3 charged in robbery of unconscious Kansas driver

WICHITA (AP) — Three men are facing felony criminal charges in connection with the robbery of an unconscious woman whose purse and wedding ring were taken as she sat unconscious in the drive-thru of a fast food restaurant in Wichita.

The three suspects made their first court appearance Wednesday through a video feed.

Charged with robbery are Daquantrius S. Johnson; Quanique D. Thomas-Hameen; and Keith Byron Hickles.

Their defense attorneys did not immediately return phone messages seeking comment.

Danielle Zimmerman was pulling into a Taco Bell on Dec. 29 when she suffered a brain aneurysm. While unconscious, someone took her purse, a cellphone and her wedding ring. The ring hasn’t been recovered.

The case has sparked outrage in Wichita and prompted the mayor to implore the public to help recover the ring.

Rape trial underway in Reno County District Court

HUTCHINSON — The trial for a former Mulvane area man accused of rape, aggravated sexual battery and breach of privacy began Tuesday in Reno County District Court.

Jodie Mosier is accused of taking pictures of the victim when she should have had the expectation of privacy. This alleged crime occurring at the same time as the rape and sexual battery of a then 32-year-old woman at M&M Point at Cheney Lake on May 30, 2010.

On the stand Tuesday afternoon was Wichita Police Detective Virgil Miller, who works in the department’s Exploited and Missing Child Division. He testified on the investigation and said authorities seized the defendants computers and allegedly found evidence of the crime of rape. That included photos of the victim, when and where they were taken, which indicates Cheney Lake. Miller says they believe the photos were taken using a cellphone at the lake.

The victim reportedly had been drinking at the lake and might have passed out, according to testimony, and that’s when the alleged sexual assault occurred. Miller testified the incident allegedly occurred during an extended family camping trip over Memorial Day weekend.

The case is being tried in front of Judge Tim Chambers and continues today.

Four sentenced, one pleads in Dodge gang case

WICHITA — Four members of a Dodge City street gang were sentenced and another pleaded guilty Monday in a federal racketeering case, U.S. Attorney Barry Grissom said Monday

Sentenced were:
Gonzalo Ramirez, 28, Dodge City, who was sentenced to life plus 57 years.
Pedro Garcia, 27, Dodge City, who was sentenced to life plus 32 years.
Donte Barnes, 22, Dodge City, who was sentenced to 32 months.
Jesus Flores, 28, Dodge City, who was sentenced to time served of 20 months.

Jayson Vargas, 31, Dodge City, pleaded guilty to one count of unlawful possession of a stolen firearm. In his plea, he admitted that on Aug. 20, 2011, he was driving a car in pursuit of his former girlfriend, who was in another car. During the chase, he pointed a handgun at her. Officers of the Ford County Sheriff’s Office stopped Vargas’ car and arrested him. They seized a .45 caliber handgun.

Vargas is set for sentencing March 24. He faces a maximum penalty of 10 years in federal prison and a fine up to $250,000.

Pedro Garcia was convicted in a jury trial on count one (conspiracy to commit racketeering), count two (conspiracy to commit murder), count three (murder), count four (attempted murder), count five (assault with a dangerous weapon), count six (possession and discharge of a firearm during a violent crime), count seven (assault with a dangerous weapon), count eight (conspiracy to commit assault with a dangerous weapon), and count nine (brandishing a firearm during a crime of violence).

Donte Barnes pleaded guilty to one count of attempted murder in aid of racketeering.

Jesus Flores pleaded guilty to one count of assault with a dangerous weapon in aid of racketeering and one count of conspiracy to commit assault with a dangerous weapon in aid of racketeering.

The defendants were among 23 members of the Norteno street gang indicted in May 2012. It was only the second time a federal RICO Act indictment (Racketeer Influenced and Corrupt Organizations Act) had been filed in Kansas. Twenty two defendants have been convicted. Charges were dismissed without prejudice against defendant Adam Flores.

Grissom commended the Dodge City Police Department, the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Ford County Sheriff?s Office, the Ford County Attorney’s Office, the Kansas Bureau of Investigation, Assistant U.S. Attorney Lanny Welch and Assistant U.S. Attorney Aaron Smith for their work on the case.

Police frustrated over four unsolved killings in Kansas

WICHITA (AP) — Wichita police say the city’s residents can feel good about having one of the lowest homicide totals in a decade last year with 16.

But it’s the four that remain unsolved that have local law enforcement frustrated because nobody is stepping forward with information that could bring the killers to justice.

The Wichita Eagle reports two of the unsolved homicides were gang-related, while the other two involved gang members.

Two of the victims — 27-year-old James Gary Jr. and 25-year-old Kolby Hopkins — were shot in the midst of large crowds.

Aaron Bohannon was with Hopkins when he was fatally shot in the city’s Old Town district. Bohannon says it’s tough to start the healing process without knowing who is responsible for taking his friend’s life.

Reward offered in theft from dying Kansas woman

WICHITA (AP) — Police are looking for a man who was in a silver car near where a Wichita woman was robbed after she died at a fast-food restaurant.

Danielle Zimmerman died Dec. 29 after suffering a brain aneurysm while pulling into a Taco Bell, causing her truck to hit a speaker in the drive-through lane. Someone took her purse, phone and wedding ring before help arrived.

Wichita police said the restaurant’s manager saw a man get out of a silver car and apparently approach Zimmerman’s truck. By the time the manager got outside, the man was pulling out of the parking lot.

Crime Stoppers is offering a reward of up to $2,500 for information leading to an arrest in the case.

Man in custody after New Year’s Day homicide (UPDATE)

Pottawatomie Sheriff’s DepartmentST. MARYS (AP) — A suspect has been charged with killing a northeast Kansas man who was driven to a police station after being shot.

Pottawatomie County authorities said passengers in the car called deputies to the St. Marys police station around 4:30 a.m. Wednesday. The deputies found Levi W. Bishop, 24, Rossville, dead with a gunshot wound.

Prosecutor Sherri Schuck told WIBW-TV on Thursday her office has charged Pablo Alberto Gonzalez, 21, with second-degree murder. The St. Marys man was being held on $1 million bond and did not have a lawyer.

Authorities said Bishop had been a passenger in Gonzalez’s car.
