Kansas man accused of 4-year-old granddaughter’s murder

SILVER LAKE, Kan. (AP) — A northeast Kansas man has been charged with first-degree murder in the death of his 4-year-old granddaughter.

Shawnee County District Attorney Mike Kagay announced Thursday that 56-year-old Timothy Wayne Funk Sr., of Silver Lake, was charged in the July death of Brandy Funk. He is also charged with two counts of aggravated endangering a child.

Brandy, of Beatrice, Nebraska, died July 23 at a Silver Lake home.

Authorities did not release any further information Thursday.

Funk remains jailed in Shawnee County Jail Thursday afternoon on $500,000 bond.

Funk was discharged from state prison in August 2012 after serving time for driving under the influence, fourth or subsequent offense in June 2008.

NTSB: Loss of control blamed for fatal Kansas plane crash

TOPEKA, Kan. (AP) — Investigators say loss of control resulted in the 2017 crash that killed a Topeka physician.

The National Transportation Safety Board posted on its website that investigators had found “no mechanical anomalies.”

Topeka pulmonary physician William M. Leeds and his flight instructor, James K. Bergman, were killed in July 2017 at Topeka’s Philip Billard Municipal Airport.

The NTSB determined the accident’s probable cause to be “the failure of the pilot and flight instructor to maintain aircraft control while maneuvering in the traffic pattern.”

It reached no conclusions as to why control of the 1965 Piper PA-30 fixed wing, multi-engine was lost.

TOPEKA — A Kansas felon identified by the Kansas Highway Patrol as Brandon K. Jordan, 48, Topeka, driving a 2003 Acura TL linked to a bad-check cashing case caused a deadly crash while trying to get away from a Kansas Highway Patrol trooper Thursday afternoon.

The chase westbound on Holly Lane lasted only a couple seconds just, according to the KHP.
Jordan ran a stop sign and crashed into a 2016 Ford Explorer driven by Dennis E. Affolter, 69, Topeka. EMS transported Affolter to Stormont Vail where he died.

Jordan is felon with 19 convictions that include forgery, burglary, theft, obstruction and for drugs, according to the Kansas Department of Corrections. He will be booked into jail on new charges when he is released from the hospital.

TOPEKA, Kan. (AP) — Authorities say a man driving a car linked to a bad-check cashing case has caused a deadly Topeka crash while trying to get away from a Kansas Highway Patrol trooper.

Patrol Lt. Adam Winters says the chase lasted only a couple seconds Thursday before the fleeing driver ran a stop sign and crashed into a sport utility vehicle in the western part of the city.

The SUV’s driver was rushed to a hospital and later died. The driver’s name wasn’t immediately released.

The patrol says the driver of the fleeing car will be booked into jail when he is released from the hospital. A passenger in the fleeing motorist’s car also was injured. Neither of their injuries were believed to be life-threatening.  Late Friday morning, the KHP had not released names of those involved in the crash.

SHAWNEE COUNTY— Law enforcement authorities are investigating a fatal crash that occurred just before 12:30p.m. Thursday during a high-speed chase in Shawnee County.

The Kansas Highway Patrol reported a vehicle was westbound on Holly Lane traveling at a high rate of speed fleeing from law enforcement.

The driver failed to stop at McAlister Avenue and struck a vehicle which was southbound on McAllister.

Authorities have not released names of the individual involved in the accident.

Troopers find hundreds of packages of THC products in man’s car

CUSTER COUNTY, NE —Law enforcement authorities are investigating a suspect on numerous charges after a traffic stop.

Just after 5p.m. Wednesday, a trooper observed a Saab sedan speeding near the intersection of Victoria Springs Road and Drive 443, approximately 10 miles west of Sargent, Nebraska, according to a media release.

During the traffic stop, a K9 from the Custer Count Sheriff’s Office detected the presence of a controlled substance in the vehicle.

The trooper searched the vehicle and found hundreds of containers of THC products, along with four pounds of marijuana. The search revealed 386 containers of THC wax, 144 packages of THC shatter, 62 THC vape cartridges, and 39 containers of THC edibles and liquid products.

Troopers arrested the driver, Anthony Kolbe, 30, of Sleepy Eye, Minnesota, on requested charges of possession of a controlled substance, possession of marijuana – more than one pound, possession with intent to distribute, and possession of drug paraphernalia. Kolbe is being held in Custer County Jail.

Police investigate shooting near the K-State campus

MANHATTAN, KAN. – Law enforcement authorities are investigating a shooting in Manhattan that sent one man to the hospital

Just before 2:15p.m. Friday, the Riley County Police Department Emergency Dispatch Center received multiple 911 calls from citizens reporting hearing the sound of gunshots in the 1400 block of Hartman Place in Manhattan.

Officers quickly responded and found one male victim suffering from what appears to be a non-life-threatening gunshot wound.

Officers were still on scene. Police have not reported an arrest.

