Elderly Kansas man sentenced for sex crime

Jail - Prison - Bars 003A Minneapolis man was sentenced Tuesday to nearly 13 years in prison after being convicted of sex crimes earlier this year, Kansas Attorney General Derek Schmidt said.

79-year-old Bernard Wallin, was sentenced to 155 months in the Kansas Department of Corrections by Chief Judge Jerome P. Hellmer in Ottawa County District Court. An Ottawa County jury found Wallin guilty in August of one count of rape, three counts of aggravated criminal sodomy and two counts of aggravated sexual battery.

The charges stemmed from an investigation by the Minneapolis Police Department and Kansas Bureau of Investigation. Assistant Attorney General Steve Karrer of Schmidt’s office prosecuted the case.

After earning a berth to the NCAA Tournament, the Fort Hays State University men’s soccer team re-entered the National Soccer Coaches Association of America (NSCAA)/Continental Tire Division II Men’s Soccer poll at No. 20, announced Tuesday.

The Tigers had dropped out of the poll but still received votes the week prior, but used a runner-up position in the MIAA Championship to move back into the rankings.

FHSU, ranked second in the Central Region, awaits a matchup with No. 1 (overall and in the region) Lindenwood in the NCAA Tournament on either Nov. 21 or 22 at a site to be determined.

MIAA foe Northeastern State remained in the poll at No. 24.

Amtrak routes in jeopardy

 amtrak(AP) — An Amtrak official says New Mexico, Colorado and Kansas communities face the potential loss of passenger rail service if a new agreement isn’t reached by 2016 for maintaining and upgrading portions of the Southwest Chief route through those states.

Amtrak’s state government relations chief Ray Lang proposed to a legislative committee on Tuesday that Amtrak split the costs of maintenance and capital improvements for more than 600 miles of track with the states and Burlington Northern Santa Fe, which owns the line but uses only a portion of it for freight trains.

Lang and northeastern New Mexico governmental officials asked lawmakers to consider a cost-sharing arrangement for each of the states to spend about $4 million annually for a decade to keep the Southwest Chief on its current route.

There were fewer Boy Scouts than usual attending the Fall Merit Badge Event in Hays.

“About 50 Scouts were here Saturday, mostly from Troop 101, United Methodist Church, and Troop 133, First Presbyterian Church in Hays,” said Troop 101 Assistant Scout Master Steve Urban.

“We know we were competing with football playoff games and pheasant hunting opening weekend.”

Still, those in attendance had their pick of 14 Eagle Merit badge offerings.

Seven of the badges are required:  Citizenship in the Nation, Citizen in the World, Cooking, Family Life, Personal Management, Swimming, and Sustainability.   Seven other are elective:  Art, Auto Maintenance, Energy, Graphic Arts, Scout Heritage, Soil and Water ad Traffic Safety.

The Cooking badge starts with the basics.  Registered Dietician Kristen Angell of the Center for Health Improvement, talked about using knives carefully, whether in the kitchen and around the campfire:

The scouts also spent part of their lunch break practicing the flag ceremony at Mount Allen cemetery on Vine Street.

Company Fined for “No-Call Act” Violations

courts-gavelA Missouri lawn service company will pay a $10,000 fine for violating the Kansas No-Call Act, Kansas Attorney General Derek Schmidt said today.

Pro Turf Lawn Service, Inc., Belton, Mo., agreed to a consent judgment ordering it to pay $10,000 in civil penalties and fees.  Beginning in October 2012, the Kansas Attorney General’s Office received complaints from four residents of Johnson County that the company called them to solicit the sale of lawn and landscaping products and services, although the consumers were on the Do Not Call list.

“Companies doing business in Kansas must respect Kansas laws,” Schmidt said.  “Consumers who have taken the time to register their phone numbers on the Do Not Call list have an expectation that their privacy will be respected.”

In addition to the fine, the company was ordered to refrain from further violations of the Kansas No-Call Act.  Judge Rebecca Crotty approved the judgment last week in Shawnee County District Court.

So far this year, the Attorney General’s Office has obtained judgments against 13 businesses for violations of the No-Call Act.  These companies have been ordered to pay a total of more than $1.7 million in penalties and fees.

