Kansas man sentenced for octopus found in boy’s throat

WICHITA, Kan. (AP) — A southern Kansas man who admitted to endangering a child after a 2-year-old boy in his care ended up with an octopus lodged in his throat has been sentenced to two years of probation.

Thirty-seven-year-old Matthew Gallagher also was sentenced Thursday to a suspended one-year jail term. Gallagher pleaded guilty to a reduced count of child endangerment, and additional charges of battery and interference with law enforcement. All are misdemeanors.

The boy’s mother told investigators she returned from work April 5 to find Gallagher performing CPR on her son at her Wichita home. A small octopus was found in the boy’s throat. He was treated then released from a hospital.

Gallagher originally was charged with a felony count of aggravated child endangerment and was scheduled for a Nov. 7 trial.

SALINE COUNTY – Law enforcement authorities in Saline County are investigating a suspect for alleged child abuse.

Salina Regional Hospital staff called Police after treating an infant for burns to his lower extremities, according Police Captain Mike Sweeney.

The infant was suffering from 2nd degree burns on the lower legs that may have occurred while the child was in the care of 27-year-old Michael Bryant at a south Salina home.

Bryant was arrested and booked into the Saline County Jail on a requested charge of child abuse, inhuman corporal punishment.

The child was transferred to the burn unit at Via Christi St. Francis Hospital in Wichita for further treatment, according to Sweeney.

LINCOLN COUNTY- Fire investigators in Lincoln County have confirmed a gas leak was responsible for Wednesday morning’s house explosion and fire at a rural residence on 290th Road south of Beverly, according to Sheriff Mike Weigel.

Connie Whelan, 59, was home at the time of the blast and remains hospitalized in critical condition in Wichita, according to Weigel.

Her husband William was at work in Salina.

A neighbor just south of the residence heard the explosion, drove to the scene and called emergency responders.

The Kansas Fire Marshal’s office assisted with the investigation.

“We have not determined the point of ignition,” said Weigel.

Beverly is located approximately 36 miles northwest of Salina on K-18 Highway between Lincoln and Tescott.

Hyundai issues vehicle recall; sunroof can fly into traffic

screen-shot-2016-10-20-at-10-11-35-amDETROIT (AP) — Hyundai is recalling nearly 63,000 midsize cars in the U.S. because the panoramic glass sunroofs can come loose and fly into traffic.

The recall covers certain Sonata midsize cars from the 2015 and 2016 model years, including gas-electric hybrids.

The South Korean automaker says in government documents that a wind deflector anchor plate in front of the sunroof wasn’t bonded properly to the car. A loose deflector can detach and interfere with the roof as it closes. If the owner tries to force the roof closed, it can fly off.

The company says it has no reports of accidents or injuries due to the problem. But Hyundai had several reports of detached sunroofs in the U.S.

Dealers will repair the wind deflector anchor plate at no cost to customers. Owners will be notified by mail in December about when to take their cars in for service.

Suspect arrested in West Virginia for Kansas road-rage killing

SHAWNEE COUNTY -Law enforcement authorities in Shawnee County are investigating a road rage shooting and report another suspect is in custody.

Just after 12:30 a.m. on October 8, police reported to a hospital in Topeka after gunshot victim, Michael Stadler, 28, arrived by personal vehicle, according to a media release. He died later that morning.

Police say Sadler was a passenger in a vehicle traveling near the intersection of SW 29th and SW Burlingame Road in Topeka, and became involved in a road rage argument.

On Thursday, the U.S. Marshall’s Fugitive Task Force and local law enforcement arrested a second suspect Andre Rhoiney, 22, Topeka, in Bluefield, West Virginia. He was taken into custody during a call for service at the local bus station, according to a media release. He faces first-degree murder charges.

On Tuesday, October 11, officers arrested Daniel Askew, 27, in connection with shooting.

Askew was booked into the Shawnee County jail for conspiracy to commit first-degree murder.

SUMNER COUNTY – An earthquake shook portions of Kansas on Thursday morning.

The USGS reported the 3.6 magnitude quake at 7:14 a.m. was centered approximately 13 miles southwest of Caldwell in Sumner County.

No damage or injuries reported early Thursday, according to Emergency Management officials in Sumner County.

Kansas officer shoots at suspect during failed arrest attempt

officerinvolvedshootingSHAWNEE, Kan. (AP) — Authorities say a suburban Kansas City officer has shot at a suspect who then fled in a vehicle and remains at large.

Police said in a news release that it’s not clear whether the suspect was injured Thursday during the failed arrest attempt at a Shawnee convenience store.

The release says an officer from Shawnee asked for help from an officer from neighboring Lenexa after checking a license plate. The check showed that a person associated with the vehicle had an outstanding warrant.