Police ask for help to locate Kan. felon wanted for attempted murder

SEDGWICK COUNTY —Law enforcement authorities are asking the public for help to locate a wanted Kansas felon. Tyreese L. Atkinson, 25, Wichita, is wanted on two Sedgwick County sheriff’s warrants for attempted second-degree murder, aggravated battery, felon in possession of a firearm, possession of marijuana and evade and elude police, according to a media release from Wichita Police

Atkinson is described as 6-foot-2 inches tall, 215 pounds with brown eyes, balding and a beard. He has previous convictions for burglary and theft, according to the Kansas Department of Corrections.

He is a documented gang member and should be considered armed and dangerous. Anyone with information on Atkinson should call 911, according to police.

Kansas family reported furnace problem before home explosion

MCPHERSON COUNTY – An explosion at a home in rural McPherson County was the result of a propane leak, according to Captain Dean Scott with the McPherson County Sheriff’s Office.

The explosion occurred just after 5 p.m. Wednesday at a residence in the 1600 block of 24th Avenue northeast of Galva.

When fire crews arrived, they found the home completely leveled and debris scattered over several hundred yards, according to the State Fire Marshal’s office.

The two residents Kim and Rich Carlson were not home at the time of the explosion. The home is a total loss. The family also lost three dogs, cats and a pet pig.

The homeowner had reported smelling propane the day of the incident and had a company check the furnace, according to Scott.

Kan. man dies after crash with with a semi attempting U-turn

RENO COUNTY — One person died in an accident just after 2 a.m. Friday in Reno County.

The Kansas Highway Patrol reported a 1999 Buick Century driven by Melvin G. Uphoff, 72, Hutchinson, was traveling southwest on Kansas 61 six miles west of south Hutchinson.

The vehicle stuck a 2014 International Prostar driven by Jose Cota-Espinoza, 46, Mexicali, Mexico that became stuck when the driver missed an exit and attempted to make a U-turn and blocked both lanes of the highway.

Uphoff was pronounced dead at the scene and was transported to the Sedgwick County Forensics Center. Cota-Espiniza was not injured. Neither driver was wearing a seat belt, according to the KHP.

Court documents: Kansas toddler died of blunt force trauma

WICHITA, Kan. (AP) — Court documents say the cause of death for a bruise-covered 2-year-old Wichita boy is blunt force trauma.

The probable cause affidavit was released Thursday in the case against the boy’s mother, 24-year-old Stephanie Aviles, and her boyfriend, 31-year-old Bernardo Gonzalez-Mejia. They’re charged with first-degree murder in the Sept. 29 death of Jacob Aviles.

Stephanie Aviles told police that Gonzalez-Mejia called her while she was out, first to tell her the boy wasn’t breathing and then to say he was turning yellow. She called 911. She said her son had been hurt before while with Gonzalez-Mejia, but that he would “explain it away.”

The affidavit says Gonzalez-Mejia initially denied injuring Jacob but then admitted that he hit the boy with a belt the night before because he wasn’t eating.

Alternative meats, markets on KLA convention program

TOPEKA – Featured presentations about the cattle markets, how the industry is using its resources to position beef as the optimal choice over plant proteins and the continual progress being made on beef sustainability will highlight the educational program at the Kansas Livestock Association (KLA) Convention. The three-day event will be held December 4-6 at the Wichita Hyatt and Century II Convention Center.

CattleFax Chief Executive Officer Randy Blach will offer perspective on the cattle and beef markets during Beef Industry University (BIU), sponsored by the Farm Credit Associations of Kansas. As the industry waits for one of the largest beef processing facilities, the Tyson plant in Holcomb, to come back on-line after the fire in early August, Blach will discuss packing capacity and what that means for future growth in the cattle business. He will assess where the industry stands with herd expansion and what that means for beef supplies in 2020. Blach’s outlook for the year ahead will consider grain prices, energy costs, the macroeconomy, beef exports and consumer demand for beef and its competitors.

The Industry Information Session, sponsored by Elanco Animal Health, will feature two speakers discussing how the industry is positioning beef as plant-based protein options gain notoriety. This involves separate, but closely coordinated efforts between both the checkoff and policy divisions of the National Cattlemen’s Beef Association (NCBA). From the checkoff perspective, NCBA Senior Vice President of Global Marketing Alisa Harrison will outline how checkoff dollars are being used to highlight the taste and nutritional advantages of beef. High-level digital strategies and paid advertising on social media platforms are among the ways this is being accomplished.

In addition, Kansas Beef Council staff will share a video featured in the upcoming in-state checkoff campaign titled “One Simple Ingredient.” The message, targeted at millennials and Generation Z consumers, provides positive differentiation for beef from meat substitutes. The policy side of the fake meat issue will be presented by NCBA Vice President of Government Affairs Ethan Lane. He will outline how NCBA staff in Washington, D.C., is working to ensure all protein sources, including the plant-based varieties and cell-cultured options of the future, are produced and marketed under the same food safety and labeling standards as animal-based proteins.

The Consumer Trends Forum, hosted by the Kansas Beef Council and Kansas CattleWomen and sponsored by the Kansas Soybean Commission, will feature Elanco Animal Health Technical Consultant in Sustainability Sara Place. She will highlight how the cattle industry has reduced its environmental footprint in recent years. In her previous role as NCBA senior director of sustainable beef production research, Place oversaw the checkoff-funded life cycle assessment used to benchmark the sustainability of the U.S. beef industry. She has been interviewed on the subject by many major media outlets and has spoken on high-profile panels targeted at the consuming public.

