Highway Patrol trooper during a traffic stop on January 29, 2011 in southeast Hays.
Using an interpreter, Ruben Herrera Escobedo pleaded no contest to Aggravated Battery on a Law Enforcement Officer and Aggravated Assault of a Law Enforcement Officer in the shooting of Trooper Doug Schulte.
After reviewing an affidavit and the DVD recording from Schulte’s patrol car camera, District Judge Glenn Braun accepted the plea and found Escobedo guilty.
The affidavit says Schulte stopped Escobedo for speeding and running a stop sign. Escobedo got out of his truck despite being told not to and shot at Schulte three times, hitting him once.
Schulte has recovered and was in the courtroom for Wednesday’s proceedings.
Under the plea the state is asking for a sentence of six years. The court will determine the sentence at a later date. Escobedo is not a U.S. citizen, and the conviction will result in deportation.