While attempting an arrest, the Lenexa officer fired his weapon. The release offered no other details about what led up to the shooting or the warrant.

The Lenexa officer suffered minor scrapes and has been placed on paid leave amid an investigation. The other officer wasn’t hurt.

Police search for Kansas man in connection with shooting, burglary

SHAWNEE COUNTY -Law enforcement authorities in Shawnee County are investigating a shooting and continue to search for a person of interest.

Just before 2 a.m. on Wednesday, police were dispatched to St. Francis Hospital after a shooting victim arrived by private vehicle, according to a media release.

Officers spoke to a victim who told them he was shot while in the 400 Block of SE Winfield in Topeka.

He identified the suspect as a medium build, black male with braided hair in his 20s.

Police are looking for Deontay Kashif Spearman, 26, Topeka, as a person of interest in the aggravated battery and burglary.

The victim suffered non-life threatening wounds and is expected to make a full recovery. His name was not released.

Kansas man dies in head-on semi crash

CHASE COUNTY – A Kansas man died in an accident just after 1:30p.m. on Wednesday in Chase County.

The Kansas Highway Patrol reported a 2015 Dodge Ram driven by William T. Lamey, 72, Elmdale, was westbound on U.S. 50 one mile west of U Road.

The pickup went left of center and struck a semi head-on.

Lamey was pronounced dead at the scene and transported to First Coroner Kansas City.

The semi driver Gilberto Antonio Cisneros, 38, Emporia, was taken to Newman Memorial Hospital in Emporia, then flown to Wesley Medical Center in Wichita.

The drivers were not wearing seat belts, according to the KHP.

2 jailed after drugs found on Kansas community college campus

HUTCHINSON– Two people arrested at the dorms at Hutchinson Community College Tuesday on drug charges made first appearances in court Wednesday.

Rheim D. Guerrero, 22, and Savannah Smith, 23, both of Salina were arrested at 1501 North Ford for possession of marijuana with intent to distribute within a thousand feet of Graber School and possession of drug paraphernalia.

Officers indicated they found a backpack in room 220 that contained a jar with the suspected marijuana inside the residence as well as a small scale. The amount of marijuana was allegedly around 22-grams.

The suspects allegedly admitted that they had smoked marijuana earlier in the day, that according statements made in court.

Both requested a reduction of their $5,500 bonds stating that they had children in Salina that they needed to take care.

Magistrate Judge Cheryl Allen denied the request and they are expected back in court next week.

Kansas cites slavery-era ruling in abortion case, backpedals

WICHITA, Kan. (AP) — Kansas Attorney General Derek Schmidt is withdrawing a court brief that cites the slavery-era Dred Scott decision to support the state’s position that the Kansas Constitution does not guarantee a right to an abortion.

Schmidt said Wednesday in a statement that the filing submitted to the Kansas Supreme Court a day earlier does not accurately reflect the state’s position and should not have been made.

The state used the 1857 Dred Scott case to bolster its argument that the Declaration of Independence had no legally binding effect.

Schmidt says the reference was “obviously inappropriate,” and he ordered it withdrawn once he became aware of it.

In the infamous decision, the U.S. Supreme Court ruled a black person whose ancestors were sold as slaves could not be a U.S. citizen.

Kan. cold case reopened, body of victim in 1974 killing exhumed

screen-shot-2016-10-19-at-4-08-08-pmDickinson County- In April, the Dickinson County Sheriff’s Department was notified by the Kansas Bureau of Investigation (KBI) of a possible match between unidentified remains found near Upland in Dickinson County in 1974 and a person reported missing from Tulsa, Oklahoma in 1974, according to a media release.

This match was the result of communication between databases maintained by the Doe Network (www.doenetwork.org) and the National Missing and Unidentified Persons system (NamUS) (namus.gov).

Investigation conducted by the Sheriff’s Department determined it was necessary to exhume the remains of the unidentified victim to attempt to determine if the remains were in fact the missing person.

On Wednesday morning, the Sheriff’s Department and the KBI exhumed the remains.

Forensic Anthropologist Dr. Michael Finnegan of Forensic Anthropological Consultants, LLC; employees of the Abilene Cemetery and employees of the Martin-Becker-Carlson Funeral Home assisted officials.

The remains will be sent to a laboratory for comparison with information provided in the Tulsa, Oklahoma case.

Investigation conducted in 1974 by the KBI indentified a serial killer, Cecil Henry Floyd, as the suspect in the Dickinson county case. Investigative reports indicate that Floyd admitted to killing 11 individuals, four killings in Florida, one killing in Kansas, and one killing in Nebraska and the remainder of the killings in Indiana.
