5-A Sub-State Basketball Tourney Brackets Now Set; 3A Set

 

The 8 schools assigned to a site will be divided into 2 sub-state tournaments with all games being played at the higher seeded team. First round games will be played at the higher seeded team on Wednesday, February 27 (Girls 5A) and Thursday, February 28 (Boys 5A).

Finals will be played at the higher seeded team: Friday – Girls 5A; Saturday Boys 5A.

The Lady Indians are the seven seed and will play at Salina South Wednesday at 7:00. Hays lost in overtime to the Cougars back in January.

The boys will host rival Great Bend as the two seed.  Game time is 7:00 on Thursday. Great Bend beat the Indians in their only meeting. The loss was the first for Hays after starting the season 7-0. The regular season finale was cancelled between the two on Friday due to the winter weather.

The #8 Seed TMP girls will open Sub-state play on Thursday at #4 Hoisington

The #4 Seed TMP boys will host Russell on Friday night.

Cause of Fire Still a Mystery

The cause of Wednesday’s fire that destroyed Abilene’s historic Kirby House Restaurant remains a mystery.

The State Fire Marshall spent Friday on the scene. The blaze started about 6 p.m. on Wednesday and the building is considered a total loss.

Kirby House FireOn their Facebook page, the restaurant owners wrote,” “Wednesday we suffered a devastating fire at our restaurant,” the message says. “We have appreciated all the hard work and long hours that the firefighters and police have put in, for our sake. We would like to say thank you to every customer that came thru our doors. Also, thank you to everyone who has had wonderful comments and stories to share.”

Driver injured; hits KDOT Truck

A twenty five year old man remains hospitalized in Russell today after the car he was driving slid on I-70 and hit a KDOT snow-plow truck. The accident happened Friday near Dorrance.

Snow Storm Kills 4

Four deaths are now blamed on the winter storm that’s moved from the Plains states over the Great Lakes.

The fatalities include a Kansas woman who died after her car collided with a train. Authorities told The Wichita Eagle that witnesses said her car began to slide before the accident.

The storm has lost some strength as it moves to the northeast — leaving a half foot or so of snow in some areas, freezing rain in others — and not the foot and a-half that’s on the ground in parts of Kansas.

Students across a large area of Kansas spent a second day at home today. Schools were also closed in parts of Missouri, Michigan, Wisconsin and Minnesota.Walker 730 a.m.

Kansas Priest Honored

The Department of Defense has recommended that a Kansas war hero be awarded the Medal of Honor.

Kansas congressional leaders announced Friday that Father Emil Kapaun will be recognized at a ceremony in April for his bravery during the Korean War.

Kapaun pulled wounded soldiers to safety and attended to their injuries during the battle of Unsan. He was taken prisoner along with other American soldiers and carried severely injured fellow soldiers on his back. He escaped prison camp to steal food from nearby farms, bringing food to starving soldiers. He cared for the sick, washed them and shared stories of faith.

Father Kapaun died at a North Korean prison camp after developing a blood clot and pneumonia in 1951.

Pat Robert, U.S. Senator, said the honor is long overdue.

“I have been especially moved by the many stories of those who served with him and witnessed his acts of extreme valor,” Roberts said. “These soldiers have been waiting for this award for a long time, and tonight we know that the Medal of Honor will be posthumously awarded to their friend and hero.”

Rep. Todd Tiahrt began the Medal of Honor campaign in 2000. But it was not until last year the Kansas congressional delegation offered legislation in both the House and the Senate to waive the time limitation and award the Medal of Honor. The legislation was included in the final Fiscal Year 2012 National Defense Authorization Act.

Local families have prayed to Father Kapaun for healing. The Vatican is considering whether he should be declared a saint.

Abortion Clinic Rezone Rejected

Despite 14 thousand signatures on a petition, the Wichita Planning Commission has rejected a request to rezone the former site of an abortion clinic.

The Metropolitan Area Planning Commission voted 6-4 against the proposal.

Abortion 001The vote follows the petition from the group “Kansans for Life” asking the city of Wichita to rezone the area where a clinic once operated, in an effort to keep another women’s clinic from opening there.

Big Changes at Sternberg Museum

It has been ten years since the Sternberg Museum Discovery Room has been updated. James Leiker with the museum told Hays Post that by mid April, visitors will be impressed with the changes. “We are totally redoing the Discovery Room. We will have all new technology for kids, an amazing whale skull and a fun new shark coming out of the ceiling, among other things.”