Authorities in Riverside, Missouri say they stopped Chiefs wide receiver Dwayne Bowe for speeding Sunday, but they booked him after they found marijuana in his car.

Bowe was stopped just before midnight Nov. 10 at West Platte Road and Riverside Street for speeding. Officers said Bowe’s Audi A8 registered a speed of 48 mph in a 35 mph zone.

The traffic officer says he detected a strong odor of marijuana from inside of the vehicle.

A police dog alerted to an illegal substance. The officer found a black bag and inside it were Bowe’s wallet and two containers containing more than ten grams of marijuana.

A passenger in the vehicle was also cited after the canine alerted to a backpack containing another 4.2 grams and the officer found two marijuana cigarettes in the man’s pocket.

Death of toddler under investigation

saline county sheriffs PatchThe Saline County Sheriff’s Office is involved in trying to determine if the death of a toddler is a case of abuse or accidental.

Sheriff Glen Kochanowski said Tuesday morning that an 18 month old boy was taken to Salina Regional Health Center on November 6th with a head injury.

After surgery was performed in Salina, the boy was then transferred to Children’s Mercy Hospital in Kansas City for further treatment. The boy died on November 8th, and an autopsy was performed on November 9th.

Kochanowski said the boy lived with one parent in Saline County, as well as the other parent in another Kansas county which the Sheriff would not disclosed.

It is not known if the injury occurred in Saline County or at another location. In addition to the Sheriff’s Office, the Saline County Attorney’s office is involved in the investigation.

Kochanowski said his office is waiting for autopsy results to help determine the cause of the injury.

ellis county sherrif badgeThe Ellis County Sheriff’s Department is investigating the report of a burglary at a business located in the 1700 block of 130th Avenue in Ellis.

According to Ellis County Sheriff, Ed Harbin, a .50 caliber black powder rifle and other miscellaneous tools were taking from a welding shed at 1719 130th Avenue, in the early morning hours of November 6th.

The sheriff said the suspect gained access to the shed, where the rifle and tools were stored by cutting the lock.

Sheriff Harbin said the investigation is ongoing but they have identified a suspect in connection with the case.

Study: Recession hits young particularly hard

Economy - Money 001(AP) — Another study is finding that the financial crisis is having a lasting effect on young people.

Terri Friedline of the University of Kansas co-authored a study mapping the patterns in household net worth from 1999 to 2009.

The study found that children in households where net worth declined grew up to have only about $300 in savings. That’s 10 times less than the amount of children raised in fiscally stable households.

Friedline noted that $300 in savings isn’t enough to rent a first apartment. She says the findings emphasize the importance of encouraging children, especially those in low-income families, to begin saving money at a young age.

ACA Navigator Taking Appointments Again

The local Affordable Care Act Certified Navigator is taking appointments once again.

Last month, Sayre Shuck, the ACA Navigator in Hays was forced to postpone appointments because the Healthcare.gov website was not working. Shuck said Tuesday she is able to access the website and she is once again taking appointments to help people sign up and gain more information on the Affordable Care Act.

Shuck also said people can just stop in and talk with her about the law.

Shuck is based at the Hays First Care Clinic, although you don’t have to be a First Care patient.  Anyone can ask for her help, at no charge.

Monday night fire damages home

A clothes dryer fire Monday night damaged this house at 2301 E. 15th Street, Hays.

At 9:03 PM on Monday the City of Hays Fire Department, Police Department and Ellis County EMS were dispatched to a building fire in a house at 2301 East 15th Street.

On arrival, firefighters observed heavy smoke conditions and found a fire burning in the utility room and starting to spread into the rest of the house. Firefighters advanced one attack hoseline and one back-up hoseline to quickly control the fire. Ellis County EMS paramedics checked the occupants for injuries.

Occupants of the home were provided alternative housing by the American Red Cross, Hays.

The house suffered direct fire damage in the utility room and areas nearby as well as heat, smoke and water damage throughout. The fire started in the clothes dryer however the exact cause was not determined. The Red Cross assisted the occupants with alternate housing.