An individual who takes his humor seriously will entertain the crowd at the Cattlemen’s Banquet, sponsored by INTRUST Bank and Tyson. Devin Henderson helps people use humor to perform at their best in the workplace. He will show livestock producers how humor can help them deal with change, stress, failure and difficult people. Henderson’s presentation is sponsored by Micro Technologies and Zoetis.

KLA members will review existing policy and consider new resolutions during committee and council meetings at the convention. Among policy issues expected to be discussed are proper labeling of meat alternatives to better inform consumers, continued efforts to preserve and enhance the lesser prairie chicken population, trichomoniasis and the CattleTrace project. Final policy consideration will come during the general KLA membership meeting at the end of the convention.

The KLA Trade Show will feature livestock products and services on display for producers, as well as being the site for many social events and meals at the convention. A barn party will close out the trade show schedule, with entertainment by the Jared Daniels Band. The band’s appearance is sponsored by Merck Animal Health and Kansas Feeds.

State fire marshal identifies two victims in fatal SW Kan. fire

KEARNY COUNTY – The Kansas Office of the State Fire Marshal’s Investigation Division has classified a fatal fire in rural Kearny County, south of Deerfield, Kan., that occurred early Tuesday morning as undetermined, according to Jill Bronaugh with the state fire marshal’s office.

The Kearny County Sheriff’s Office and local fire department asked the OSFM investigators for assistance with the  house fire at 2102 Road 150 that left two individuals dead. Two others were able to escape.

The fire originated in the garage. The two fatality victims have been identified as Jim Dale, 84, and Reta Dale, 84, both occupants of the house. Two other occupants escaped — one with very minor injuries and the other uninjured.

There were operating smoke detectors within the residence. Damages are estimated at $150,000.

Police arrest Kan. teen for social media dispute killing of 15-year old

SEDGWICK COUNTY — Law enforcement authorities are investigating a fatal shooting and have made an arrest.

Just after 6p.m. Wednesday, police responded to report of a shooting in the 1400 Block of North Ohio Street in Wichita, according to Captain Brent Allred.

At the scene, police located a 15-year-old later identified as Marion Wheaton who had been shot in his upper body. EMS transported him to a local hospital where he died.

On Thursday evening police reported the arrest of 18-year-old Malick Garrett of Wichita on a requested charge of 2nd degree murder and outstanding warrants in connection with Wheaton’s death.

Investigators have learned that Wheaton and two teenage friends walked to the area to meet with a 15-year-old boy and other unknown individuals to fight over an ongoing dispute that involved social media, according to Allred.

As Wheaton and his friends walked in the area, they were approached by a vehicle.  A 15-year-old male and Garrett exited the vehicle.  Garrett fired multiple shots from a handgun, striking Wheaton.

This was not a random incident, according to Allred. Multiple handguns were recovered during the investigation.

It is the 24th criminal homicide in Wichita in 2019.

Just after 6p.m. Wednesday, police responded to report of a shooting in the 1400 Block of North Ohio Street in Wichita, according to Captain Brent Allred. At the scene, police located a 15-year-old later identified as Marion Wheaton who had been shot in his upper body. EMS transported him to a local hospital where he died.

As Wheaton and his friends walked in the area, they were approached by a vehicle. A 15-year-old boy and unknown individuals exited the vehicle and shots were fired striking Wheaton.

This was not a random incident, according to Allred and police know some of the teens were involved in gang activity. Police know that there were basketball practices going on in the area and hope that those individuals will come forward with information. Authorities have not located the suspect vehicle and have not released details on the vehicle. Police have not reported an arrest.

It is the 24th criminal homicide in Wichita in 2019.

Passing motorist alerts residents to Kansas house fire

RENO COUNTY — Authorities are working to determine the cause of a fire at a home in Hutchinson.

Just after 1:30a.m. Friday, fire crews responded to a structure fire at 14 East Bigger Street, according to Fire Chief Steve Beer.

Upon arrival, fire crews were faced with a one-story residential home with heavy fire coming from 50 percent of the structure at the rear of the home. All occupants were out of the home upon fire crew’s arrival.

Due to the amount of heavy fire showing and adjacent structure that was being threatened by fire, fire crews went into defensive operations. Multiple handlines and an aerial ladder were used to contain the fire. There was extensive damage to the entire attic space and rear portion of the home, according to Beer. Fire crews remain on scene completing salvage and overhaul. Fire Investigators are working to determine the cause.

A single resident was alerted by a passing motorist that was driving down the street and noticed the residence on fire. The home had no working smoke detectors in it at the time of the fire.

With the recent cold weather, and added heating devices, HFD reminded citizens about the importance of having a working smoke detector. Smoke detectors do save lives. HFD also wants to remind our citizens that we have a smoke detector program, please call 620-694-2871. Fire crews will be canvasing the neighborhood tomorrow and talking to residences about fire safety.