The museum is also preparing for their March 30 Easter egg hunt. “We’ll have 5000 eggs and expect just as big a crowd as last year,” Leiker said. Stay tuned to Eagle Radio and Hays Post for more details as the new Discover Room is completed.Sternberg 001

Kansas AG: Support Second Amendment

Kansas Attorney General Derek Schmidt has joined attorneys general from 19 other states in asking the US Supreme Court to affirm the Second Amendment rights of citizens who wish to lawfully carry concealed handguns outside their homes.

The attorneys general have asked the Supreme Court to review a lower federal court’s ruling that had upheld the authority of a state to limit the right to keep and bear arms to an individual’s home and also had allowed states to require that a permit application show a reason the permit is needed.

“The Second Amendment clearly protects the rights of our citizens to keep and bear arms, and in 2010 Kansas voters made clear their view that the right to keep and bear arms is an individual right,” Schmidt said. “Legally permitted concealed carry of handguns falls within that right and the Supreme Court should affirm that. This is an opportunity for the Supreme Court to clarify its recent decisions in favor of Second Amendment rights.”

The pending case is Kachalsky v. Cacaces. The states petitioning the US Supreme Court include Alabama, Alaska, Arizona, Arkansas, Florida, Georgia, Idaho, Kansas, Michigan, Montana, Nebraska, New Mexico, North Dakota, Oklahoma, South Carolina, South Dakota, Texas, Utah, Virginia and West Virginia.

Home Invasion, Stabbing Suspects Remain at Large

Law enforcement officials are still looking for three suspects in connection with Monday’s home invasion and stabbing of a Hutchinson man. Police have issued a state-wide attempt to locate for Troy Lavon Bell, Desmond Cantu and his brother, John Cantu.

One suspect in the case has been arrested and another turned himself in to authorities early Thursday. They have been booked into jail on suspicion of attempted first-degree murder, aggravated battery, aggravated assault with a deadly weapon and aggravated burglary.

Legislature Considers Opposing Medicaid Expansion

medicaid-300x225TOPEKA, Kan. (AP) – A Kansas House committee is considering a resolution declaring the Legislature’s opposition to expanding Medicaid following the federal government’s overhaul of health care.

The Appropriations Committee was having a hearing Friday. The measure says the Legislature doesn’t want to expand Medicaid to make tens of thousands of additional people eligible for the program covering health care for the needy.

Republican Gov. Sam Brownback is a vocal critic of the federal health care law enacted in 2010. But he’s said he’ll leave a decision on expanding Medicaid to the GOP-dominated Legislature.

The federal government has committed to paying almost all costs associated with the expansion, but many Republicans doubt the promise.

The administration and Kansas Hospital Association have released conflicting studies on the expansion’s potential cost to the state.

Legal Trouble for “Anonymous” Online Commenters: Joan Jerkovich

social-media-tips-for-professionalsBefore you hit the enter button to post a comment on your favorite blog, social media, or online site, be forewarned that if your comment can be proven in a court of law to contain a libelous statement about an individual or business you can be sued for damages.

As the Internet has become an increasingly popular reporting and social media tool, libelous claims have risen.  Two criteria apply.  If your post can be proven false, and proven that it was published with the intention of harming that entity’s reputation, the offended party has a case against you.

The defense tool you hold is the truth.  If what you are posting is the absolute truth and can be proven to be so, your post, no matter how damaging to a person or businesses’ reputation, is not libel.  Keep in mind, however, that defending your comment as truth can be difficult and expensive and in any legal claim, your position of “truth” is not assured.

So what happens if you are posting “anonymously”?  If you don’t know it by now, you are not as anonymous as you might think.  Your identity can be traced.  Numerous court cases have forced Internet Service Providers (ISP’s) to provide information and the IP address of known offenders.

So, before you post that comment, listen to my podcast for answers to the following questions:

  • Do you have to use a persons name to be sued?
  • Can you also be sued if you just agreed with the libelous comment?
  • What is the statute of limitations for online defamation?
  • Can the ISP and host website also be sued for libel?
  • My caller, a public figure in her community, was falsely accused of having an affair.  Does she plan to sue the commenter?
